An Alexis retractor, or AWR, which can measure 17 centimeters (6 inches) in diameter, was left inside the mother’s body following the birth of her baby at Auckland City Hospital in 2020.

The AWR is a retractable cylindrical device with a translucent film used to draw back the edges of a wound during surgery.

The woman suffered months of chronic pain & went for several checkups to find out what was wrong, including X-rays that showed no sign of the device. The pain got so severe that she visited the hospital’s emergency department & the device was discovered on an abdominal CT scan & removed immediately in 2021.

New Zealand’s Health & Disability Commissioner, Morag McDowell, found Te Whatu Ora Auckland – the Auckland District Health Board – in breach of the code of patient rights, in a report released on Monday.

During the operation in 2020, a count of all surgical instruments used in the procedure did not include the AWR, the commission report found. This was possibly “due to the fact that the Alexis Retractor doesn’t go into the wound completely as half of the retractor needs to remain outside the patient & so it would not be at risk of being retained,” a nurse told the commission.

The case has also been referred to the director of proceedings, an official who will determine whether any further action should be taken.

“We would like to assure the public that incidents like these are extremely rare, and we remain confident in the quality of our surgical and maternity care,” read a statement from Te Toka Tumai Auckland

(Reuters) - Donald Trump faced a new raft of felony charges on Tuesday after a Georgia grand jury used a law developed to take down organized crime gangs to charge the former U.S. president with trying to overturn his 2020 election defeat.

The charges, brought on Monday by Fulton County District Attorney Fani Willis charge Trump & 18 associates for a scheme intended to reverse his loss to Democrat Joe Biden.

The indictment listed 19 defendants & 41 criminal counts in all. All the defendants were charged with racketeering, which is used to target members of organized crime groups & carries a minimum penalty of 5 years in prison.

Mark Meadows, Trump's former White House chief of staff & lawyers Rudy Giuliani, Jenna Ellis & John Eastman were among those charged.

Trump & the other defendants have until noon Friday, Aug. 25, to surrender voluntarily, rather than face arrest. Willis said she intends to try all 19 defendants together within 6 months.

Trump called the indictment a "witch hunt" & accused Willis of trying to sabotage his presidential comeback bid.

He said he would release a report on Monday on "Presidential Election Fraud" that would exonerate him.

Since his defeat in 2020, Trump has repeatedly made false claims that the election was marred by widespread fraud. Those claims have been rejected by dozens of courts, state reviews & members of his own administration.

In a Jan. 2, 2021, phone call, Trump urged Georgia's top election official, Brad Raffensperger, to "find" enough votes to reverse his narrow loss in the state. Raffensperger declined.

Trump's supporters stormed the U.S. Capitol 4 days later in an unsuccessful attempt to prevent lawmakers from certifying Biden's victory.

PHILADELPHIA (AP) — Authorities searched Tuesday for 2 inmates — 1 accused of killing 4 people — who were gone from a Philadelphia prison for nearly 19 hours before officials knew they were missing.

Ameen Hurst, 18, & Nasir Grant, 24, escaped from the Philadelphia Industrial Correctional Center around 8:30 p.m. Sunday by cutting a hole in a fence surrounding a recreation yard.

Headcounts conducted at 11 p.m. Sunday, 3 a.m. Monday & 7 a.m. Monday reportedly showed that all prisoners were accounted for, said Philadelphia Prisons Department Commissioner Blanche Carney. The facility became aware of the escaped inmates at about 3 p.m. Monday, Carney said.

“We have protocols in place & those protocols were not followed,” Carney said. “That yard should have been secured & the fence not breached.”

Mayor Jim Kenney said at a news conference Monday evening that they want to find out exactly what happened.

“Clearly the system screwed up & people didn’t do what what they’re supposed to do,” Kenney said.

Hurst was arrested in March 2021. He’s accused of shooting & killing a man on Christmas Eve 2020. The other 3 shootings happened in March 2021.

Grant was being held on conspiracy drug charges & conspiracy weapons charges. The inmates were housed in the same unit, but different cells.

Dwyane Wade's ex-wife is fighting a legal petition to allow their daughter to change her gender and name, claiming the child is being pressured financially to make this monumental decision.

Former NBA star Dwyane Wade's ex-wife, Siohvaughn Funches-Wade, filed an objection to his petition for recognition of their daughter Zaya's change of gender & issuance of a new birth certificate. As you know, Wade's daughter is transgender & is asking to legally be identified as a female. The issue is that she is only 15 years old & must get a court order & permission from her parents to make the change.

Siohvaughn claims her famous ex-husband is "attempting to circumvent the requirements of the Illinois final custody order judgment entered on March 14, 2011. Siohvaughn says the former couple's final custody order provides parental consultation and that Dwyane "shall discuss with & obtain input in the major decisions affecting care, welfare, activities, health, education and religious upbringing" of their 2 children prior to any major decisions being made.

Siohvaughn claims, "There are multiple factors to be considered by the Court in determining the requests to change the minor child's name & gender. The minor child is 15 years old." Adding, Dwyane "is positioned to profit from the minor child's name & gender change with various companies through contacts & marketing opportunities including but not limited to deals with Disney."

Dwyane's ex-wife is straight up saying the child might be influenced by an opportunity for the NBA star to make money if the gender change is completed.

SACRAMENTO, Calif. (AP) — A Northern California mother of 2 was sentenced Monday to 18 months in prison for faking her own kidnapping so she could go back to a former boyfriend, which led to a three-week, multi-state search before she resurfaced on Thanksgiving Day in 2016.

Sherri Papini, 40, pleaded guilty last spring under a plea bargain that requires her to pay more than $300,000 in restitution.

“Papini’s kidnapping hoax was deliberate, well planned & sophisticated,” prosecutors wrote. "And she was still falsely telling people she was kidnapped months after she pleaded guilty in April to staging the abduction & lying to the FBI about it"

So “in pursuit of a non-sensical fantasy,” The married mother fled to a former boyfriend in Southern California, nearly 600 miles south of her home in Redding. He dropped her off along Interstate 5 about 150 miles from her home after she said she wanted to go home.

Passersby found her with bindings on her body, a swollen nose, a blurred “brand” on her right shoulder, bruises & rashes across her body, ligature marks on her wrists & ankles & burns on her left forearm. All of the injuries were self-inflicted & were designed to substantiate her story that she had been abducted at gunpoint by 2 Hispanic women while she was out for a run.

Days after police in the Lehigh Valley shot & killed a giant snake that had wrapped itself around the neck of a 27-year-old man, the man died from his injuries.

The Lehigh County Coroner's Office reported Monday that Elliot Senseman, a 27-year-old Upper Macungie Township man, died Sunday morning at Lehigh Valley Hospital, Cedar Crest.

The coroner ruled the cause of death as "Anoxic Brain Injury due to Asphyxiation by Constriction." The manner of death was ruled an accident.

"A Boa Constrictor type snake approximately 18’ in length constricted around the neck of Mr. Senseman, thus causing the anoxic brain injury (complete lack of oxygen to the brain)."

When Upper Macungie Township police officers arrived around 2:15 p.m. Wednesday, Senseman was already unconscious & in cardiac arrest in his Fogelsville neighborhood home. In an attempt to save the man, officers shot the boa in the head "without risking further injury to the male" & killed it.

It was a pet snake that had grown enormous, police said.

Police originally said the snake was at least 15 feet long. On Monday, the coroner's office said the snake was actually 18 feet long.

Senseman was pulled from the snake's grasp after the gunfire & rushed to the hospital.

The county coroner's office & the the Upper Macungie Township Police Department continued to investigate the incident.

The gunman, Salvador Ramos, who authorities say killed 21 people in a South Texas community – 19 of them elementary school students – legally purchased two rifles in the days following his 18th birthday, authorities said.

Officials said they recovered the two AR-15 style rifles from the scene at Robb Elementary School in Uvalde. The gunman, who had attended Uvalde High School, purchased one of the rifles from a federally licensed gun store on May 17, the day after his 18th birthday, according to authorities and Sen. John Whitmire, D-Houston, who said law enforcement officials briefed him on the purchases.

A day later, on May 18, the gunman purchased 375 rounds of ammunition. And on May 20, he purchased the second rifle.

That's four days before Tuesday's massacre, which ended in the deaths of the students and two adults.

At 11:32 a.m., a person called police reporting a crash at the school, and a man with a gun exiting the damaged vehicle.

The man left one rifle in his truck, according to officials. He took the other and walked toward the school, also carrying a backpack containing several magazines of ammunition.

He dropped that backpack near the school entrance. But inside, investigators found seven 30-round magazines – though it's not clear if they contained live rounds.

In Texas, people who are 18 or older are legally allowed to buy long guns, such as rifles or shotguns. With few exceptions, they must be 21 to purchase a handgun.

HOUSTON (AP) — Cleveland Browns quarterback Deshaun Watson must say whether he had sex with 18 massage therapists who supported him last year following criminal complaints, a judge in Texas ruled Tuesday.

USA Today reported that Watson has 30 days to comply. He previously would not address his past with the therapists. Watson also has to provide other information about his massage history since 2019, including any language in his contract with the Texans about massages.

One of the NFL’s top quarterbacks, Watson was traded last month from Houston to Cleveland.

He has been accused by 22 women of sexual misconduct during therapy sessions, many of which he arranged by contacting the therapists on social media in 2020 and 2021.

To this point, two grand juries have declined to indict Watson on 10 criminal complaints filed to Houston police. He still faces the civil suits and has been giving depositions on those for several weeks.

As part of those civil lawsuits, the women’s attorneys want Watson to answer written “requests for admission” about whether he had sex with the 18 therapists who backed him after the first lawsuits against him were filed in March 2021.

The plaintiffs’ attorneys say the answers would demonstrate a pattern and motives for setting up the massages.

Those charged face a count of conspiracy to commit health care & wire fraud.

Williams, a 34-year-old Seattle native who spent four seasons in he NBA, was described as the leader of the plan to submit false claims to the league's health care plan, federal prosecutors out of New York City said.

He would allegedly supply false invoices to support the fraudulent claims in exchange for kickback payments that totaled at least $230,000, authorities said.

The phony medical procedures, some set on dates when the players were out of the country, were allegedly marked to have come from a chiropractic office, two dental offices & a wellness office.

At 6 feet, 9 inches & 289 pounds, he was a fan favorite & member of the last Boston Celtics world title team in 2008.

Telfair, the cousin of longtime NBA player & Chinese basketball icon Stephon Marbury, was famous before he even set foot on the pro hardwood. He was one of his era's most well-known high school players and the 13th overall pick of the Portland Trail Blazers in the 2004 NBA Draft.

WASHINGTON, D.C. (Reuters) - The U.S. Capitol Police is increasing security in preparation for potential violence at a Sept. 18 rally in which followers of former President Donald Trump intend to show support for people arrested after the deadly January attack on the Capitol.

Department Chief Tom Manger will provide a security briefing to top lawmakers on Monday about the rally. The source said U.S. House of Representatives Speaker Nancy Pelosi has invited U.S. Senate Majority Leader Chuck Schumer, Republican Minority Leader Mitch McConnell & House Republican leader Kevin McCarthy to the briefing.

"We have a robust security posture planned for September 18th," the U.S. Capitol Police statement said. "All available staff will be working."

Citing an internal Capitol Police memo, CNN reported on Wednesday that law enforcement officials are bracing for potential clashes & unrest during the rally after seeing a noticeable uptick in violent rhetoric around the event on social media and discussion boards.

The "Justice for J6" rally, planned for the area around the U.S. Capitol, is intended to protest the treatment of the more than 600 people arrested for participating in the Jan. 6 siege of the building. Mobs of supporters of then-President Trump stormed the building while Congress was meeting to certify Joe Biden's November election win.

The demonstration is being organized by Look Ahead America, a nonprofit led by Matt Braynard, who worked on Trump's presidential campaign.

The Jan. 6 attack was the worst violence at the Capitol since the British invasion during the War of 1812.

Four people died on the day of the violence, one shot to death by police & the other three of natural causes. A Capitol Police officer who had been attacked by protesters died the following day. Four police officers who took part in the defense of the Capitol later took their own lives.

A 21-year-old Chanhassen man was indicted on charges of premeditated first-degree murder by a Carver County grand jury last week for shooting his sister 18 times inside their family home filled with hundreds of spent bullet casings.

Joseph T. Ness was initially charged with intentional second-degree murder in connection with the May killing of Noelle Ness, 25, according to Carver County attorney Mark Metz, but the jury came back Aug. 10 with the indictment.

An omnibus hearing for Ness is slated for Oct. 6.

Metz said in a statement on the indictment that Ness retains the presumption of innocence "unless and until the state proves every element of the charged crimes beyond a reasonable doubt." Metz offered no motive for the shooting.

According to court documents:

On May 8, deputies were dispatched to the Ness home on Landings Drive after the mother ran to a neighbor's house saying that "Joey shot and killed Noelle." That neighbor called 911 around 2:20 p.m. and about 45 minutes later, another nearby resident said Ness had walked onto her property confessing that he had just killed his sister. They called 911 and Ness was arrested and held in lieu of $1 million bail.

Inside the bullet-riddled home with many shot-out windows just off Lake Minnewashta., authorities found six rifles, including AR-15 and AK-47 variants, ammunition and high-capacity drum magazines.

Ness shot from his bedroom into his sister's room across the hall, according to the criminal complaint, but it noted that she was also shot from closer range "as rounds traveled vertically through her bed."

Oscar De La Hoya will face ex-UFC champion Vitor Belfort in a boxing match on Sept. 18, and likely to occur in Las Vegas, according to Sports Illustrated's Chris Mannix.

The fight will be billed as an exhibition match with both fighters wearing 12-ounce gloves, according to The Athletic's Mike Coppinger, who was the first to report the news of the fight.

The 48-year-old De La Hoya has not fought since losing to Manny Pacquaio in December 2008.

In March, De La Hoya announced plans to return to the boxing ring on July 3. Instead of a July fight, however, he will fight in September, which would mark more than a year from when De La Hoya first planned to come out of his retirement from boxing.

"The Golden Boy" won gold at the 1992 Olympics before winning the WBO junior lightweight title in 1994. He would win his first 32 professional bouts before finally being defeated by Felix Trinidad by majority decision.

Since he retired, De La Hoya battled addiction struggles while his career as a promoter thrived. But he began training his way back into shape, rediscovering the drive to return to the ring.

Belfort, 44, is tied for the third-most finishes in UFC. Per The Athletic, Belfort said in May that he was interested in fighting De La Hoya. Belfort's last fight was the UFC 224 in May 2018 when he lost to Lyoto Machida.

Belfort's only win of his boxing career came in April 2006 against Josemario Neves.

The legal teams representing Deshaun Watson & the women accusing him of sexual misconduct continued their public posturing Tuesday night & early Wednesday, as 2 more women filed lawsuits against the Houston Texans quarterback.

Watson's team, led by Rusty Hardin, issued a news release with on-the-record statements from 18 women who say they have previously had massage sessions with Watson & he never acted inappropriately.

Hardin pointed to the 18 statements in support of Watson as evidence that "the other side to this story that has been so lacking in the flurry of anonymous complaints filed by opposing counsel." He added that the women in the news release, most of whom are massage therapists, have collectively worked with Watson more than 130 times.

"Deshaun never made me feel uncomfortable or intimidated," massage therapist Masako Jones said in one of the statements. "... I am just completely floored by these lawsuits. The behavior described in them doesn’t sound like him at all."

Watson, 25, is now facing civil lawsuits in Harris County District Court from a total of 21 unnamed women – including 2 complaints that became publicly available Wednesday morning. The women have accused Watson of inappropriate conduct or sexual assault during separate massage sessions over the span of more than a year.

A 22nd woman came forward with similar allegations in a Sports Illustrated article this week, but she said she has not filed a lawsuit.

Watson has not been charged with a crime & broadly denied wrongdoing.

The NFL is investigating the allegations against Watson under the auspices of its personal conduct policy.

(CNN) Low-income families of color in Oakland, California, could receive some extra financial assistance over the next year and a half.

Oakland Mayor Libby Schaaf announced this week that the city will launch a guaranteed income project to give hundreds of Black and Indigenous families and people of color $500 per month for 18 months.
The project's payments will be unconditional, and recipients may spend the money however they choose.

The Oakland Resilient Families program is the latest trial of a "guaranteed income" system of wealth distribution, where residents are given a set amount of money per month to supplement the existing social safety net.

The project targets groups with the city's greatest wealth disparities, per the Oakland Equality Index, which reveals the median income for White households in Oakland to be nearly three times that of Black households.

"The poverty we all witness today is not a personal failure, it is a systems failure," Schaaf said in a statement. "Guaranteed income is one of the most promising tools for systems change, racial equity and economic mobility we've seen in decades."

Guaranteed income is different from Universal Basic Income (UBI), which would provide enough income to meet everyone's basic needs.

Instead, guaranteed income is only meant to supplement other wages and programs for low-income residents, helping to build the "income floor" on which people in poverty can begin to build financially secure lives.

Although the idea has seen a resurgence in recent years, it's not new -- Martin Luther King, Jr. advocated for it in his 1967 book, "Where Do We Go from Here: Chaos or Community?"

"I'm now convinced that the simplest approach will prove to be the most effective -- the solution to poverty is to abolish it directly by a now widely discussed measure: the guaranteed income," King wrote.

MINNEAPOLIS (AP) — A Black man who was sent to prison for life as a teenager took his first steps of freedom to the sound of ringing bells and cheering family members and supporters, hours after a pardons board commuted his sentence in a high-profile murder case.

Myon Burrell’s prosecution and harsh punishment raised questions about the integrity of the criminal justice system that put him away nearly two decades ago for the death of a young girl killed by a stray bullet. Earlier this year, The Associated Press and APM Reports uncovered new evidence and serious flaws in the police investigation, ultimately leading to the creation of an independent national legal panel to review the case.

Last week, the panel published its findings, saying there was a “failure to investigate that illustrates tunnel vision” and that evidence that could have helped exonerate Burrell was either ignored or minimized.

The panel said it saw no purpose served by keeping Burrell locked up, pointing to his age at the time of the crime and his good behavior behind bars.

Burrell’s request for a pardon was denied and he will have to spend the next two years under supervised release. But it was the first time in at least 22 years that Minnesota commuted a sentence in a murder case, according the the Department of Corrections.

The release was swift. Just hours after receiving the news, he walked out the front door of Stillwater prison into below-freezing temperatures. Dozens of bundled supporters, some holding signs and balloons, surrounded Burrell while cheering “Myon’s free! Myon’s free!”

After jumping into a waiting car, he was soon home. Friends and relatives filtered into the living room, greeting him with gifts and hugs.

“It’s just a blessing,” he said, while standing outside on the street searching the sky for the moon and stars, which he said he’s been longing to see.

Burrell has always maintained his innocence in the 2002 killing of 11-year-old Tyesha Edwards, struck in the heart while doing homework at the dining room table with her little sister. He told Minnesota’s Board of Pardons members Gov. Tim Walz and Attorney General Keith Ellison that his “heart goes out” to her family. The third board member, Supreme Court Chief Justice Lorie Skjerven Gildea, recused herself, citing prior involvement with the case.

A monthlong mission in Ohio recently turned up 45 missing children and led to 179 arrests, authorities said.

In an operation dubbed Autumn Hope, the US Marshals Service in Ohio and Virginia tracked the children, including a “high-risk” 15-year-old girl from Cleveland who was linked to suspected human trafficking, authorities said Monday.

Twenty other children were also located as authorities checked on their well-being.

During one of the missing children recoveries, a loaded gun was recovered. A 15-year-old boy had two warrants and is suspected in multiple shootings and a murder, authorities said.

Two other juveniles were found in West Virginia during a traffic stop, leading to the arrest of an adult male who was charged with concealment/removal of a minor child in Jackson County.

Autumn Hope was conducted by the marshals in conjunction with the Ohio Attorney General’s Office and the Central Ohio Human Trafficking Task Force, as well as the National Center for Missing and Exploited Children and state and local agencies in Ohio.

“My thanks to all personnel who have stepped up for this operation,” said Peter C. Tobin, US Marshal for the Southern District of Ohio. “These are the same personnel who hunt down violent fugitives every day. I’m incredibly proud of them and pleased that they were able to apply those same skills to finding missing children. I know Operation Autumn Hope has made a difference in a lot of young lives.”

The US Marshals have conducted similar operations before, including in Ohio.

Last month, they said 35 missing children, between the ages of 13 and 18 from the Cuyahoga County area, were located during Operation Safety Net. Just over 20 percent of the found cases were tied to human trafficking.

That same month, the marshals also announced the arrest of 262 suspects, including 141 gang members, and the recovery of five missing children in Oklahoma.

Thirty-nine children were found in Georgia during Operation Not Forgotten in August and eight missing kids were recovered in Indiana in September as part of Operation Homecoming.

The marshals have found missing children in 75 percent of cases the agency has received — and 72 percent of those cases were recovered within a week, officials said.

Since 2005, the agency has recovered more than 2,000 missing kids.
