A 22-year-old man accused of posing as a high school basketball star in West Texas was charged with sexual assault Friday after an underage girl reported having sex with him last summer when she thought he was a teenager, police said.
Guerdwich Montimer was arrested for the third time in four days, this time after a 16-year-old girl in Odessa told police and school district officials she had sex with him at a home in August when she thought he was 15-year-old Jerry Joseph, said Odessa police Cpl. Sherrie Carruth.
Officials said Montimer enrolled at a junior high school and later at Permian High School last year with a fake birth certificate from Haiti. Suspicions were raised recently after coaches at an amateur basketball tournament said they recognized Joseph as Montimer, a 2007 graduate of a Florida high school and a naturalized U.S. citizen from Haiti.
Montimer was being held in jail Friday on a $50,000 bond, according to a court affidavit released Friday.
Montimer was originally arrested Tuesday on a misdemeanor charge of failure to identify himself to a police officer, and school officials said he admitted that he wasn't Joseph. He was arrested again Thursday on a third-degree felony charge of tampering with a government document.
A jail official said Friday there was no information about whether Montimer had an attorney. The sexual assault charge, a second-degree felony, carries a sentence of two to 20 years in prison and a fine up to $10,000.
Based on information provided by the girl, investigators determined Montimer "intentionally and knowingly engaged in a sexual relationship with a 15-year-old juvenile and portrayed himself to be 15 years old when he was actually 21 years of age," Carruth, the Odessa police official, said in a statement.
Permian High School made the state basketball playoffs with Joseph helping lead the way as a sophomore star. Questions arose after the season, and Joseph was initially cleared by immigration authorities and allowed to return to the school.
The investigation continued, and a fingerprint from a passport found in his room matched one taken by Immigration and Customs Enforcement agents after the allegations surfaced, according to an affidavit. School officials said Montimer confessed after he was confronted with the new evidence.
His last name has been widely reported as Montimere, including by The Associated Press, but an affidavit released Thursday had several references to official documentation with Montimer, the spelling used by Odessa police.

Arizona Law SB 1070 continues to draw protests and heavy criticism. The law gives police authority to stop and question people they suspect are in the country illegally.
Cypress Hill and Pitbull are the latest to protest the law by cancelling their concerts in the state.
Cypress Hill posted a statement on their website explaining their decision.
“In a show of resistance to the criminalization of immigrant communities and in opposition to SB1070, recently signed into Arizona legislation, Cypress Hill has elected to cancel a performance scheduled in Tucson for May 21, 2010. This decision was made in an effort to show support and solidarity with those, undocumented and otherwise, being directly affected by this unconstitutional "law." Cypress Hill recognizes those living in the struggle for their basic civil rights. Rise Up!”
Pitbull has similarly issued a statement via his Twitter account.
"I am canceling my concert in Phoenix on May 31... How is the country we enjoy and love bcuz of its human rights, freedom, opportunity and that has been built by immigrants, now start 2 deny them??.. It is contradicting 2 everything the USA stands 4."
The bill, signed into law by Governor Jan Brewer in April is the nation's toughest on illegal immigration. It's aim according to Brewer is to "identify, prosecute and deport illegal immigrants."
However it has increasingly come under fire as being racist.
Pima County, Arizona Sheriff Clarence Dupnik has refused to enforce the law saying "what she (Governor Brewer) and the legislature has accomplished is morally wrong and a national embarrassment."
Just this past Thursday (April 13) the city of Austin,Texas voted to boycott Arizona by banning travel and business in protest of the law.
"I'm concerned that if they go to Arizona, as far as we know, we can't tell for sure that they'll be subjected to harassment and even the potential for false arrest," said councilmember Bill Spelman . "I'd like to be able to maintain their security by sending them elsewhere."
More states will be joining the boycott soon.

Rapper/Writer/Director/Actor/Businessman 50 Cent debuted the premier of his new film 'Caught In The Crossfire' for an excited audience in Grand Rapids, Michigan this week.
The locals not only got a chance to meet Fif, but they were also thrilled to see locations they recognized in the movie, since it shot entirely in Grand Rapids.
50 has fallen in love with the city. He and his company Cheetah Films have already shot three movies there including 'Caught In The Crossfire' and 'Gun'. The latter stars Val Kilmer. The plan is to shoot two more before the year is out.
On filming in the small town of Grand Rapids 50 had this to say:
This month production of 'Things Fall Apart' started. It's 50's most demanding role to date physically as he had to shed more than 50 pounds to accurately portray the role of a college football player suffering from cancer.
The film, written by 50 Cent and Brian Miller is being directed by Mario Van Peebles.
The man who has released an astounding 20 studio albums including compilations is preparing to drop a new 'Greatest Hits' CD.
Jay-Z's 'The Hits Collection Vol.1' will be released on June 29. The album will also include a booklet detailing the photographic history of Hov's career.
While no official tracklisting had been released yet, the audio player on the album's website, Jayzhitscollection.com, features the songs 'Public Service Announcement', 'D.O.A.', 'Run This Town', 'Empire State Of Mind' and 'Where I'm From'.

Kelis has revealed that she almost quit music to become a chef, after struggling to complete her last album.
The singer, who will release her new record 'Flesh Tone' on May 17, went to culinary school to train as a cordon bleu chef after making her last LP.
"I took four years off to have a little life between this album and my last album," Kelis told the Daily Record. "I studied to be a chef as a side thing, a little hobby that I enjoyed doing, but I ended up falling madly in love with the food and the lifestyle."
Explaining that the process of recording her 2006 album 'Kelis Was Here' "sucked the life out of [her]", the singer graduated from the course and now counts being a saucier chef as her speciality.
"I needed a break and going to culinary school turned a lightbulb on that I didn't have to make music," she said. "The people in the music business forget that not only is there an entire world of people out there who do not care what we do, we are not creating the wheel."

DALLAS — Petty complaints of a comfortable marriage have all melted away for Katy and Al Hayes.
The loving couple already had two children, but the arrival of their third child changed everything.
The last thing Katy really remembers is giving birth at her Houston-area home on February 10.
And then this:
"Waking up in the hospital with no arms and legs. And going, 'What's going on here?' And then he tells me. And his story will knock your socks off, cause I had no idea I was going through all that."
Katy Hayes was unconscious the entire time — unaware that a common Group A strep infection had set in, eating away at her body.
She was unaware of the incredibly difficult decision her husband made for surgeons to amputate her arms and legs in the hope that they could save her life.
"I decided that I loved her so much that the risk was worth it," Al Hayes said. "And if we came out and I had to spend a lifetime taking care of her that the risk was worth it to say that I didn't give up on her. Right? She's my best friend."
At first, Al admits he wondered if Katy would forgive him. He wondered if she could have a full life without a full body.
There is no doubt now.
"It's a complete miracle that I'm alive, so I'm so grateful... I'm so grateful," Katy said. "I wouldn't be here for my kids if they wouldn't have taken my arms and legs."
Katy Hayes may not have limbs, but she does have life and all that it represents.
"I've got three beautiful children, so I'm doing good," she said.
Katy says she will one day learn to walk — perhaps at the same time as her baby girl.
Doctors call Katy Hayes' recovery a miracle, saying she had less than a five percent chance of survival.
Group A strep is a bacterium found in the throat and on the skin. It typically causes mild illnesses, like a sore throat or a skin infection.
Katy Hayes' case is rare because the bacteria infected her muscles, fat, and skin tissue.

50 Cent warned rappers a long time ago "this is chess not checkers." The industry is about to witness the ultimate chess move by the G-Unit boss according to Tony Yayo.
While not spilling the beans completely on what 50 has planned, Yayo did tell XXL in a brand new interview that something big is coming.
“We was gonna go the independent route, ’cause we put out ‘Beamer, Benz or Bentley,’ all that’s independently,” he added. “That’s with no machine.” But it seems like 50 has something else up his sleeve."
Tony also talked a little bit about how being dropped from Interscope turned out to be a blessing in disguise.
“When I got dropped, I’m not gonna front. I was a little down about it,” he explained. “It’s not like it was because of the money, because Interscope, they advanced me for my second album. So I got money that I didn’t even deserve."
Everything happens for a reason, with his upcoming role in the movie 'S.W.A.T. :Firefight' and 50's big plans, things are coming back into focus for Tony Yayo and G-Unit.
“God works in mysterious ways and good things is happening now,” he told the Mag “The new opportunities are coming. I don’t wanna talk too much about them either ’cause I don’t wanna ruffle any feathers or anything, but 50 is definitely bringing G-Unit back to where it needs to be. “

An upcoming concert featuring rapper PITBULL has prompted protests in the notoriously conservative country of Malaysia.
The hip-hop star is due to perform at a dance musicfestival in the country on Saturday (May 15), but Pitbull's inclusion on the bill has sparked outrage amongst Islamist groups there - who have cited his performance style and lyrics as a cause for concern.
Around 300 Muslim protesters gathered in the capital city, Kuala Lumpur, on Friday (May14) to express their outrage at Pitbull's planned performance, as well as a new government ruling which will allow a sports gambling company to be set up in Malaysia.
Pan Malaysian Islamic Party (PAS) official Kamaruzaman Mohamad, says, "It's bad enough that he is named after a dog, but if you watch his video clip on YouTube, his performance and lyrics are against Malaysian cultural norms."
The protests were broken up by police, but no arrests were made, according to Reuters.
Strict Islamic groups in Malaysia frequently oppose pop concerts in the country - Beyonce scrapped a planned gig in Kuala Lumpur last year (09) after Muslim leaders slammed her sexy show, while other stars, including the Black Eyes Peas' Fergie have been forced to cover up and tone down their raunchy routines while performing in Malaysia.

New Orleans rapper Jay Electronica has started to build a nice buzz for himself. He started to get a lot of national recognition in 2009 when he released the Just Blaze produced banger "Exhibit C." Since then he's continued to dispel the myth that rappers from the South can't be lyricists.
To that end he recently caused a bit of a stir when he revealed that he once had beef with the Wu Tang Clan's Rza over remarks he made disparaging southern hip hop.
"I remember Rza said some ridiculously stupid things about the south," Jay said.
“Peace on RZA, that’s my brother,” he continued. “RZA had a great effect on me via the Wu Tang Clan and the music he did, I wouldn’t be who I am today if it wasn’t for the RZA and the Wu. But also RZA you said some crazy wild shit, and if you would have seen me at that time we might have had a physical altercation.”
"So I put in in a record called 'I Feel Good' that I did a long, long time ago. But peace to Rza, he's a beautiful black man. He's done a lot for our culture, a lot for our people and a lot for humanity in general."
Jay's interview caught the attention of The Drama King DJ Kay Slay who took to his Twitter to speak his mind on the matter.
"This jay electronica dude gettin real disrespectful towards New York n***as these days.. if he hates us so f*kin much why does he rap like us?"
"His f*kin interview just made my blood boil."
Jay responded via an interview on Shade 45's Angela Yee Show.
"Hold on Mr Kay Slay. I'm not rhyming like nobody, we all got our influences. And no disrespect, I love Kay Slay, I been f***in with Kay Slay since Style Wars," Jay said. "I f***s with Kay Slay, I made it known that I fucks with New York. But I'm not 19 years old, I'm not 15 out here sucking d*** and kissing ass, Imma say how I feel."
“When I say New York n***as was dissing us and talking crazy s**t about us; I’m not being hypothetical, I’m talking about what I experienced…I was real clear in the interview I have super respect for RZA. If it wasn’t for Wu, Nas, BIG, Jeru, Primo, by the way Primo’s from Texas, if it wasn’t for all these people I wouldn’t be the person I am today.”
Kay Slay responded on his Hot 97 show.
“What happened in the past happened and the South is eating now and you got on. Why you keep bringing up old foolishness and keep throwing New York up?” Slay said. “I’m taking offense because when Ludacris came around before his first album dropped, he came to my crib to freestyle. T.I. when he first came out came to my crib to freestyle; he asked me to bring him on BET his first time around. Eightball’s first time when he came to New York, I took him through Harlem. You’re using these people like no one in New York supported the South and everybody was dogging them [and] that never was the case.”
Cooler heads have since prevailed.
Kay Slay feels like he has always shown the south love and doesn't want this situation to get out of hand. He tweeted this morning. "Dear bloggers! Me an Jay elec are grown men an we had our opinions about issues an thts that..No violence just opinions!yall can relax now!"
Meanwhile in more positive Jay Electronica news. He recently told Vibe that he will be touring with 50 Cent and G-Unit on their U.S. run.
"I'm touring with G-Unit at the end of the month. I think 50's gonna be down but right now I don't even know the dates. Aside from that, I’m working on the next phase of my music. I want to tour and travel the world. I’m definitely at some point going to make a point to go all over the continent especially after the experience I had shooting "Exhibit C" in Nepal."

We put pen to paper to design a range of T-shirts inspired by the life and passing Guru. The range comprises of three T-shirts with two dedicated to Gurus lyrics and one created solely for that punk Solar. We have gone through our whole collection of Guru tunes which killed it because when you think, ok, we have enough a next one comes through and smashes it!:)
We carefully chose lyrics to create the ultimate battle T which consists of Gurus hardest lines spit (in our eyes, we are sure this will bring on a new debate!). We have also created the Inspiration T, which has his most insightful lyrics, which we feel elevated the way people thought about their actions. We also done a straight up FUCK Solar T, which needs no explanation.
We have put crazy heart into these T's and hope that the people feel that when they rock it. We never do anything half-assed and for a cause like this we defiantly wouldn't slip. We will also be submitting a 15% of profits made from the range to the American Cancer society.

T.I. the self proclaimed King Of The South gave his first interview since being released from prison on weapons charges.
T.I. tells Larry King he was in a state of depression and paranoia when he purchased three machine guns and two silencers from undercover officers.
"This most recent incident, it came from an attempt that was made on my life," he said. "My best friend [Philant Johnson] had died in my arms. It caused a state of depression and paranoia. My judgment was jaded, and I felt my life was in danger. ... At the time, when I felt the need to have these things, I never took into consideration the legalities; I only took into consideration the protection of my life and family."
Larry asked why did he feel the need to purchase that kind of firepower. He pointed out that not even law enforcement uses those kinds of weapons.
Tip explained that when he and his entourage were attacked in Cincinnati the night his best friend was killed the assailants pumped more than 50-100 rounds into the van they were riding in.
So he felt out gunned and didn't want that to happen again.

The hacker that got into
He calls himself "Renaldo" and speaks about why he's going after Solar.
"I'm angry because [of the] things popped off on the Internet about Solar," he said. There were rumors going on about Solar selling Guru’s house while Guru was in the hospital. So when people came forward like Solar’s baby mother, I was like, ‘Let’s expose this guy.’ So that’s why I did it."
Renaldo feels like Solar should be punished for the wrongs he did to late rapper Guru of Gang Starr. He was given Solar's email address and got busy.
"It was never my choice to do it. It was a random thing. It’s not like I feel like I’m the chosen one. But the opportunity was there," he explained. "When that person said ‘Here is Solar’s email account.’ I said ‘Okay, I’m going to hack that shit.’"
Renaldo says he's not done with Solar. He accuses him of stealing from Guru while he was on his death bed.
"I’ve got a shitload of pics of him cheating. I don’t think I leaked this completely…. When Guru was in the hospital fighting for his life, Solar sent an email from Guru’s email account to EMI and said, 'I want to transfer 1K from my bank account to another bank account.' And that bank account is Solar’s bank account. I've got several bank records indicating that he was stealing from Guru. And some documents indicating that all the royalties from EMI went to 7 Grand [his record label]. I've got an email showing that he didn't pay Doo Wop."

A source at Rikers Island confirmed reports that Lil Wayne was busted Monday for having headphones, a charger and a watch that doubles as an MP3 player in his jail cell.
The offense isn't extremely serious, but it could mean more prison time for Wayne. "You just get an infraction, a violation," the source told MTV News. "You lose some 'good time.'
"It depends on the severity of the infraction," the source added about what other type of trouble Weezy could get into. "Level one is the worst. Then you have [level] two or three. [This infraction] could be a level one. He has to go on trial, and based on evidence, they'll make their determination."
Our source also confirmed that Wayne has a job as a suicide-prevention aid, which entails staying up at night to keep an eye on at-risk inmates.
"He checks each cell or area to see if each guy is alive. There are three shifts," our source said. "I think his shift is at night, like 11 [p.m.] to 7 [a.m.] or 12 to 8."
That job is now in jeopardy due to the infraction.
In 2007, Lil Wayne was arrested for attempted gun possession following his first headlining performance in Manhattan at the Beacon Theatre. New York is among the toughest states in the country when it comes to gun-possession laws. In other states, Lil Wayne could have gotten off with a misdemeanor rap and probation. However, in New York, only law-enforcement officials and those affiliated with authorities are permitted to carry firearms. The rapper was sentenced to a year in prison in March.

On the heels of wrapping production on "Batman XXX: A Porn Parody," a skintastic skewing of the 1960s TV show, porn producer Vivid Entertainment has announced the creation of Vivid-Superhero, an imprint that will take the wraps off Superman (already in preproduction, according to the company), the Green Hornet, Spider-Man, Wonder Woman, Captain America, Thor and the Incredible Hulk.
"Batman XXX" brought a lot of mainstream attention to the company, and the (clean) trailer was a hit on YouTube, surpassing expectations by notching more than 150,000 views in the first 24 hours. Part of the appeal was obviously the love for the characters. But this isn't some cheesy, low-budget attempt to do a parody of a TV show, which have been proliferating on the porn scene.
Part of the interest and appeal is what seems like high production values and eye to detail such as hiring the original TV show's costume designers to re-create outfits (the last detail according to Bleeding Cool, which has been all over this like vanilla scent on a stripper).
Axel Braun, who directed "Batman XXX," will act as the lead director for the imprint, and is also working on parodies "Godfather XXX" and "The Addams Family XXX" for Vivid.
"Axel truly did an amazing job with ('Batman XXX'), and we agreed that together we could mine the really rich treasure of superheroes and have a lot of fun doing it," said Vivid founder Steven Hirsch.
The DVD hits certain stores May 24.

Percy "Master P" Miller has done a great job instilling the proper values in his son Romeo.
The two of them have joined Michelle Obama in her fight against childhood obesity.
Percy talked about his program for inner city kids, 'It's Time Kids Campaign' and 'The Three E's' "education, eat right and exercise."
Romeo is the spokesperson for the campaign. He talked about why he's so passionate about it.
"I have seven brothers and sisters and I'm the oldest. Anytime I can help and give back, I want to do that," he said "A lot of kids now are on the internet, on facebook , Twitter and they're not exercising."
