Colorado authorities are taking a second crack at investigating the death of Elijah McClain, who died last year after being stopped by police, and put into a chokehold.

Governor Jared Polis appointed a special prosecutor Thursday to reopen the inquiry into Elijah's death and potentially prosecute the cops who were involved.

As you've probably read ... Elijah died back in August 2019 after police stopped him on a street in suburban Denver. His story has gone viral this week, and become a rallying cry for protests against police brutality and systemic racism.

Mari Newman -- the attorney for Elijah's family -- tells TMZ ... "It shouldn't take a petition signed by millions to hold police accountable when they kill an innocent black man."

The Governor is putting state Attorney General Phil Weiser on the case and Polis says, "Elijah McClain should be alive today, and we owe it to his family to take this step and elevate the pursuit of justice in his name to a statewide concern."

Polis says he was moved to act in part because of Elijah's mother, who described her son as a "responsible and curious child ... who could inspire the darkest soul."

Aurora PD officers stopped Elijah on August 24, 2019, while responding to a call about a suspicious person walking the streets wearing a ski mask and waving his arms. His family says he commonly wore the mask to keep warm ... due to his anemia.

Cops say Elijah refused to stop walking down the street and resisted when police confronted him and attempted to place him in custody. One of the cops placed Elijah in a chokehold.

Body-camera footage of the incident shows Elijah telling the cops, "Let go of me. I am an introvert. Please respect the boundaries that I am speaking." His words are now popping up on social media posts demanding justice.

Cops reportedly kept Elijah on the ground for 15 minutes, and then paramedics gave him a sedative. Elijah suffered cardiac arrest on the way to a hospital and was declared brain dead on Aug. 27 -- and he was taken off life support a few days later.

A popular St. Louis rapper, and Kinloch native, Huey was shot and killed Thursday night. He was 32-years-old.

The shooting happened just before 11:00 p.m. in front of a home in the 8100 block of Martin Luther King Boulevard near Mable Avenue in Kinloch. According to police, Huey whose real name is Lawrence Franks arrived at a local hospital suffering from a gunshot wound. He was pronounced dead shortly after his arrival.

Upon further investigation, police determined another victim a 21-year-old man of the same shooting had arrived at the Ferguson Police Department with a gunshot wound. He was taken to an area hospital and treated for his injuries. He is expected to survive.

Huey was originally signed to Jive Records and is best known for his 2006 debut single “Pop, Lock and Drop It”.

Fans have poured out tributes and condolences to the family of the deceased. Huey’s Instagram profile says he was looking forward to shooting a music video Saturday for his new single.

Huey is survived by his 13-year-old daughter.

Investigators say as many as 10 people were present during the time of the shooting. Police have made no arrest at this time. More details will be posted as this story develops.

PASADENA, Calif. — A San Diego man who was fatally shot during a gun battle last month with police in California was a former U.S. Marine and ex-police officer, authorities said Wednesday.


Dramatic video released Tuesday shows 47-year-old Lloyd Nelson Jr, firing his gun May 8 at officers after his car crashed head-on into a police vehicle during a pursuit in Pasadena.

He fired through his windshield and continued to shoot as he exited the vehicle. One officer was shot in the leg by friendly fire, police said.

Nelson was honorably discharged from the U.S. Marine Corps in 1996, according to Pasadena police Lt. William Grisafe. Nelson previously worked for the Los Angeles County Office of Public Safety until it was absorbed into the sheriff’s department in 2010.

Grisafe said Nelson may also have served in the Army and Air Force reserves. He did not have a previous criminal record, the lieutenant said.

The incident began when a Pasadena officer saw Nelson make an illegal turn, park in the middle of the street and get out of the car, authorities said.

The officer tried to speak to Nelson but he got back into his car and drove away. Officers pursued Nelson in vehicles and with a helicopter before a supervisor called off the ground chase and let the helicopter take over. Nelson drove slowly but did not stop for red lights and stop signs, the video shows.

Police in patrol vehicles began chasing him again and forced a crash using an intervention maneuver designed to stop a car. The video shows Nelson open fire while still seated after his car struck a police vehicle.

Nelson got out of the car and continued shooting as officers returned fire.

Nelson was struck multiple times and died at the scene, officials said. Police said they found two other loaded firearms in his car.

CNN - The New York Police Department officer seen on video putting a man into a chokehold during an arrest over the weekend was arrested and charged Thursday, the NYPD said in a statement.

The officer, David Afanador, 39, was charged with "attempted strangulation" and "strangulation," the statement read.


Afanador probably would be arraigned Thursday morning, the Queens District Attorney's Office tells CNN.

The NYPD suspended Afanador without pay after cellphone video surfaced showing officers tackling 35-year-old Ricky Bellevue and Afanador putting his arm around Bellevue’s neck as he lay face down on the boardwalk.

Bellevue’s lawyer, Sanford Rubenstein, said in a statement that Afanador’s arrest is the “first step in getting justice for Ricky Bellevue.”

“The next step is for this police officer to be convicted and sentenced to jail,” Rubenstein said.


The New York City Council last week passed a package of police reform measures, including an official ban on chokeholds. The bills passed amid nationwide protests spurred by the death of George Floyd after a Minneapolis police officer pressed a knee to his neck for several minutes.

NASCAR released the clearest photo on Thursday of the garage pull rope that was mistaken for a noose in the garage of Bubba Wallace, NASCAR's only Black driver in the Cup Series, prior to the GEICO 500 at Talladega. The image shows the rope tied into what could be interpreted as a noose.

After an investigation from the FBI and NASCAR, it was found that no hate crime that had been committed against Wallace when the rope was originally found. Wallace went on CNN afterwards to assert that regardless of whether it was something intended for him or not, the rope was still a noose.

According to Wallace's retelling of the incident, NASCAR president Steve Phelps was the first to inform the No. 43 driver that this was found in his garage. The rope itself was reportedly found by a staffer, who reported it to the proper authorities.

In a press conference given Thursday, Phelps pointed out that no other garage had anything similar to the type of knot that was tied at the end of Wallace's garage rope. He also apologized using poor word choice in NASCAR's initial statement following the finding of the noose.

Around the time that the noose was found in Wallace's garage, protestors were driving outside of Talladega Superspeedway in Alabama protesting NASCAR's decision to ban the confederate flag at all future events. A plane even flew above the track with the phrase "Defund NASCAR" over the confederate flag on a banner. during the race. This was less than a week after Wallace had driven a Black Lives Matter scheme car at Martinsville.
