(KTLA) -- An Iowa inmate serving a life sentence says he should be a free man after he became ill, momentarily died, and had to be revived at the hospital. But the courts are having none of it.
Benjamin Schreiber was sentenced to life in prison without parole in 1997 after being convicted of first-degree murder. In March 2015, he developed large kidney stones that led to septic poisoning, according to court documents.
He eventually fell unconscious in his cell and was taken to a local hospital, where he was resuscitated five separate times, the documents say.
According to the Iowa Court of Appeals, Schreiber “claims he momentarily died at the hospital, thereby fulfilling his ‘life’ sentence … Because his sentence has been fulfilled, he argues, he is imprisoned illegally and should be immediately released.”
A district court previously denied Schreiber’s motion. And on Wednesday, the Iowa Court of Appeals upheld the lower court’s decision.
In its opinion, the appeals court said a “plain reading” of Iowa law says defendants guilty of a class A felony “must spend the rest of their natural life in prison, regardless of how long that period of time ends up being or any events occurring before the defendant’s life ends.”
“Schreiber is either alive, in which case he must remain in prison,” Judge Amanda Potterfield wrote, “or he is dead, in which case this appeal is moot.”
An attorney for Schreiber did not immediately respond to requests for comment Friday morning. It’s unclear whether Schreiber plans to take the case to a higher court.

(NBC Bay Area) -- A Bay Area teacher is apologizing for appearing in blackface and the rapper he imitated responded by calling the incident a teachable moment.
Common said he would like to speak with the Milipitas teacher who dressed up in blackface and imitated the rapper and social activist in front of his classroom on Halloween.
"My first thought was, what the hell?" Common said said in an interview with NBC Bay Area. "I'd meet him, to educate him; he's a teacher."
Milpitas High School teacher David Carter spoke exclusively to NBC Bay Area on Thursday. The 48-year-old educator struggled to explain what he did, while trying to deal with the worldwide -- mostly negative -- reaction to his decision to dress up as Common and teach class.
Carter said the Halloween presentation was planned for weeks and that his engineering students expected it.
"I would become the hip-hop artist Common, doing the Microsoft AI guy," Carter said. "I had no intention to come across as blackface and my actions were perceived that way, and offended so many people. I'm truly sorry and I apologize."
Carter said he was stunned by the backlash and defended his methods to a point.
"As a teacher I constantly go over the top to engage my students in learning -- I went too far," he said.
The educator said he hopes the whole episode can start a dialogue about understanding and appreciating culture, and he hopes he can do it in his classroom.
"I recognize my mistake. I ask anybody who has been adverselfy affected by this, and that's a lot of people, to give me another chance because my heart is in the right place," Carter said.
Carter remains on administrative leave as he awaits a decision from the Milpitas Unified School District on his future.
Meanwhile, Common said he first saw the video when his daughter sent it to him.
"Blackface lacks understanding of what black and brown people go through," he said. "I believe in forgiveness, understanding, and compassion to the point where I'm willing to sit and talk with the individual and also bring others who can dig deeper into the education of what blackface has come from."
Earlier in the day, Common in an interview with TMZ was also asked about the incident while he was at Los Angeles International Airport prior to boarding a flight to the Bay Area.
"It's important that teachers and people who are educating our children are well educated themselves on things that deal with history and culture -- emotional history and emotional intelligence is important," Common said to TMZ. "I think we need to look at the teacher, the administration and the people that we have leading our children in classrooms and make sure they are fully equipped not just with academic things, but also have emotional intelligence and understanding. Maybe that's something that we start implementing to our schools."
The Milpitas Unified School District this week announced it placed Carter on administrative leave after video posted on social media shows the Milpitas High teacher in black face and apparently imitating Common.
Common was asked by TMZ about the punishment the educator should face.
"That's a decision administration needs to figure out as far as should this person lose their job. I think that he should definitely go through the training that needs to be done. I would love to hear, 'What makes you think you can go up there and do that?'"
Common also told TMZ he was headed to the Bay Area and wants to get in touch with the school. He also said he would like to speak face-to-face with the educator.
"I'd break it down to him and it would be done with love, but it would be for real. This ain't acceptable, this ain't happening. I would let him know what it is, for sure," Common said. "I'm glad it happened because it's a moment that we got to teach and learn. And more than anything the students showed what they're about. And that goes to show you young people in America got their mind in the right place."
The NAACP has also demanded an investigation into the incident.
"It’s harmful, it’s hurtful, it’s not the right environment for a student of color to see their teacher perform like that," said Pastor Jethroe Moore with the NAACP.
On Sunday, the president of the Milpitas Unified school board, Chris Norwood, issued a statement, saying the actions were inappropriate, unprofessional and insensitive.
"District administration has placed a staff member on administrative leave, and I have asked the superintendent to ensure an immediate investigation is conducted," Norwood said.

Things have not been going well for Dion Waiters. The Miami Heat shooting guard has not played in a game this season, and that streak continued Friday under bizarre circumstances.
According to Miami radio host, Andy Slater, Waiters ingested too many "gummies" while the team was in flight from Phoenix to Los Angeles and passed out.
"He had a seizure when he was finally woken up, I’m told," Slater tweeted.
Waiters had recovered enough by game time to be able to sit on the bench and watch as Miami fell to the Lakers 95-80 at Staples Center.

Fox News -- A Mexican police officer involved in the botched operation to arrest one of drug kingpin Joaquin “El Chapo” Guzman’s sons last month was killed by a hail of more than 150 bullets in a brazen daylight assassination, in the latest incident of extreme cartel violence to blight the country.
The 30-year-old officer, only named by police as Eduardo N., was killed in Culiacan, Sinaloa on Wednesday – just three weeks after militarized police captured and then released Ovidio Guzman Lopez after a brutal shootout with cartel gunmen.
Mexican newspaper Excelsior shared CCTV footage from Wednesday’s attack that showed the police officer parking his white vehicle outside a shopping center. Moments later, a red vehicle pulls up alongside him and armed gunmen men leap out, firing rapidly from close range.
Within 30 seconds, the gunmen fired 155 shots at the police officer, before leaping into the vehicle and running off, the outlet reported.
Officials said the officer was a member of Sinaloa’s State Preventive Police who had been assigned to protect Undersecretary of Public Safety Carlos Alberto Hernandez Leyva.
Cristobal Castañeda Camarillo, the Secretary of Public Safety in Sinaloa, said that Eduardo N., was not directly involved in the botched arrest attempt of Guzman Lopez on Oct. 17, but that he was part of the wider antidrug security unit patrolling the region, according to El Heraldo de Mexico.
Guzman Lopez, who is wanted by U.S. authorities on drug trafficking allegations, was briefly captured by police in a house in Culiacan.
But cartel gunmen ambushed the police convoy and burned road barricades in the area while Lopez was in custody. He was released and police retreated following the intense fighting. At least eight people were killed and more than 20 wounded.
Dramatic helmet cam footage released by authorities showed police moving into a building where a young woman first emerges, followed by Guzman Lopez, who is wearing a baseball hat.
The latest targeted attack came on the same day Mexico's President Andres Manuel Lopez Obrador again defended the officers’ retreat and subsequent release of Guzman Lopez, reiterating his belief that cartel violence cannot be fought with more violence.
“The bad cannot be confronted with the bad. The bad needs to be confronted doing the good,” he added. “We believe that the most important (thing) is life, protecting the lives of everyone; the lives of the military, the lives of the presumed delinquents, and the lives of civilians.”
He added: “If we had acted as they asked, implored us, there would have been more than 200 dead.”
Obrador's so-called "hugs, not bullets" when dealing with the cartels has come under increasing scrutiny this week following the deaths of nine Americans - three adult women and six children - who were gunned down in Sonora state.
Since Obrador took office in December, Mexico has been on track to record more than 32,000 murders this year. In the last month alone, the country has been plagued by at least three deadly high-profile attacks - including Monday's - at the hands of cartel members.
