(CNN) A California Superior Court judge has ordered President Donald Trump to pay $44,100 to Stephanie Clifford, also known as Stormy Daniels, to reimburse her attorneys' fees in the legal battle surrounding her nondisclosure agreement.

The judge's order was issued Monday but posted online Friday by Clifford's attorneys.
Clifford, an adult-film actress who says she had an affair with Trump from 2006 to 2007, signed a $130,000 nondisclosure agreement with former Trump attorney Michael Cohen, who represented a shell company and a "David Dennison," which Clifford contends is a pseudonym for Trump. Trump denies the affair occurred.


Clifford sued Trump in 2018, seeking to be released from the NDA. In response, Trump and his legal team agreed outside of court not to sue or otherwise enforce the NDA. The suit was dismissed and Clifford's claims ruled moot, as the NDA had been rendered unenforceable.


Monday's decision was a response to Clifford's efforts to be reimbursed for costs and attorney's fees related to the case.


In his decision this week, Judge Robert Broadbelt III ruled that Clifford was entitled to legal fees, finding her the "prevailing party" under California law, despite the case having been dismissed.
Broadbelt also rejected an argument by Trump's attorneys that the President was not liable for the fees because he had not signed the NDA.


In his decision, Broadbelt wrote that since Trump had reimbursed Cohen for the $130,000 payment to Clifford, and since the Trump legal team had earlier argued that a defamation suit filed against the President by Clifford should be handled by an arbitrator per the NDA, the President was effectively a party to the agreement.

(CNN) A Taco Bell employee in Tennessee is being hailed a hero for saving a man's life after he passed out in the drive-thru.

Sonja Nixon Frazier, the night shift manager at a Taco Bell restaurant in Clarksville, doesn't usually work during the day. But on August 12, in a fortunate turn of events, she happened to be on duty when she and two coworkers noticed a car driving in the wrong direction.


"We saw the driver was slumped over the wheel so we ran to him and pulled him out of the car," Frazier, 37, told CNN. "I checked for a pulse and found that it was vague. I almost couldn't find it at first. My coworker called 911, but I noticed his fingertips, his ears, and his lips were all blue."


Frazier immediately flipped him over and began performing CPR while talking to the man and telling him everything was going to be okay. After approximately 11 minutes of CPR, first responders arrived at the scene and took over.


"I saw him grab one of their arms when they were lifting him up in the stretcher and that was when I knew he would be okay," Frazier said. "I don't look at myself as a hero. This is what I was supposed to do. It doesn't matter who he was or what skin color he had. I knew I was there to save his life. But it really was overwhelming emotionally. After I just smoked a cigarette and cried."

Marquita Johnson, the Clarksville Taco Bell general manager, told CNN she "was in tears" when she found out what happened. She says she was not surprised that Frazier immediately stepped in when she realized the man was in danger.


"She normally works the night shift, but I needed her there with me on that day. She is a genuine person always willing to help anyone and everyone whenever she can," Johnson said. "She is my hero. I'm honored to be her boss."

Risking her life to save his


Frazier, who has two children, was a home healthcare worker for more than six years before joining Taco Bell, where she's been employed for 13 years.


She also suffers from sarcoidosis, a rare lung disease that puts her more at risk from the coronavirus.


"I have been really scared about Covid-19," Frazier said. "My preexisting condition can be deadly. But that never crossed my mind. It really didn't. All that mattered to me was saving that man's life. I wasn't going to leave him."


After the incident, Frazier, who knew the man's name from his license, found him on Facebook and sent him a message to make sure he was okay.

LIBERTY, Mo. (AP) — A Kansas City police sergeant has been indicted on a felony charge of third-degree assault after he allegedly kneed a 15-year-old boy on his neck and head and forced his head into the pavement while the teenager repeatedly said “I can’t breathe,” a Missouri prosecutor announced Friday.

The juvenile was handcuffed, kneeling and cooperating when Sgt. Matthew Neal injured him in the parking lot of a fast-food restaurant in eastern Kansas City on Nov. 14, 2019, Jackson County Prosecutor Jean Peters Baker said.

“I know (I can’t breathe) have become very infamous words but those were his words back when this occurred,” Baker said.

The phrase has been a rallying cry for protesters since the May 25 death of George Floyd in Minneapolis, who said he couldn’t breathe several times as an officer pressed his knee into Floyd’s neck.

The juvenile, whose name was not released, was treated at a hospital for broken teeth and a gash on his head.

“This use of force, injuring this juvenile who was handcuffed and compliant — I think we can all agree this is not a provocative statement — just can’t be tolerated,” Baker said. “We should all agree about that.”

Baker said police video captures part of the incident but not Neal’s handling of the juvenile. But she said there was audio of the incident and eyewitnesses also provided information.

She said a second officer was involved and the investigation was continuing.

Kansas City Police Chief Rick Smith said in a statement the department became aware of the incident after a complaint was filed with department’s internal affairs unit. He said after reviewing the investigation, the information was sent to federal prosecutors, the FBI and Baker’s office.

Neal, an 18-year veteran of the department has been on administrative leave since the investigation and will remain on leave pending the outcome of the case.

“All of us want justice,” Smith said. “And we remain committed to the legal process going forward.”

Baker said she was disturbed that the incident occurred in November but her office was not made aware of it until late spring, and she credited a lawyer who represents the juvenile and his mother with being instrumental in moving the case forward.

“Needless to say, learning of incidents like this more quickly increases the chance the we’ll find additional evidence,” Baker said. “So it’s important, timing is important on these. That kind of speaks for itself.”

A grand jury affidavit said the incident began when an officer tried to stop the 15-year-old and a male who was with him at a 7-Eleven because he suspected a robbery might occur. The driver fled until the vehicle was stopped at the fast-food restaurant. The driver and the teenager got out of the car, knelt down and had their hands above their head, Baker said.

When Neal arrived, the juvenile, who was unarmed, was on his stomach and did not struggle, the affidavit said. Neal put his knee on the back of the teenager’s head and forced his face into the cement. The officer’s knee remained on the juvenile, who repeatedly said he couldn’t breathe, according to the affidavit.

No charges were brought against the juvenile.

Neal has been served with a summons to appear in court on a date that has not been scheduled.

SACRAMENTO, Calif. (AP) — A former California police officer dubbed the Golden State Killer told victims Friday he was “truly sorry” before he was sentenced to multiple life prison sentences for a decade-long string of rapes and murders that terrorized a wide swath of the state.

Joseph James DeAngelo, 74, pleaded guilty in June to 13 murders and 13 rape-related charges under a plea deal that avoided a possible death sentence.

The punishment imposed by Sacramento County Superior Court Judge Michael Bowman means DeAngelo will die in prison for the crimes committed between 1975 and 1986.

“When a person commits monstrous acts, they need to be locked away so they can never harm an innocent person,” the judge said.

DeAngelo also publicly admitted dozens more sexual assaults for which the statute of limitations had expired. Prosecutors called the scale of the violence “simply staggering,” encompassing 87 victims at 53 crime scenes spanning 11 California counties.

Before sentencing, DeAngelo rose from a wheelchair, took off his mask and said to the court: “I listened to all your statements, each one of them, and I’m truly sorry for everyone I’ve hurt.”

Applause erupted when DeAngelo was remanded to the custody of sheriff’s officials for transfer to the state prison system.

“The defendant deserves no mercy,” the judge said.

Bowman sentenced DeAngelo in a university ballroom large enough to hold all the survivors and family members of victims. The sentencing followed an extraordinary three-day hearings in which they told in excruciating detail how he had upended their lives.

DeAngelo sat silently through those hearings, expressionless in a wheelchair that prosecutors contended is a prop to hide his still vigorous health.

He eluded capture for four decades until investigators used a new form of DNA tracking to unmask and arrest him in 2018.

One of six prosecutors who spoke before the sentencing, Tulare County District Attorney Tim Ward, said the outcome of the case offered hope to victims of long unsolved crimes.

“As science and technology evolve, the space for evil like this to operate within gets smaller and smaller. Simply put, the DNA will never forget,” Ward said.

Prosecutors initially sought the death penalty but settled for a life term given California’s moratorium on executions, the coronavirus pandemic and the advancing age of DeAngelo, his victim, and witnesses they needed to make their case.

Bowman sentenced DeAngelo under a plea deal that called for 11 consecutive life terms without the possibility of parole, plus 15 life terms with the possibility of parole and eight years for other enhancements.

A Georgia police officer was placed on administrative duty Thursday after a video of him arresting 22-year-old Kyndesia Smith appeared on the social media app TikTok.

The video, which has been viewed millions of times and shared 170,000 times, shows officer Michael Oxford arguing with Smith, eventually tasing her and arresting her. Oxford is White and Smith is Black.

According to the Gwinnett County Police Department, Oxford was called to the neighborhood Tuesday night for a property damage complaint. Oxford's report said the alleged victim told him a group of people yelled at her, threw a bottle at her car and “threatened to kick her son in the head.”

The officer was directed to a house down the street where he recognized one of the women from security footage of the incident, the report said. Oxford tried to speak with a group gathered outside the house, but the situation went awry.

The video shows Oxford in a screaming match with Smith. He eventually asks her, “Do you want to go to jail?” Smith responds, “I’m not going anywhere. … I’m not resisting, you’re not touching me.”

Oxford then attempts to arrest Smith, who steps behind another woman, and a physical fight ensues. The video shows Oxford pulling out his taser and telling the woman to get on the ground multiple times. She doesn’t, and Oxford tases her, causing her to fall into a bush.

Smith was charged with felony obstruction of a law enforcement officer and simple battery. The Gwinnett County Police Department said Oxford is on desk duty during an internal investigation.

“The police department takes all use of force seriously. All use of force cases are administratively reviewed through the chain of command. An investigation into this incident is being conducted,” a spokesman for the police department said in a press release Thursday.

“We have a long history of being transparent public servants to the citizens of Gwinnett County,” it said.

Jail records show Smith was released Wednesday morning on a $2,950 bond.

CLEVELAND — A local broadcaster is out of a job after using an offensive term on the air to describe Democratic Vice Presidential nominee, Sen. Kamala Harris.

On Wednesday night during WTAM 1100's Indians broadcast, anchor Kyle Cornell used the word 'colored' to describe Harris in a news promo.

The use of the term stirred up plenty of anger on social media as Tribe fans expressed their concerns on Twitter.

On Thursday, WTAM program director Ray Davis released the following statement:

“We are aware of the reference made on WTAM by Kyle Cornell. We take this matter very seriously and addressed it immediately. The term used is extremely offensive and does not align with our station’s core values and commitment to the communities we serve. He is no longer with WTAM.”

3News, which has a partnership with WTAM, spoke with Cornell on Thursday. Cornell told Tiffany Tarpley that what he did was an unfortunate mistake.

"I wasn't trying to be malicious or in any way decimate the character or anything like that," Cornell said. "That was never the goal. And for that, I am truly sorry."

The 26-year-old also apologized to the station.

"For the station of WTAM too, I feel awful for putting them through what they've had to go through over the past 24 hours...I just want them to understand it was a rough choice to make and that I accept my punishment and know that I still love and care about everyone at the station, wish them well and I hope that they can forgive me for making a judgement in error and something that I know is not me."

The firing of Cornell came one day after Reds television broadcaster Thom Brennaman was suspended for using an anti-gay slur when he was coming back from a break during the first game of a doubleheader. Brennaman later apologized and was taken off the air in the second game.
