PORTLAND, Ore. (AP) — DDA Multnomah County grand jury has ordered Walmart to pay $4.4 million in damages to a man who sued the store, saying he was racially profiled & harassed by a Walmart employee at a Portland, Oregon, area store in 2020.

According to the lawsuit the employee “spied” on Michael Mangum while shopping, ordered him to leave and called police when he refused.

Mangum, who was 59 at the time, visited the Walmart to buy a light bulb for his refrigerator. After Mangum arrived, he noticed store employee Joe Williams watching him as he shopped.

Williams told Mangum to leave the store, but Mangum refused, saying he’d done nothing wrong. Williams told Mangum he was going to call the police & tell them Mangum had threatened to “smash him in the face.”

Williams called the non-emergency police dispatch line & told the operator he “had a person refusing to leave.”

Deputies from the Multnomah County Sheriff’s Office responded & “refused to take action against Mangum.” Deputies made that decision based on Williams’ “shifting explanations” for the reason he called & because of his “reputation for making false reports to police.”

The next day, Sheriff’s Sergeant Bryan White & another deputy met with the director of the Walmart & explained that deputies had noticed a “pattern of behavior” in which Williams would call police to report “dangerous active situations, such as customers physically assaulting him or other employees,” that were not happening.

Walmart corporate officials kept him on the job for several more months & fired him in July 2020 for “mishandling $35 of Walmart property.”

LOS ANGELES (AP) — A California man who smuggled more than 1,700 wild animals into the United States, including 60 reptiles hidden in his clothing, pleaded guilty Wednesday to federal charges.

Jose Manuel Perez, 30, of Oxnard, entered pleas to 2 counts of smuggling & a charge of wildlife trafficking.

Prosecutors said that from 2016 to this February, Perez & his accomplices used social media to arrange to smuggle animals from Mexico & Hong Kong. Most were reptiles & included Yucatan box turtles, Mexican box turtles, baby crocodiles & Mexican beaded lizards.

It is illegal to import the animals without permits under an international treaty on the trade of endangered species.

Perez paid accomplices a crossing fee to drive animals from Mexico to El Paso, Texas, where he had them shipped to his family’s Ventura County home & resold them to customers throughout the U.S.

He also made some 3 dozen trips to Mexico himself to pick up animals & on Feb. 25 he was arrested while trying to enter the U.S. with 60 reptiles hidden in bags of his clothing. 3 of the reptiles died.

The smuggled reptiles were worth about $739,000.

Perez fled to Tijuana in June while out on bond but was quickly captured & returned to the U.S. He could face up to 20 years in federal prison for each smuggling count when he’s sentenced on Dec. 1.

TAMPA, Fla. (Fox13) - Twenty days after the death of a 1-year-old at a Tampa apartment complex, the Tampa Police Department said their suspect had been arrested in Tennessee.

Detectives in Tampa started investigating on August 1 when an unresponsive infant was brought to the hospital and died soon after. An autopsy showed the baby had injuries to their stomach and head, according to TPD.

Officers were called to an apartment complex on Woodville Street around 3 p.m. after other children in the home realized the baby was unresponsive and ran to a neighbor for help.

Investigators later learned the baby and the baby's mother lived in the same apartment was 28-year-old Terin Smith, who cared for the child while the mother was at work.

Other children in the home told officers they saw Smith hit the infant for being "whiny" during bath time. Smith then reportedly put the baby in a crib, where the child was found by other juveniles in the home.

When officers got there, Smith was already gone.

TPD said Smith was located and arrested in Tennessee on August 21. He has been charged with first-degree murder while engaged in aggravated child abuse.

It was unclear when Smith would be transported back to Tampa.

CHILDERSBURG, Ala. (WBRC) - New video released tonight of a Childersburg pastor who was arrested while watering his neighbor’s flowers.

Pastor Michael Jennings of Vision of Abundant Life Ministries in Sylacauga, was confronted & arrested by police while watering flowers at a neighbor’s home.

“Y’all racially profiled me,” Jennings said in the video.

“We’re not racially profiling you,” the unidentified officer responded. "Yes, you did,” replied Jennings.

“No sir, no sir,” the arresting officer rebutted. “We’re not about that okay?”

“I told you I was here watering flowers,” Jennings responded. “How do we know that’s the truth,” the officer asked.

“I had the water hose in my hand! I was watering the flowers,” Jennings laughs.

Jennings was arrested & charged with obstructing government operations. Those charges dropped the following month.

Police say someone reported a suspicious vehicle & person on the property.

“It represents an abuse of police powers. It represents racial profiling and it represents law-enforcement officers intimidating a person who actually understands & knows their rights,” his attorney Harry Daniels said.

The charges against Jennings were dropped the following month, however, Daniels said they were still planning to sue the department.

“These cases put law enforcement on notice & the country on notice that these types of interactions. Thank God that my client had a cool head. He didn’t get aggressive or defensive in a sense & he complied when the officers grabbed him. It could’ve went a different way. Pastor Jennings could very well not be here today.”

Video After The Jump

In this clip, Tony Yayo quickly touches on the fact that John Cena's famous "You Can't See Me" taunt actually comes from a gesture that he made in a 50 Cent video many years ago. The Queens native then gives a shoutout to John Cena before revealing that the reason behind the gesture is that he was trying to hide his face from law enforcement because he was on the run. This prompts DJ Vlad to ask him about the rumor that Suge Knight showed up to the music video shoot for "In Da Club." Yayo confirms that Knight did indeed show up, along with the Mexican Bloods, and that he and his bandmates were actually excited to have beef with him because it meant that they had "arrived" as artists. Moving along, Yayo shares another encounter with Suge Knight at the Vibe Awards, where 50 Cent instructed James Cruz to go and buy 16 knives for the members of his crew just in case the had to engage in a brawl with Suge Knight.

Kodak Black is lending a major hand to Haitians cut off from food and water -- due to extreme gang violence -- by sending more than 35,000 bottles of H2O.

Kodak heard about the Caribbean nation's crisis, and decided to do something to help the situation -- dropping $50k to get tons of bottled water shipped there from Florida ... according to the rapper's attorney, Bradford Cohen.

We're told Kodak is using cargo ships to send over alkaline water, and the labels on the bottles read "LAST" because Kodak wants this to be the last time anyone in Haiti goes without water.

Once the shipment reaches Haiti ... Kodak and his team are working with Haitian government officials to ensure the bottles get to their intended destinations.

Cohen says Kodak is calling for a ceasefire in the rising gang violence that's turning Haiti into a war zone ... and the water donation is just his latest step in an ongoing effort to help the island.

In addition to making sure Haitians don't go thirsty, we're told Kodak previously donated to orphanages and food banks on the island to get folks health care.

MORROW, Ga. (AP) — 2 white Atlanta police officers who clashed with Rayshard Brooks acted reasonably during the 2020 encounter that ended with the 27-year-old Black man’s fatal shooting, a specially appointed prosecutor said Tuesday in announcing his decision not to pursue charges against the pair.

Pete Skandalakis, executive director of the Prosecuting Attorneys’ Council of Georgia, said Officer Garrett Rolfe, who shot & killed Brooks in June 2020, & Officer Devin Brosnan will not face any charges, saying they faced a “dynamic situation” that was “quickly evolving.”

Skandalakis said he believes that context is important and acknowledged that encounters between police and the African American community are sometimes “very volatile,” but he said he doesn’t believe race played a role in this instance.

“This isn’t one of those cases,” he said. “This is a case in which the officers were willing to give Mr. Brooks every benefit of the doubt and, you know, unfortunately, by his actions, this is what happened.”

On June 12, 2020, police responded to complaints of a man sleeping in a car in the drive-thru lane of a Wendy’s restaurant. Police body camera video shows the 2 officers having a calm conversation with Brooks for nearly 40 minutes.

Then, when the officers told Brooks he’d had too much to drink to be driving & tried to arrest him, Brooks resisted in a struggle caught on dash camera video. Brooks grabbed a Taser from 1 of the officers & fled, firing it at Rolfe as he ran. Rolfe fired his gun & an autopsy found that Brooks was shot twice in the back.

Rolfe was fired a day after the shooting, but his dismissal was overturned in May 2021 by the Atlanta Civil Service Board. The board found that the city failed to follow its own procedures for disciplinary actions.

Former Louisville Metro Police Detective Kelly Hanna Goodlett pleaded guilty Tuesday to 1 count of conspiring to violate the civil rights of Breonna Taylor for helping falsify an affidavit for the search of her apartment that ended in her death in March 2020.

Goodlett is expected to against 2 of her ex-colleagues, Joshua Jaynes and Kyle Meany, when they are tried on civil rights charges in connection with Taylor’s death. A third ex-detective, Brett Hankison, is also charged in a separate federal indictment.

Goodlett, 35, admitted the charge before U.S. District Judge Rebecca Grady Jennings with Taylor's mother, Tamika Palmer, among those present in the courtroom.

She faces a sentence of no more than 6 years in prison, plus up to a $250,000 fine & 3 years of supervised release.

Goodlett admitted she falsely claimed a postal inspector had verified Taylor was receiving packages for her ex-boyfriend, convicted drug dealer Jamarcus Glover, at her apartment before the raid. In fact, postal inspectors said there was no evidence Taylor was receiving packages at her apartment.

The indictment of Jaynes alleges Goodlett met with Jaynes in his garage so they could “get on the same page” after a postal inspector said the claim that Taylor was receiving Glover's packages was bogus.

Jaynes, 40, & Meany, 35, also face civil rights charges for the search that ended in Taylor's death, while Hankison, 46, is charged with violating the civil rights of Taylor; her boyfriend, Kenneth Walker & 3 of Taylor’s neighbors; by blindly firing shots into her apartment.

Taylor was 26 when she died.

MULBERRY, Ark. (CBS 5 News) — Attorneys for Randal Worcester's speak on their hopes for his future & his health.

2 Crawford County deputies were suspended & a Mulberry police officer is on administrative leave after a video surfaced showing a violent arrest, causing outrage on social media.

In the video, the 3 law enforcement officers are seen on top of Worcester allegedly using excessive force, at a convenience store in Mulberry, Arkansas on Sunday, Aug. 21.

Attorneys Carrie Jernigan & David Powell are representing Worcester. Originally, the day after the arrest he was arraigned & given a public defender but around noon the same day, it was revealed that attorneys Jernigan & Powell would represent him. He was released from jail Monday afternoon.

They say Worcester had multiple scratches on his face & knees & that he complained of pain in his head. They described the right side of his face as purple & swollen.

"I am obviously glad for my client, that someone did pull out there and their camera phones able to capture this," Powell said. "Otherwise, may not ever know what happened to him"

"I think it could have gotten much worse because I think the brutality was escalating," Jernigan said. "I'm just thankful she stood up for what she believed in."

According to the attorneys, Worcester mentioned it essentially being an attack on the ground for what seemed like a couple of minutes.

"There just has to be a point where if the ability to subdue— once that ends— you cannot use excessive force," Jernigan said. "It violates the Fourth Amendment that is to protect us from excessive force against law enforcement."
