A Baltimore police officer was indicted Thursday on 32 counts of assault, false imprisonment and misconduct after a review of months’ worth of body-cam footage unveiled a “pattern and practice of harassment and intimidation,” prosecutors said.
Sgt. Ethan Newberg, an officer with 24 years on the force, turned himself in to the Baltimore Police Department on Thursday afternoon, Baltimore City State’s Attorney Marilyn J. Mosby told The Washington Post.
It also prompted a review of nearly a year’s worth of Newberg’s daily interactions with citizens, Mosby said.
There were nine incidents involving Newberg apparently intimidating citizens. All nine incidents unfolded almost identically: Newberg, 49, questioning and restraining bystanders who happened to be in the same place as the police interactions, such as traffic stops and arrests, according to an indictment obtained by The Post.
In one January incident, a bystander identified in court documents as “DM” was told to move away from police activity. DM walked away, but Newberg pursued him and shoved him against a wall, the indictment said.
“You were told to walk away, it’s a safety issue. You don’t make the rules out here, we do,” Newberg said, according to the document. Newberg coerced an apology from DM before he was released.
“Hey, don’t play me … don’t mess with me,” he told DM, according to the document.
Other interactions summarized in the document reveal an attitude of lording over the Western District. In one February traffic stop, Newberg told a man sitting on a stoop to disperse after a nearby traffic stop but then went after him and took him into custody.
“I’m the sergeant they talk about, now you’ve met me. Sgt. Newberg. Now you know me,” he told the man. “Now we have an understanding, correct?”
Those moments came to light in a review prompted by a May 30 incident involving Lee Dotson, who saw two Baltimore officers force a man to sit on a rain-drenched curb. He decided to speak up.
“That ground wet, man,” Dotson said, as he passed the scene and walked away. Newberg described Dotson as “combative” in initial reports, though footage later released told a radically different story.
Newberg broke into a run, grabbed Dotson by the arm and tried to take him down before another officer tackled the passerby to the pavement and locked handcuffs around his wrists, according to body-cam footage.
The 32-count indictment includes charges related to that incident, Mosby said. Joseph Murtha, Newberg’s attorney following the initial charges, did not respond to a request for comment.
Newberg has been trained in de-escalation, use of force and laws allowing citizens to record police action, the prosecutor’s office said.
The department declined to provide a statement but pointed to Harrison’s previous comments.
“From what I saw, the man did nothing to provoke Sergeant Newberg, whose actions were not just wrong but deeply disturbing and illegal,” Harrison said at a news conference in June after release of the Dotson body-cam footage. “This type of behavior cannot and will not be tolerated under any circumstances.”
Mosby said Newberg’s arrest was “another example of my office’s commitment to share one standard of justice.”
“You’ll face the consequences even if you wear a badge,” she said.
Newberg has remained suspended with pay, Mosby said.
His salary is notable. He was paid $260,775 in the fiscal year ending in June when accounting for overtime — the highest of any city employee.
That period included every incident cited in the indictment.

LOS ANGELES — A police officer was arrested Thursday on a charge that he fondled the breast of a dead woman in October, according to authorities and court documents.
Officer David Rojas, 27, who has been with the Los Angeles Police Department for four years, was arrested by the department’s internal affairs division.
He is charged with one count of having sexual contact with human remains in the Oct. 20 incident, which occurred after Rojas and his partner responded to a call about a woman who had died, prosecutors said in a statement.
Rojas was released Thursday on $20,000 bail, according to jail records. It was not clear if he had an attorney who could speak on his behalf. A phone number for Rojas could not immediately be found Thursday night.
The Los Angeles County District Attorney's Office said Rojas faces up to three years in prison if convicted.
"This incident is extremely disturbing and does not represent the values of the Los Angeles Police Department," LAPD Chief Michel Moore said in a statement.
The LAPD said earlier this month that an officer was removed from active duty amid an investigation. The Associated Press reported at the time that that the alleged incident was captured on the officer’s body camera despite an effort to turn it off.
The officer turned off the camera after being left alone with the corpse and then turned it on, but the cameras have two-minute buffering periods that record what happens right before they are activated, the AP reported, citing a person briefed on the investigation.
The district attorney's office said Rojas touched the dead woman's breast while he was alone.
The board of directors for the Los Angeles Police Protective League, the police officers' union, called the alleged acts "vile."
"We hope that District Attorney Jackie Lacey charging Mr. Rojas for his vile alleged crime will bring some solace to the deceased woman's family during their time of grieving," the board said in a statement.
"The Los Angeles Police Protective League will not defend Mr. Rojas during his criminal proceedings," it continued, "and his alleged behavior is abhorrent and an affront to every law enforcement professional working for the LAPD."
Internal affairs detectives were examining Rojas' entire career at the LAPD, including a review of other video he recorded while on duty, NBC Los Angeles reported, citing sources.
The police department said in a statement that it presented its case to the district attorney's office on Tuesday and the single felony count was filed Thursday.

50 Cent thinks Oprah is targeting famous black men accused of being sexual predators ... but gives white guys in the same boat a pass.
The rapper took to Instagram to call O out, saying ... "I don’t understand why Oprah is going after black men. No Harvey Weinstein, No Epstein, just Micheal Jackson and Russell Simmons this sh*t is sad."
Fiddy's referring to the media mogul's upcoming #MeToo documentary featuring Drew Dixon, one of the women who's accused Russell Simmons of sexual misconduct, along with her 'After Neverland' interview of Jackson's accusers, Wade Robson and James Safechuck.
50 also roped in Oprah's close friend Gayle King -- who conducted R. Kelly's disastrous TV interview after "Surviving R. Kelly" renewed outrage about his behavior -- adding ... "Gale hit R Kelly with the death blow documentary," and he claims, "These documentary’s are publicly convicting their targets, it makes them guilty till proven innocent."
The rapper then shared a photo showing images of Bill Cosby, Jeffrey Epstein, Kevin Spacey, Harvey Weinstein, R. Kelly and Donald Trump ... with "Jail" written on the black men and "Walk" on the white men. He captioned it, "You think Oprah don’t notice how this sh*t is playing out?"
Of course, 50 and Oprah have feuded in the past ... when she criticized lyrics in rap music and he disparaged her audience. They seemingly smoothed things over in a 2012 TV interview, but with Fiddy ... any beef can be renewed.
BTW ... Oprah's documentary, for which she's executive producer, is set to premiere at the Sundance Film Festival in early 2020.

A Tennessee family said someone hacked a Ring security camera set up in their children's bedroom and taunted their 8-year-old daughter.
The LeMay family, of Memphis, said they installed the device to keep an eye on their daughters. A few days later, the family said a stranger had gained access to the device and was talking to the little girl.
In a video from the Ring device, the child, standing in her room, asks: "Who is that?"
A man responds that he's her "best friend."
"I'm Santa Claus. Don't you want to be my best friend?" he says.
The terrified girl screams for her mother.
The hacker also played music for the girl and instructed her to mess up her room and break her television.
"You can do whatever you want," he says.
"I don't know who you are," the girl responds.
Ashley LeMay, the girl's mother, said that the hacker could have watched her daughters changing or sleeping.
"They could have seen all kinds of things," she said.
Ring told NBC News in a statement that, "While we are still investigating this issue and are taking appropriate steps to protect our devices based on our investigation, we are able to confirm this incident is in no way related to a breach or compromise of Ring’s security."
The terrifying ordeal the LeMay family experienced isn't the first time there have been reports of security camera devices being hacked.
Earlier this month, a Florida family said someone hacked their Ring device and spewed racial slurs at their 15-year-old son. The family said told NBC affiliate WBBH in Fort Myers that they had to remove the batteries from the camera.
"I was scared... I was scared. I didn't know who that is, how long he'd been watching us and I'm still scared now because I don't have any answers," Josefine Brown told the outlet.
In January, an Illinois family said a stranger hacked into their Nest home security camera and thermostat.
Arjun Sud told NBC Chicago that after he put his 7-month-old son to bed he heard someone talking to the infant. The hacker also turned the heat up in the room to 90 degrees.
“The moment I realized what was happening, panic and confusion set in, and my blood truthfully ran cold,” Sud said. “We don’t know how long someone was in our Nest account watching us. We don’t know how many private conversations they overheard.”
During that incident, Google, which owns Nest, told the outlet that its systems were not breached and customers were "using compromised passwords" that were exposed in breaches on other websites.

The mother of slain 6-year-old Zymere Perkins on Wednesday coldly recounted the fatal beating her lover delivered with a broken broomstick, and how she cleaned her child’s limp and unresponsive body, read the bible and did her makeup before carrying the battered little boy to the hospital.
In her third day on the stand in Manhattan Supreme Court in the murder trial of ex-boyfriend Rysheim Smith, Geraldine Perkins, 29, confessed that she stood idly by while her son endured the heartless beating that killed him in their Harlem apartment Sept. 26, 2016.
After a day without food or water — punishment for his supposed misbehavior — Perkins testified she found little Zymere rummaging through the trash for food.
“I heard him walking and going into the garbage bag, eating out of it,” Perkins said. “I thought it was a mouse.”
The next morning, Perkins said she was awoken by Smith yelling at her son for defecating in the living room and hiding it.
“He started to strike him with a broomstick, beating him from his chest to his legs with the broomstick,” said Perkins.
“'Why the f--k did you take a s--t? Why did you take a f-----g s--t in here? There’s a bathroom, you could have used the bathroom,'” she said Smith yelled at the little boy.
The beating intensified when Smith picked a screaming Zymere from the floor and brought him into the bathroom, where he waterboarded him before pulling down the shower rod and unleashing another beating.
“He was going limp, like unresponsive,” Perkins recounted.
He looked “like he was dead,” his mother testified.
Perkins said hours later she finally sought medical assistance for her son, who, she testified, she instinctively knew was dead.

Former Pro Bowl running back Clinton Portis and other retired NFL players have been charged by a federal grand jury with defrauding the NFL's health care benefits plan for its retirees, according to an indictment unsealed Thursday.
The former NFL players allegedly submitted fraudulent health care claims seeking to be reimbursed for "expensive medical equipment" that was never purchased, court records show.
CNN is reaching out to the NFL and the named players for comment.
According to an indictment unsealed in Kentucky, the former players are accused of submitting claims for equipment such as "hyperbaric oxygen chambers, ultrasound machines designed for use by a doctor's office to conduct women's health examinations, and electromagnetic therapy devices designed for use on horses."
The scheme, which lasted from June 2017 to December 2018, led to over $3.9 million in false and fraudulent claims, of which the plan paid out more than $3.4 million, prosecutors said in a news release.
The defendants "each personally profited" by receiving reimbursements from the plan or by getting kickbacks and bribes paid by participants in exchange for making false and fraudulent claims, the indictment says.
The defendants include:
* Portis, the former Washington Redskins and Denver Broncos running back; * Robert McCune, a former linebacker with the Redskins; * John Eubanks, a former cornerback with the Redskins; * Tamarick Vanover, a former Kansas City Chiefs wide receiver; * Ceandris "C.C." Brown, a former Houston Texans safety; * James Butler, a former New York Giants and St. Louis Rams safety; * Fredrick Bennett, a former Houston Texans defensive back; * Etric Pruitt, a former defensive back for the Atlanta Falcons and Seattle Seahawks; * Carlos Rogers, a former Redskins and San Francisco 49ers cornerback; * Correll Buckhalter, a former Philadelphia Eagles running back.
In addition, the government plans to file criminal information charging Joseph Horn, the former New Orleans Saints wide receiver, and Donald "Reche" Caldwell, the former San Diego Chargers and New England Patriots wide receiver, according to the news release.
More than 20 FBI field offices across the country participated in the investigation, from Miami to New Jersey to Los Angeles, prosecutors said.
