A North Texas man is suing two officers in the Keller Police Department following his arrest in August. Keller PD demoted Sergeant Blake Shimanek for his role in the incident.

The arrest occurred Aug. 15 when 22-year-old Dillon Puente was pulled over for making a wide right turn. Puente was on his way to his grandmother’s house when he was stopped in the Riverdance neighborhood.

Bodycam video shows Shimanek ask Dillon to get out of the car before he places him in handcuffs. In a police report obtained by WFAA, Shimanek said he detained Dillon because he was worried about his safety.

“He was ticketed and taken to jail for a wide right turn,” said Dillon’s dad Marco Puente in an interview with WFAA.

Marco Puente was following Dillon to his grandma’s house, and he pulled up his vehicle after he saw his son was pulled over by police.

Bodycam video shows Shimanek threaten Marco Puente with arrest if he continued to remain in the roadway with his truck.

After obeying the order to move his vehicle, Marco started recording his son’s arrest on his cellphone, while he was waiting on the sidewalk across the street from the scene.

“The officer didn’t like me being there recording anything,” Marco told WFAA.

Bodycam video shows Shimanek ordering Officer Ankit Tomer to arrest Marco too.

“Put your phone down,” Tomer said, while his body-worn camera recorded. “Put your hands behind your head.”

“This guy is arresting me for just standing here,” Marco said in video captured by the body-worn camera.

“They tried to take me down and pepper spray me, and it was a fiasco,” Marco told WFAA.

Dillon Puente ultimately paid a ticket for his wide turn.

But a new lawsuit filed against the two officers said Keller PD leadership called the use of force and arrest of Marco Puente “inappropriate." The lawsuit says two days after the incident, the police chief met with Marco to apologize for the officers’ conduct “and to reiterate that Officers Shimanek and Tomer were in the wrong, not Mr. Puente.”

When contacted, Keller police were quick to provide WFAA documents into their investigation of this incident, but said they cannot publicly comment due to the ongoing lawsuit.

Scott Palmer is Marco's attorney. He said the lawsuit is about accountability.

“Marco is not a criminal. This is a man, a concerned father, and if this can happen to him, it can happen to anyone,” Palmer said. “These officers knew better. I believe they were trained better, but why did they not execute better? I don’t know.”

Police records show Shimanek has had previous problems as a Keller officer. In 2016, an Internal Affairs review found that he entered a home without a search warrant and without approval from the homeowner.

In 2018, Shimanek's discipline file shows that he was reprimanded after he made a comment in reference to "women not carrying guns because they would not be able to protect the children during a school shooting."

Now, in this 2020 incident, another Internal Affairs review has found misconduct. This time, it is has led to Shimanek's demotion from his rank as a sergeant to officer.

Keller police said Officer Tomer, also named in the lawsuit, was not punished as he arrived later and was working under the orders of his then sergeant.

“It’s disturbing to know that these are the people we are entrusting with providing safety in the community and they are abusing that power,” James Roberts, an attorney in Palmer’s law firm, told WFAA. “I know that they knew better. I know that they knew what they were doing was wrong, yet they still did it.”

Now three months later, the Puente family remains troubled by the August incident.

“Who gets pulled out of a car and cuffed for a wide right turn?” Marco said. “Nobody. Nobody.”

When the church doors open, only white people will be allowed inside.

That’s the message the Asatru Folk Assembly in Murdock, Minnesota, is sending after being granted a conditional use permit to open a church there and practice its pre-Christian religion that originated in northern Europe.

Despite a council vote officially approving the permit this month, residents are pushing back against the decision.

Opponents have collected about 50,000 signatures on an online petition to stop the all-white church from making its home in the farming town of 280 people.

“I think they thought they could fly under the radar in a small town like this, but we’d like to keep the pressure on them,” said Peter Kennedy, a longtime Murdock resident. “Racism is not welcome here."

Many locals said they support the growing population of Latinos, who have moved to the area in the past decade because of job opportunities, over the church.

“Just because the council gave them a conditional permit does not mean that the town and people in the area surrounding will not be vigilant in watching and protecting our area,” Jean Lesteberg, who lives in the neighboring town of De Graff, wrote on the city’s Facebook page.

The Southern Poverty Law Center describes Asatru Folk Assembly as a “neo-Volkisch hate group” that couches “their bigotry in baseless claims of bloodlines grounding the superiority of one’s white identity.”

Many residents call them a white supremacist or white separatist group, but church members deny it.

“We’re not. It’s just simply not true," said Allen Turnage, a folk assembly board member. "Just because we respect our own culture, that doesn’t mean we are denigrating someone else’s."

The group, based in Brownsville, California, says teachings and membership are for those of strictly European bloodlines.

The church was looking for a new church in the eastern North Dakota region when they came across Murdock. It’s unknown how many members they have worldwide or how many people will attend the new church.

“We do not need salvation. All we need is freedom to face our destiny with courage and honor,” the group wrote on its website about their beliefs. “We honor the Gods under the names given to them by our Germanic/Norse ancestors.”

Their forefathers, according to the website, were "Angels and Saxons, Lombards and Heruli, Goths and Vikings, and, as sons and daughters of these people, they are united by ties of blood and culture undimmed by centuries."

“We respect the ways our ancestors viewed the world and approached the universe a thousand years ago,” Turnage said.

A small contingent of church supporters in Murdock said the community should be open-minded and respectful to all.

“I find it hypocritical, for lack of a better term, of my community to show much hate towards something they don’t understand. I for one don’t see a problem with it,” Jesse James, who said he has lived in Murdock for 26 years, wrote on Facebook.

“I do not wish to follow in this pagan religion, however, I feel it’s important to recognize and support each other’s beliefs,” he said.

Murdock council members said they do not support the church but were legally obligated to approve the permit, which they did in a 3-1 decision.

“We were highly advised by our attorney to pass this permit for legal reasons to protect the First Amendment rights," Mayor Craig Kavanagh said. "We knew that if this was going to be denied, we were going to have a legal battle on our hands that could be pretty expensive.”

The Houston Rockets and NBA are reviewing video of James Harden partying maskless at a strip club to determine if he violated the league's COVID-19 protocols, putting the perennial All-Star's availability for Houston's season opener Wednesday night in question, sources told ESPN.

The video, which was published by Black Sports Online and has been circulating on social media, is purportedly from a Houston strip club's Christmas party held this week. The Rockets and the league office are attempting to verify that it is indeed a recent video, which would confirm that Harden violated the league's protocols.

The NBA's COVID protocols prohibit players from going to bars, lounges or clubs and from participating in social gatherings of more than 15 people.

Harden, who has requested to be traded, violated the league's COVID protocols during his brief holdout at the beginning of training camp, when he attended rapper Lil Baby's birthday party in Atlanta and hung out in Las Vegas clubs. The league required Harden to have six consecutive days of negative coronavirus tests before clearing him to practice with the Rockets.

The jury selection process in the George Floyd murder trial is underway, and it's clear the judge, prosecutors and defense attorneys want to know where prospective jurors stand on social justice.

The Hennepin County Special Juror Questionnaire was just mailed out to citizens who could potentially decide whether the 4 accused cops are guilty of murder.

TMZ obtained a copy, and it begins by telling potential jurors they are to avoid viewing anything about the case from this day forward ... then digs into what they already know, and how they got that information.

A lot of it is basic stuff for highly publicized cases, but then it asks ... "Did you, or someone close to you, participate in any of the demonstrations or marches against police brutality that took place in Minneapolis after George Floyd’s death?"

If the answer's yes, the next question is ... if they carried a sign and what the sign said.

The questionnaire continues with ... "Did you or someone you know get injured or suffer any property damage during the protests that took place after George Floyd’s death?" Also ... "Do you believe your community has been negatively or positively affected by any of the protests that have taken place in the Twin-Cities area since George Floyd’s death?"

Other questions focus on the media and law enforcement. Obviously, with police officers on trial, the intent here is to uncover biases ... either against or in favor of cops.

As we've reported ... former officer Derek Chauvin faces charges of second-degree murder and second-degree manslaughter for Floyd's death, and the trial is set to being March 8.

The other officers -- J. Alexander Kueng, Thomas Lane and Tou Thao are charged with two counts each -- one for aiding and abetting 2nd-degree murder and one for aiding and abetting 2nd-degree manslaughter.

CANTON, Ga. - Authorities have arrested a woman in connection to a stabbing that resulted in the death of her toddler earlier this month in Canton.

Chloe Driver, 20, of Tennessee and Florida, is facing several charges for the murder of her 13-month-old daughter, Hannah, Canton police said.

The incident happened on Dec. 8 at home in the Mountain View subdivision located along Mountain Vista Blvd.

When officers arrived, they said they found both the child and the mother in an upstairs bedroom. The child was rushed to the hospital where she later died. The child's mother was initially listed in critical condition.

Driver was arrested on Tuesday after being discharged from the hospital. Her charges include felony murder with malice, cruelty to children, aggravated assault with intent to rape/murder/rob, and aggravated battery.

Driver was being held at the Cherokee County Adult Detention Center.

Four other people were at the home at the time of the stabbing. Investigators spent several hours interviewing them to try to figure out what happened.

21 Savage surprised a bunch of kids and their families when he played secret Santa ... giving them exactly what they wanted from their Christmas wish lists.

The rapper and his Leading By Example Foundation hooked up over 30 kids from the Wade Walker Park Family YMCA in DeKalb County, GA for some much-needed relief and joy.

Lorna Loh, the Executive Director at that YMCA, tells TMZ ... last week the kids were asked to write letters to Santa with their wish lists. Unbeknownst to the kiddos -- and their families -- the YMCA staff went on a shopping spree and bought everything on their lists ... courtesy of 21 Savage and the foundation.

Some of the most popular items requested were LOL surprise dolls, Legos and Hot Wheels. The kids who benefited are in the YMCA's virtual learning program ... many of whom are on financial assistance, so you know this gesture went a long way.

Then, on Monday, parents brought the kids to the YMCA where the surprise was revealed. The kids were stunned, to say the least. Parents also got a surprise ... the foundation provided each of them with 12 lb. turkeys along with the sides and trimmings for a true Christmas feast.

Yes, social distancing was practiced similar to Prince Jackson's shopping spree.

21 Savage was not at the occasion but his presence certainly was felt. He's also no stranger to the YMCA -- last Thanksgiving he was there to serve 300 Thanksgiving meals to needy families.

Giving back ... it's one helluva mood.

BRADENTON, Fla. (AP) — Three brothers have been charged in Florida with involvement in the 2006 slaying of a 16-year-old girl.

Manatee County Sheriff Rick Wells said at a news conference Monday that the case was solved using cellphone tracking analysis unavailable when Amber Woods was fatally shot 14 years ago.

Second-degree murder charges have been filed against Ralph Williams, 35, and Tyjuan Williams, 32. Both are jailed on unrelated charges in different counties. It’s not clear if they have lawyers to represent them on these new charges.

Their half-brother, Jamaine Brown, pleaded no contest last week to being an accessory to murder after the fact, the Bradenton Herald reported. Authorities say Brown provided detectives with details about Woods’ kidnapping and killing as part of a plea deal.

Wells said Ralph Williams, who was Woods’s boyfriend at the time, suspected she was pregnant and feared he would face criminal charges because of her age. An autopsy later determined the girl, who lived in Hardee County, was not pregnant.

“We always believed that these three murderers were in cahoots together and were trying to do everything they could to conceal the fact that they had murdered Amber and they went the last several years like nothing ever happened,” Wells said.

Hall of Fame linebacker Kevin Greene, considered one of the fiercest pass-rushers in NFL history, has died. He was 58.

Greene died Monday, the family confirmed, as did the Pro Football Hall of Fame.

No cause of death was given.

"The entire Pro Football Hall of Fame family mourns the passing of Kevin Greene," Hall of Fame president and CEO David Baker said in a statement Monday. "I regarded him as a personal friend and a true Hall of Famer in every sense. He possessed the most incredible can-do attitude of anyone I ever met. He was a great player, but more than that, he was a great man."

Known for his long blond locks, his relentless pursuit of the quarterback and his omnipresent charisma -- which helped him in his brief career as a professional wrestler -- Greene made the most of his skills.

"I wasn't the biggest [and] I wasn't fastest,'' Greene once said. "But as long as you have a motor, you have heart ... that will overcome any physical limitations.''

Greene regularly used film study to search for an opponent's weakness.

"I figured out how to pass rush,'' Greene said. "I figured out how to put a guy, an offensive tackle three to four inches taller, 80 pounds heavier, put him in a position of failure, and I did that.''

A two-time All-Pro and five-time Pro Bowl selection, Greene finished his career with 160 sacks, which ranks third in league history behind only Bruce Smith (200) and Reggie White (198). He also had 23 forced fumbles and five interceptions.

"My condolences go out to Kevin's wife, Tara, their children and the entire Greene family in this most difficult time," Steelers president Art Rooney II said. "They will always be members of the Steelers family and in our thoughts and prayers."

Greene was inducted into the Hall of Fame in 2016.

A 20-year-old U.S. Army corporal who was found dead in North Jersey last weekend is believed to have been abducted and killed by a fellow soldier stationed at Fort Drum in upstate New York, Sussex County prosecutors said Monday.

Cpl. Hayden Harris disappeared after leaving Fort Drum on Thursday night for a vehicle transaction in Watertown, New York.

Army officials said the young soldier's body was found in a wooded area of Byram Township in Sussex County on Saturday, when firefighters discovered blood and personal effects in the area. Harris died of injuries from a shooting, investigators said.

On Monday, First Assistant Prosecutor Gregory Mueller identified 23-year-old Jamaal Mellish, another soldier stationed out of Fort Drum, as the man suspected of killing Harris.

Mellish allegedly "abducted" Harris after a meeting between them escalated, Mueller told the New Jersey Herald. Mellish is believed to have driven from upstate New York to the New York City area in a Chevrolet Silverado. The vehicle then crossed into New Jersey.

Another juvenile, who has not been identified, was in the vehicle with Mellish and Harris, according to authorities.

Investigators previously believed Harris had been driving a 2016 Ford Mustang with license plates from his home state of Tennessee. Both the Mustang and Silverado belonged to Harris, Army officials said.

It's not yet clear what may have led to a disagreement between Harris and Mellish. Neither has any known connection to Sussex County, officials said.

Mellish was arrested in Jefferson County, where Fort Drum is located, and is awaiting extradition to Sussex County.

Mueller said criminal charges against Mellish in New Jersey likely will include murder and weapons offenses.

A Black man with dreadlocks man was sharing a meal with his family in a shopping mall Saturday when Virginia Beach police walked up to him and handcuffed him without telling him why.

The cops led him outside to a parking lot of the Lynnhaven Mall, detaining him for several minutes, still refusing to tell him why they had handcuffed him.

It was only after the same cops arrested another Black man with dreadlocks that they removed the handcuffs, allowing him to be on his way with a weak apology.

"We got a description somebody was using stolen credit cards," a cop told the man's wife who posted the video to her Facebook page where she goes by Kiara Love.

"That person is a Black man with dreads and was wearing all black and was with a boy that was wearing red," the cop explained. "I completely apologize. It was a complete misunderstanding."

But for Black Americans, it was just another case of racial profiling which could have easily led to another innocent Black man shot and killed by police.

"That's why we say, 'Black Lives Matter,'" said the man who has only been identified as "Jehmel" at this time. "Look how you treat us in front of people. Black Lives Matter. That's why we fight."

The cops in the video were not wearing facial masks when they first handcuffed Jehmel even though last month Governor Ralph Northam issued an order that everybody over the age of five must wear a mask while inside public places of business.
