A 15-year-old Black girl who has been incarcerated in Michigan since mid-May after she failed to do her online schoolwork won't be returning home, a judge decided Monday, in a case that has stoked outrage that it is emblematic of systemic racism and the criminalization of Black children.
Oakland County Judge Mary Ellen Brennan determined that the girl has been benefiting from a residential treatment program at a juvenile detention center, but is not yet ready to be with her mother. Brennan, the presiding judge of the court's Family Division, scheduled another hearing for September, NBC affiliate WDIV reported.
The girl, who is being identified only by her middle name, Grace, was the subject of a report published last week by ProPublica Illinois, with politicians and community activists expressing outrage over her incarceration.
Grace told the judge that she wanted to go home: "I miss my mom. I can control myself. I can be obedient."

An Ohio man seen kneeling on the neck of a 2-year-old boy on social media has been arrested, authorities said Thursday.
Isaiah Jackson, 20, was booked into jail on a probation violation after the Clark County Sheriff’s Office launched an investigation Tuesday into the photo, which depicts a man with his knee on the back of a white child neck’s along with a caption, “Blm now mf.”
A second person is also seen behind the child holding the youngster’s hands behind his back.
Deputies determined where the incident took place and made contact with Jackson as well as the child and the child’s mother, sheriff officials said.
Jackson was taken into custody after investigators found he had a parole authority hold from the state’s Department of Rehabilitation and Correction, authorities said.
The child was taken to a hospital, where doctors found no injuries in connection to the incident. The child’s mother was unaware that the photo had been taken, deputies said.
“Detectives continue to investigate, and are continuing to compile evidence related to several other persons who were directly involved,” sheriff’s officials said in a statement Thursday.
Sheriff’s officials have prepared the case to be presented to the county prosecutor’s office to provide a “determination on the scope and breadth” of felony charges that Jackson will face in the alleged incident.
The exact charges Jackson may face were not specified by sheriff’s officials. He remained in custody as of Thursday afternoon, jail records show.

AUSTIN, Texas (AP) — A man was fatally shot at a protest in Texas when he approached a vehicle and the driver inside opened fire, police said.
The shooting happened just before 10 p.m. during a protest in Austin, police spokesperson Katrina Ratliff told reporters early Sunday. The man was taken to a hospital where he was later pronounced dead.
The vehicle had honked, turned down a road and then sped toward protesters, witness Michael Capochiano told the Austin American-Statesman. The man, who Capochiano said was carrying a rifle, approached the vehicle and was shot by the driver. The driver then drove away, Capochiano said.
Initial reports indicated “the victim may have been carrying a rifle,” Ratliff told reporters, adding that the suspect was detained and was cooperating with police.
The crowd gathered Saturday for a Black Lives Matter protest, news outlets reported. The demonstration was streamed live on Facebook and captured audio of a vehicle’s horn honking and several gunshots being fired.

FORT HOOD, Texas (KWTX) – Friends of Fort Hood Pvt. Mejhor Morta, 26, of Pensacola, Florida, found dead last Friday in the area of Stillhouse Hollow Lake, say they’re puzzled and concerned.
Some fishermen in a boat found Morta’s body just after midnight Friday morning at the base of the lake’s dam.
A preliminary autopsy report indicates his death is consistent with drowning.
"We used to talk about a lot of stuff and he told me he didn't know how to swim," said Jermaine Hamlin, who underwent basic training with Morta at Fort Benning, Ga.
Hamlin said he didn’t know if Morta liked to fish, but said he wouldn’t be surprised if the private had gone to the lake to meditate and read.
“He meant a lot to me,” he said.
“It’s kind of hard to talk about it…he always kept a smile on my face.”
Morta was discovered missing on July 16.
“As soon as his unit identified his absence, they immediately searched the unit area and reached out to his family and friends to attempt to locate him,” Fort Hood said.
Morta’s death was the fourth involving a Fort Hood soldier in the past two months.
Another friend from basic training, David Fox, expressed concern about safety at the post.
“In my duty station I feel safe, but for those in Fort Hood Texas I am sorry for them. I don’t know what’s going on there,” he said.
Pfc. Brandon Rosecrans was shot to death on May 18 along Fuller Lane just north of the western end of Stillhouse Hollow Lake.
His burning Jeep was later found near the 2500 block of Jubilation Drive.
He was killed just days before his 28th birthday.
On June 19 investigators found the skeletal remains of Pvt. Gregory Wedel-Morales during a K-9 search of a field in the 3200 block of Florence Road in Killeen.
He disappeared without a trace on Aug. 19, 2019.
He was first declared AWOL and later was added to the Army’s deserters list.
He has since been reinstated and posthumously promoted to private second class.
On June 30, contractors working on a fence along the Leon River discovered what appeared to be human remains that were later identified as those of Spc. Vanessa Guillen, 20, who was last seen sometime between 11:30 a.m. and 12:30 p.m. on April 22 in the parking lot of her 3rd Cavalry Regiment Engineer Squadron Headquarters.
According to court documents, another soldier who later killed himself as police approached beat her to death with a hammer.
He and his girlfriend, who remains in federal custody, later dismembered and tried to burn the remains, the documents say.
Morta joined the Army in September 2019 had had been assigned since Mayi to Fort Hood’s 1st Battalion, 5th Cavalry Regiment, 2nd Armored Brigade Combat Team, 1st Cavalry Division.
“The Black Knight family is truly heartbroken by the tragic loss of Private Mejhor Morta. I would like to send my heartfelt condolences to his family, friends and loved ones,” said Lt. Col. Neil Armstrong, commander of 1st Bn. 5th Cav. Regt.
“My thoughts and prayers are with them during this difficult time. Private Morta was a great Trooper and this loss is felt by every member within our formation.”
The Bell County Sheriff’s Department is investigating the circumstances of Morta’s death.

(CNN) A crowd of people in France saved two children from an apartment fire, catching them as they jumped from the burning building.
The rescue of the brothers, aged 3 and 10, happened on Tuesday, reports CNN affiliate BFM, and was captured in remarkable video footage from a nearby building in Grenoble, southeastern France.
In the footage, one child is first dropped into the crowd, while thick black smoke billows from the flat.
The other boy then sits on the ledge for several seconds as neighbors wave him down. The child leaps forward and is again caught by the crowd.
Locals were praised by Grenoble's mayor, who called the rescue "heroic."
One of those who helped the children to safety was Athoumani Walid, who told BFM TV that he heard screams from outside his window when he saw the two children trapped.
"The eldest one took a lot of courage and a lot of confidence. He put his little brother first. We took him in and we said to the other one, 'Come on, jump, it's your turn, jump,'" Walid said.
"Then he climbed up through the window, he let go, and then we got him again. None of them fell on the floor. No one's hurt."
The children were alone in the apartment because their mother had gone grocery shopping and their father had left for work, state prosecutor Éric Vaillant said, according to BFM.
