A couple is suing a fertility clinic in Los Angeles after giving birth to the wrong baby. Their biological child was born to another couple after 2 women were implanted with the other's embryo.
Daphna & Alexander Cardinale tried to conceive a second child for 3 years. With the help of in vitro fertilization, they were thrilled to welcome a baby girl in September 2019. But Alexander Cardinale said he immediately felt something was wrong.
"I had a weird, sort of a gut reaction when she was born. It wasn't anything logical. It was just like an instinct," he said.
A DNA test 2 months later confirmed their worst fear: The infant was not their biological daughter. Daphna Cardinale was implanted with a stranger's embryo, while the stranger received theirs. That woman, who wishes to remain anonymous, gave birth a week earlier to the Cardinales' biological daughter.
"When I found out she wasn't mine I poured more love into her. Maybe I was just clinging to her. I was just so scared I was going to lose her, which I ultimately did," Daphna said.
The Cardinales felt robbed of the time with their biological daughter. "We had to play a lot of catchup," Alexander said.
The babies were returned to their biological parents. The Cardinales are now suing their physician, California Center for Reproductive Health & a third-party embryology lab for alleged misconduct, including medical malpractice & negligence.

MINNEAPOLIS (AP) — Minnesota Vikings star Dalvin Cook is facing a lawsuit from a former girlfriend for alleged assault, battery and false imprisonment for a year-ago altercation at his home, & the running back is accusing the woman of assaulting & extorting him.
Cook’s attorney, David Valentini, said the woman, a U.S. Army sergeant, unlawfully entered Cook’s home, assaulted him & has been trying to settle her claim for “millions of dollars.”
According to details from the lawsuit, the woman traveled to Cook’s home near Vikings headquarters to end their relationship on Nov. 19, 2020. She said Cook was angered by her request that he help her gather her belongings. She said Cook then “grabbed her arm & slung her whole body over the couch, slamming her face into the coffee table & causing her lower forehead & the bridge of her nose to bust open.”
The lawsuit, which was filed in Dakota County District Court, includes as evidence messages sent from Cook to the woman after the fight apologizing for his actions. She said she suffered a concussion, deep cuts to her face & other bruising.
In a statement Valentini said Cook had the legal right to defend himself per Minnesota’s castle doctrine. He said the woman entered Cook’s home with a stolen garage door opener, punched him & sprayed mace in his face without provocation. The woman also sprayed mace on 2 guests of Cook’s & forced the 3 of them at gunpoint to remain in his home for “several hours.”
The injuries to the woman’s face, Valentini said, occurred when Cook tried to stop his ex-girlfriend from assaulting one of his female guests. Valentini said the woman had also previously caused damage to Cook’s property.
“We are confident a full disclosure of the facts will show Mr. Cook did nothing wrong,” Valentini said.

The father of the 9-year-old boy who was “trampled and catastrophically injured” at the Astroworld Festival in Houston has filed a negligence lawsuit against concert promoter Live Nation and Travis Scott.
Ezra Blount was on his dad Treston Blount’s shoulders at the Friday night festival when the two became trapped in the deadly crowd surge that started soon after Travis Scott took the stage at 9 p.m., his grandparents confirm.
“He kept screaming, ‘I can’t breathe.’ But everyone was pushing. It was so tight with no exits. His dad couldn’t breathe at all and passed out. We don’t really know what happened to Ezra after that,” grandmother Tericia Blount tells Rolling Stone. The family later found Ezra at a nearby hospital listed as a John Doe, and his father raced to his side, she says.
“During the concert, (Ezra), a 9-year-old minor child, was suddenly forced to watch in terror as several concertgoers were injured and killed as a result of the crowd surge. He himself was kicked, stepped on, and trampled, and nearly crushed to death,” the new lawsuit obtained by Rolling Stone claims. “He is currently in an induced coma on life support and has severe liver, kidney and brain damage. To his young, growing body, these injuries will have life-long effects, impairing his quality of life and ability to grow and thrive.”
The lawsuit is seeking a least $1 million in damages.
“This young child and his family will face life-altering trauma from this day forward, a reality that nobody expects when they buy concert tickets. Concerts and music festivals such as this are meant to be a safe place for people of all ages to enjoy music in a controlled environment. None of that was true about the Astroworld Festival,” Crump said in a statement Tuesday. “This little boy is currently fighting for his life, and his parents will never know the same child they entered Astroworld with.”
The new lawsuit – which also names promoter ScoreMore Management, its boss Sascha Stone Guttfreund and Scott’s label Cactus Jack Records as defendants – alleges the concert’s organizers failed to stop Scott’s performance for at least 40 minutes after city officials declared the scene a “mass casualty event.”

Nov 9 (Reuters) - The Oklahoma Supreme Court on Tuesday overturned a $465 million judgment against Johnson & Johnson (JNJ.N) in a lawsuit by the state alleging the drugmaker fueled the opioid epidemic through the deceptive marketing of painkillers.
The court on a 5-1 vote ruled that the state's public nuisance law does not extend to the manufacturing, marketing and sales of prescription opioids and that a trial judge went too far in holding the company liable under it.
"However grave the problem of opioid addition is in Oklahoma, public nuisance law does not provide a remedy for this harm," Justice James Winchester wrote.
The decision marked the latest setback for states and local governments pursuing lawsuits seeking to hold drug companies responsible for a drug abuse crisis the U.S. government says led to nearly 500,000 opioid overdose deaths over two decades.
The Oklahoma lawsuit was the first of the more than 3,000 cases against pharmaceutical manufacturers, drug distributors and pharmacies to go to trial.

NASHVILLE, Tenn. (AP) — The “heroic actions” of Tennessee pastor, Ezekiel Ndikumana, who tackled a man waving and pointing a gun during a service “saved a church from further violence,” police said.
No shots were fired during the incident Sunday at Nashville Light Mission Pentecostal Church, Metro Nashville Police said in a statement.
The 26-year-old man, identified as Dezire Baganda, pulled a gun as the pastor was praying with several people at the altar and told everyone to get up as he waved and pointed the gun at the congregation, police said. The pastor tackled the man and then several church members helped to disarm and hold him until officers arrived, the statement said.
Baganda is due in court on November 10. He faces 15 counts of aggravated assault. Additional charges are expected.
Bond is set at $375,000 for Baganda.

Torazz and His 4EYMG Labelmate TZIE pair up on his latest Sexy and Provocative Single, "Baby, I Gotta"
Singer and songwriter Torazz is a 4EYMG artist from Prince George's County, Maryland, and creates a new genre of music that he likes to call R&B/Pop. He sings R&B while the beat behind it is Pop, then merges the two streams into one unique style of music. Torazz is a self-described funny guy who wears his heart on his sleeve. Music has always been his outlet. He makes his music to help people get through their adversity, just as music has helped him get through his.

Growing up as an only child appeared lonely for Torazz. As a teenager, with hormones raging and the feeling that his parents just didn't understand- music was like a friend and confidante. When he was eleven years old, he began to write poems and put beats behind them. He grew up with music that his dad listened to often. Also, he was inspired at a young age by the music of Trey Songz, whose mixtapes and albums his dad would play. Although Torazz is not a rapper, he loves listening to Drake, whose music style allows him to sing along with rap.

Torazz had a couple of jobs before making music his job. He used to be a manager at DollarTree and later worked at Amazon. But the music never feels like a job to Torazz. "Music is just a lifestyle at this point." He has been in a couple of sessions with other artists to give them input, but his main focus is on his music.

Torazz believes in staying open-minded with wisdom- he takes to heart what he does. His priority is God and having a stronger foundation of people around him who "believe in the moment." LONDON, Ky. (AP) — A 16-year-old girl held captive by a 61-year-old man was rescued on an interstate highway in Kentucky after another driver noticed her using a distress signal with her hand that was made popular on TikTok, law enforcement officials said.
The girl’s parents reported their daughter missing from Asheville, North Carolina, last week. Two days later, her hand-signal — and the alert driver — enabled sheriff’s deputies in Kentucky to stop the car and arrest James Herbert Brick of Cherokee, North Carolina, on charges of unlawful imprisonment and possession of material showing a sexual performance by a minor, Deputy Gilbert Acciardo said.
The girl and the driver were acquainted, and she initially went with the man willingly, but at some point got scared, Acciardo, the spokesman for the Laurel County Sheriff’s Office, told The Lexington Herald-Leader. The man had taken her to Ohio to visit his relatives, and left with her after they realized she had been reported missing, a sheriff’s statement said.
The other driver called 911 from Interstate 75 in Laurel County, Kentucky, on Thursday to report that a girl in a silver Toyota car was making distress hand signals that he recognized from TikTok as a plea for help from domestic violence. The signal is to raise your hand, showing your palm with your thumb extended, and then tuck your thumb into your palm and lower your fingers over it, as if to trap the thumb.
Officials say the driver continued following the man and the girl, updating a dispatcher, until deputies were able to stop the Toyota and rescue the girl.
The sheriff’s statement says a cellphone found in the man’s possession had images that allegedly “portrayed a juvenile female in a sexual manner.” Brick was booked into the Laurel County correctional center on a $10,000 bond pending a court hearing on Tuesday.

KENOSHA, Wis. (AP) — A protester and volunteer medic wounded on the streets of Kenosha by Kyle Rittenhouse testified Monday that he was pointing his own gun at the rifle-toting Rittenhouse when the young man shot him.
Gaige Grosskreutz, the third & final man gunned down by Rittenhouse during a night of turbulent racial-justice protests in the summer of 2020, took the stand at Rittenhouse’s murder trial & recounted how he drew his own pistol to try to stop the bloodshed.
“I thought the defendant was an active shooter,” the 27-year-old Grosskreutz said. Asked what was going through his mind as he got closer to the 17-year-old Rittenhouse, he said, “That I was going to die.”
Rittenhouse shot Grosskreutz in the arm, tearing away much of his bicep — or “vaporized” it, as the witness put it.
Under questioning from the prosecution, Grosskreutz said he had his hands raised as he closed in on Rittenhouse. Prosecutor Thomas Binger asked Grosskreutz why he didn’t shoot first.
“That’s not the kind of person that I am. That’s not why I was out there,” he said. “It’s not who I am. And definitely not somebody I would want to become.”
But during cross-examination, Rittenhouse defense attorney Corey Chirafisi asked: “It wasn’t until you pointed your gun at him, advanced on him … that he fired, right?”
“Correct,” Grosskreutz replied.
Rittenhouse, now 18, is on trial on charges of killing two men & wounding Grosskreutz. The one-time police youth cadet from Antioch, Illinois, had gone to Kenosha with an AR-style semi-automatic rifle & a medical kit in what he said was an effort to safeguard property from the damaging demonstrations that broke out over the shooting of Jacob Blake, a Black man, by a white Kenosha police officer.
Prosecutors have portrayed Rittenhouse as the instigator of the bloodshed. His lawyers have argued that he acted in self-defense. He could get life in prison if convicted of the most serious charges against him.
Grosskreutz said he had gone to the protest in Kenosha to serve as a volunteer medic, wearing a hat that said “paramedic” & carrying medical supplies, in addition to a loaded pistol.
Grosskreutz said his permit to carry a concealed weapon had expired and he did not have a valid permit that night.
“I believe in the Second Amendment. I’m for people’s right to carry and bear arms,” he said, explaining why he was armed. “And that night was no different than any other day. It’s keys, phone, wallet, gun.”
He said he went into action after seeing Rittenhouse kill a man just feet away — the second person Rittenhouse fatally shot that night.
On cross-examination, Chirafisi sought to portray Grosskreutz as dishonest in his description of the moments right before he was shot, with Chirafisi asserting that Grosskreutz was chasing Rittenhouse with his gun out.
Grosskreutz denied he was chasing Rittenhouse & said that he was concerned about Rittenhouse’s safety after seeing others chase him & someone try to kick him.
Chirafisi also pointed to Grosskreutz’s lawsuit against the city of Kenosha, in which he alleges police enabled the violence by allowing an armed militia to have the run of the streets during the demonstration.
“If Mr. Rittenhouse is convicted, your chance of getting 10 million bucks is better, right?” Chirafisi said.
At the defense table, Rittenhouse kept his eyes on Grosskreutz as he testified, taking detailed notes when the witness spoke about the moment he was shot.
One juror nodded her head in agreement when the judge instructed the jury to disregard Grosskreutz’s referring to Rittenhouse’s fatal shooting of another protester as a “murder. ”
