BRUNSWICK, Ga. (AP) — Opening statements began Friday in the murder trial of three white men charged in the shooting death of Ahmaud Arbery, with a prosecutor telling jurors that faulty assumptions led them to chase down the 25-year-old Black man. 

Greg McMichael & his adult son, Travis McMichael, armed themselves & pursued Arbery in a pickup truck as he ran through their neighborhood just outside the Georgia city of Brunswick on Feb. 23, 2020. A neighbor, William “Roddie” Bryan, joined the chase & recorded graphic video of Travis McMichael shooting Arbery 3 times with a shotgun.

“All three of these defendants did everything they did based on assumptions — not on facts, not on evidence,” prosecutor Linda Dunikoski told the jury. “And they made decisions in their driveways based on those assumptions that took a young man’s life.”

Greg McMichael said his son killed Arbery in self-defense after Arbery attacked with his fists & tried to take Travis McMichael’s gun.

Prosecutors say Arbery was merely out jogging, was unarmed & had committed no crimes in the neighborhood. When Bryan’s video of the killing leaked online in May 2020. 

Controversy erupted on Wednesday, the final day of jury selection, when prosecutors objected to a final jury consisting of 11 whites & 1 Black juror. They argued that defense attorneys had cut 8 potential jurors from the final panel because they are Black, which the U.S. Supreme Court has declared unconstitutional.

The judge agreed there appeared to be “intentional discrimination,” but said Georgia law limited his authority to intervene because defense attorneys stated non-racial reasons for excluding Black panelists from the jury.

BRUNSWICK, Ga. (AP) — An attorney for one of the white men standing trial in the death of Ahmaud Arbery told the judge Thursday he doesn’t want “any more Black pastors” in the courtroom after the Rev. Al Sharpton sat with the slain man’s family.

Kevin Gough represents William “Roddie” Bryan, who along with father and son Greg and Travis McMichael is charged with murder & other crimes in Arbery’s Feb. 23, 2020, killing. The 25-year-old Black man was chased & fatally shot after the defendants spotted him running in their neighborhood outside the Georgia port city of Brunswick.

Gough told Superior Court Judge Timothy Walmsley that he was concerned Sharpton’s presence in court Wednesday was an attempt to intimidate the disproportionately white jury hearing the case. The jury was not in the courtroom when he made the remarks.

“Obviously there’s only so many pastors they can have,” Gough said. “And if their pastor’s Al Sharpton right now that’s fine, but then that’s it. We don’t want any more Black pastors coming in here ... sitting with the victim’s family, trying to influence the jurors in this case.”

A distraught Alec Baldwin repeatedly asked why he was given a “hot gun” after his prop weapon discharged on his New Mexico film set Thursday, accidentally killing a cinematographer and injuring the director, witnesses have claimed.

The tragic accident unfolded while Baldwin was filming his upcoming Western film “Rust” at Bonanza Creek Ranch in Sante Fe.

Cinematographer Halyna Hutchins, 42, died and director, Joel Souza, 48, was injured after they were both struck when the gun discharged, the Santa Fe County Sheriff’s Office said.

Immediately after the incident, an eyewitness told Hollywood gossip site Showbiz 411 that Baldwin started asking how he could have been given a “hot gun” — meaning a firearm loaded with real ammunition.

“In all my years, I’ve never been handed a hot gun,” the actor allegedly kept saying.

The witness said Baldwin was in shock after the ordeal and he “had no idea how badly they were hurt or Halyna was dead.”

The film set was sent into lockdown and production was halted immediately after the accidental double shooting, which unfolded at about 2 p.m.

Hutchins was airlifted to the University of New Mexico Hospital in Albuquerque, where she died from her injuries.

The director was being treated at Christus St. Vincent Regional Medical Center in Santa Fe, authorities said.

“Detectives are investigating how and what type of projectile was discharged,” the sheriff’s office said in a statement.

No charges were filed as of late Thursday and detectives are still interviewing witnesses.

Baldwin was among those questioned by authorities, and he was pictured in tears as he spoke into a cellphone outside the sheriff’s office Thursday.

LOUISVILLE, Ky. (WAVE) - The FBI has arrested 10 people associated with an alleged street gang operating in Louisville named “Everybody Shine Together,” or “EST,” the U.S. Attorney’s Office confirmed.

The alleged gang shares its name with famous Louisville Rapper EST Gee’s business, Everybody Shine Together Entertainment. Est Gee, or George Stone, is listed as one of the managing members of that company by the Kentucky Secretary of State.

Stone was not arrested in this case, but two of his business partners, Ricos Mosely and Eric Mosley, were. Ricos Mosley & Eric Mosley, who identifies himself as EST Gee’s manager, are now facing a minimum of 10 and 15 years in prison if they are found guilty on weapons & drug-related charges.

The indictment is the result of a federal initiative called Project Safe Neighborhoods which aims to take out the most violent criminal enterprises in Louisville.

According to the U.S. Attorney’s Office, the suspects are charged with crimes like trafficking, drug distribution, & conspiracy. Some of the drugs involved, they said, included heroin, methamphetamine, fentanyl, & cocaine.

During search warrants, agents confiscated one kilo of cocaine, guns, a stolen car & $160,000 cash.

Everybody Shine Together Entertainment was the name on a number of checks used to bail out Kevon Lawless, who is suspected of killing 3-year-old Trinity Randolph & her father Brandon Waddles in 2020. Lawless was being held on a $300,000 bond.

Lawless is now facing the death penalty in the case. He was on probation for an attempted murder conviction when he allegedly killed Randolph.

Stone rapped about bailing Lawless, who goes by the name of Lil’ Kada, out of jail in a song released in July called “Sky Dweller.” At the time, Lawless had a $1 million bond.

“They want one mil’ for Lil’ Kada, know I’m comin’ to get you, baby,” Stone raps. “Know my heart might get me killed, but it got me here, so risks, I’m takin.’”

Eric Mosley, 30, Zaman Taylor, 21, Khasi Jones, 28, Devonzo Summers, 24, Ricos Mosley, 33, Barry Reed, 20, Cedric Palmer, 25, Aerion Cook, 21, Dazaray Rice, 27, and Darrian Toogood, 24 were all arrested as part of the investigation.

Alec Baldwin failed to follow the No. 1 rule of gun safety before the fatal shooting on the set of “Rust,” a Hollywood weapons expert tells The Post.

“Loaded or unloaded, a weapon never gets pointed at another human being,” said Bryan Carpenter, who heads Dark Thirty Film Services.

Even on a film or TV set, he said “you never let the muzzle of a weapon cover something you don’t intend to destroy.”

The prop gun had misfired twice on Oct. 16 and once the week before, according to the Los Angeles times, and union workers said the “Rust” set had been plagued by safety issues, prompting them to walk out in the hours ahead of the tragic shooting.

The International Alliance of Theatrical Stage Employees also claimed Halyna Hutchins was killed by a live round of ammunition, which should never have been on a film set, said former filmmaker and US National Shooting Team member Peter Lake.

"I can’t think of any reason there would be a live round anywhere on set. They are generally prohibited from movie sets. There is no explanation I can think of why there would be a live round in a gun on set. You certainly wouldn’t have it in the hands of an actor,” Lake told The Post.

Hutchins, a 42-year-old cinematographer, was killed when Baldwin fired a handgun as she was behind the camera, filming him, on Thursday. Director Joel Souza, who was standing near Hutchins, was also hurt in the shooting.

The weapon was declared “cold” by a crew member, while specific details of the shooting remain unclear and are under investigation, including the trail of events that put the deadly firearm in Baldwin’s hands.

“Nonetheless,” Carpenter said, the weapon handled by Baldwin was “obviously pointed at another human being.”

The weapons consultant cited what he called “Colonel Jeff Cooper’s four fundamentals” of gun safety.

“All guns are always loaded. Even if they are not, treat them as if they are,” reads the No. 1 rule by Cooper, an influential gun safety expert who died in 2006.

While news reports call the firearm a “prop” weapon, Carpenter said the label can be misleading. Some movie-set firearms are “true” props made of rubber. But others, like the one used on the set of “Rust,” are capable of deadly force.

ELLICOTT CITY, Md. (WJZ) — A judge on Wednesday ordered Jeffrey Burnham to remain in the Allegany County Detention Center while awaiting trial in the murder of 83-year-old Rebecca Reynolds last week in Cumberland.

But that was only the start of the killing Burnham is suspected of carrying out. He’s accused of then driving to Ellicott City, where police say he shot & killed his brother & sister-in-law, Brian & Kelly Sue Robinette.

Burnham is charged with 2 counts of first-degree murder & 2 counts of second-degree murder in the death of his brother & sister-in-law. We’re also learning more about Burnham’s motives & why his mother contacted police to alert them about his behavior.

Newly released charging documents show that just 1 day before the murders, Burnham told his mother he was upset his brother Brian, a pharmacist, was administering COVID vaccines.

Her mother told police Burnham said “Brian knows something.” She said he believed the government was poisoning people with the vaccine, prompting her to contact police to voice concerns about his mental health & stability.

Last Thursday, police called on the public for help in locating Burnham.

The manhunt led authorities to capture Burnham in West Virginia. He was extradited back to Maryland on Tuesday.

Outside the Robinettes’ home, a small memorial has been assembled. Friends have set up a GoFundMe page for their two children who are now adults.

“Just like their parents, nicest kids in the world,” Perrus said. “All we can do right at this point is be there & support them.”

Burnham has a preliminary hearing scheduled for early November.

LONG BEACH, Calif. (KABC) -- The family of Mona Rodriguez, the 18-year-old woman shot by a school safety officer in Long Beach, is pleading for the hospital to keep their loved one on life support.

Relatives showed up for a vigil outside Long Beach Memorial Medical Center Wednesday night and were devastated after they were told that Rodriguez is brain dead and the hospital plans to disconnect her from life support.

"They're trying to take my sister away," said Oscar Rodriguez, Mona's brother. "At first they had told me that I would be able to make the decision & now they're taking that from me.

"And honestly, I don't feel that's right because if a government official is the one that shot my sister then the government should not be the one that's deciding whether they should pull the plug or not. It doesn't make sense to me."

Rodriguez's heartbroken mother is pleading for the hospital to keep her daughter on life support & is demanding justice.

Rodriguez, the mother of a 5-month-old son, was shot by a school safety officer near Millikan High School Monday afternoon in an incident captured on video by witnesses.

Long Beach police said the school safety officer saw an altercation in the street involving the 18-year-old & another teenage girl.

A bystander's cellphone video shows that officer firing his gun when a silver sedan, in which Rodriguez was a passenger, sped off. The footage is part of a police investigation.

Rodriguez's boyfriend, Rafeul Chowdhury & his brother said they were in the fleeing car. They said the officer never told them to stop, & fired 2 shots into the vehicle.

Rodriguez was shot in the head.

"I don't think my girlfriend deserved this. It was all for no reason," Chowdhury said.

Rodriguez's family members & their attorneys said they want justice.

"She did not deserve to get shot. She might have been doing something she wasn't supposed to, but she was unarmed," Rodriguez's cousin Alex Cervantes said at the vigil. "She was already fleeing."

The family hopes criminal charges are brought against the officer.

"This officer should be in jail right now. The mother is suffering," Carrillo said. "Every family member & friend is suffering."

MELBOURNE, Fla.(ClickOrlando) – The Brevard County Sheriff’s Office on Thursday released dash camera video showing two deputies who were attacked during a traffic stop on U.S. 192 in West Melbourne on Aug 30.

During the violent attack, the sheriff’s office said Deputy Brian Potters was shot in the leg. The shooter, Paris Wilder, was shot & killed by Deputy Tyler Thoman.

The beginning of the dashcam video shows Thoman & Potters talking to two people outside the vehicle that was pulled over.

Potters notices a 2-month-old baby & a dog in the backseat seated next to a man, later identified as Wilder.

The deputy asked the man to exit the vehicle & the next part of the video shows Wilder exit the vehicle & point an AR-15 style rifle at Potters.

Wilder opened fire on Potters & Wilder appears to get shot during the encounter. Potters yells at Thoman that he has been shot.

Thoman & Potters used the Brevard County patrol car as a barrier between themselves and the shooter.

The video shows Wilder come from behind & hit Potters in the head with the gun and the deputy falls to the ground.

The video shows the suspect repeatedly hit Potters in the head while they are on the ground.

Thoman then fires multiple rounds at the suspect killing him.

Sheriff Wayne Ivey said Thoman saved Potters’ life.

Potters is expected to make a full recovery.

Ivey said Wilder has a criminal history.

The two other people at the traffic stop returned to the scene & cooperated with the deputies after Wilder’s attack.

ATLANTA (11 Alive) — Atlanta Police are investigating a deadly shooting in a shopping plaza where they said the victim was defending himself as others attempted to break into his car.

Officers said the shooting happened around 4 p.m. Friday afternoon at the Peachtree Battle Shopping Plaza, in Buckhead. According to police, a man was walking out of the Publix in the plaza when he noticed two men breaking into his car.

At that moment, he decided to confront the men & when the situation escalated, "the victim chose to take his weapon & defend himself against the people that were breaking into the vehicle," according to APD Deputy Chief Timothy Peek.

The first suspect was found dead inside of a car.

Police said the other man ran off toward Peachtree Hills firing a gun. Shots were fired back & forth, with the second suspect being wounded on his wrist.

"Because of the quick response, units were able to get into the area, set up a perimeter, and locate a second person a short distance away," Peek said.

After being located by officers, the second man was transported to the hospital for medical treatment.

"What we do know is the victim's vehicle was entered. We do know some of the victim's property was recovered on the scene but not inside the vehicle where it was originally left, " Peek added.

11Alive SkyTracker flew over the Peachtree Road scene where multiple officers were seen in the parking lot. An ambulance was there as well. People were standing outside one of the stores as officers conducted their investigation.

A few witnesses who spoke to 11Alive said they were in a nearby tavern & ducked under the tables after hearing multiple gunshots.

"It appears to be this was a group of people who decided to come out & commit crimes & unfortunately it led to the death of someone," Peek said.

Investigators are also checking to see if the suspects are connected to any other crimes. The investigation is ongoing.

A batch of fentanyl-laced cocaine killed a comedian and two others, and left the ex-girlfriend of Darius Rucker in a Los Angeles hospital, a report said.

Fuquan Johnson, writer for "Comedy Parlour Live," died after overdosing at a Venice home Friday night, according to TMZ. Two other victims were pronounced dead at the scene, the outlet said.

Comedian Kate Quigley, who lives next door to the house and recently dated the Hootie & the Blowfish singer, was hospitalized in critical condition, according to the report.

The medical examiner will officially determine what killed Johnson, 42, and the other unnamed victims, but sources tell the outlet all four people were ingesting coke tainted with the super powerful opioid.

Fentanyl, a synthetic painkiller that is up 100 times more potent than heroin, has been a factor in the deaths of Prince, Mac Miller and Tom Petty.

In 2019, fentanyl was involved in more than two-thirds of all New York City drug overdoses, data showed. Social media users have been warning of tainted coke making the rounds in the city’s party scene this spring and summer.
