(ABC30) STOCKTON, Calif. -- A Stockton businessman who pleaded no contest to raping a 5-year-old girl has been sentenced to just 90 days of house arrest.
In addition to the house arrest, 79-year-old Lyle Burgess was also sentenced Wednesday to five years of probation for the crime.
The girl's lawyer said Burgess was a friend of the girl's family, and the sexual assault happened after the family was invited to his Calaveras County cabin in 2016.
"He's obviously very wealthy, and it's just an example of how the wealthy people, time and time again, escape the penalty for what they did," said attorney Ken Meleyco.
Burgess does not even have to register as a sex offender. The girl's family has now filed a civil suit against Burgess.
PARIS (AP) — President Emmanuel Macron on Monday lauded as a hero a migrant from Mali who scaled an apartment building to save a child dangling from a balcony, and rewarded the young man’s bravery with an offer of French citizenship and a job as a firefighter.
“Bravo,” Macron said to 22-year-old Mamoudou Gassama during a meeting in a gilded room of the presidential Elysee Palace where Gassama also received a gold medal from the French state for “courage and devotion.”
Gassama climbed five stories up the apartment building, moving from balcony to balcony, and whisked a 4-year-old boy to safety on Saturday night as a crowd below screamed. His actions went viral on social media, where he was dubbed “Spiderman”
Gassama said he has authorization to stay legally in Italy, which is where he landed in Europe in 2014 after a more than a year in Libya and a trip across the Mediterranean Sea. He came to France in September to join his older brother, who has lived in France for decades.
Dressed in tattered blue jeans and white shirt, the young man recounted for the president what took place after he and some friends saw a young child hanging from a fifth-floor balcony.
“I ran. I crossed the street to save him,” Gassama told Macron. He said he didn’t think twice. “When I started to climb, it gave me courage to keep climbing.”
God “helped me,” too, he said. “Thank God I saved him.”
Gassama said he trembled with fear only after he had reached the boy, gotten him safely back over the balcony railing and taken him inside the apartment.
The father of the child was detained overnight for alleged parental neglect, and is to appear in court in September. He left the child alone while he shopped, then lingered to play Pokemon Go, Prosecutor Francois Molins told BFM-TV. The whereabouts of the child’s mother were unclear.
“You saved a child. Without you, no one knows what would have become of him,” the president said. “You need courage and the capability to do that.”
Macron offered to begin the naturalization process to make Gassama a French citizen and said, “Because this is an exceptional act ... we are obviously, today, going to regularize all your papers.”
Macron is behind a bill toughening French immigration law, and he stressed there is no contradiction between rewarding Gassama for his act of bravery and working to prevent migrants from entering France illegally by stopping the stream of arrivals at its source.
“An exceptional act does not make policy,” he told reporters later, vowing to maintain a policy that is “exigent, respectful of our principles” on asylum and “rigorous” regarding the migratory flux.
The special treatment for Gassama comes as authorities prepare to evacuate some 2,400 migrants from makeshift encampments in the French capital. The forced closure of the encampments is the subject of a heated debate between the Paris mayor, who wants to ensure the uprooted will be sheltered, and Interior Minister Gerard Collomb, who was present Monday at the Elysee.
Gassama told Macron he was arrested and beaten during his long rough stay in Libya, “but I wasn’t discouraged.”
The French president said Gassama’s actions made him deserving of special treatment. Working as a firefighter corresponds with his skills, said Macron, who opened the door for him to do just that.
“You have become an example because millions have seen you” on social media, the president said.

(Fox News) A Florida woman was rescued Friday after she slipped a note to a veterinarian saying she needed help because her armed boyfriend was beating and threatening her, police said.
Jeremy Floyd, 39, was arrested after allegedly holding his girlfriend, Carolyn Reichle, captive in their home in Volusia County for two days, the Volusia County Sheriff's Office said. The alleged incident began Wednesday when the 28-year-old woman said Floyd repeatedly beat her and threatened her at gunpoint. At one point, they struggled over a handgun that fired inside the house.
Reichle spent the Thursday recovering from a head injury. The next day while thinking of an escape plan, she convinced Floyd, a convicted felon, to allow her to bring her dog to the DeLand Animal Hospital, police said. Floyd insisted on going with her.
“On the drive to the vet, Floyd reportedly again pointed the gun at Reichle, threatening to kill her and her family,” police said.
Fearing for her life, Reichle was able to slip a note to a vet that read: "Call the cops. My boyfriend is threatening me. He has a gun. Please don't let him know."
The vet called police, who responded and took Floyd into custody. Authorities also recovered a handgun.
Reichle was taken to the hospital and treated for her injuries that included a head wound, a black eye and bruises, according to the sheriff's office. Authorities also discovered two bullet holes inside the couple’s home.
Floyd was charged with domestic violence -- aggravated assault with a firearm, false imprisonment, possession of a firearm by a convicted felon, possession of ammunition by a convicted felon and simple battery, police said.

An online search of court records showed that Diaz was arrested on two separate charges — domestic battery by strangulation, which is a felony, and misdemeanor domestic battery. The felony charge could result in a prison term of up to five years if convicted. He was being held in the Clark County Detention Center with bail set at $18,000.
He was released Saturday morning, but authorities could not provide any details of his release.

They met on a dating website for people with HIV and spent five not-entirely-blissful years together. Co-workers sometimes saw scratches on Mark van Dongen, courtesy of Berlinah Wallace’s jealous outbursts. Enraged during one fight, Wallace had poured boiling water on him.
By August 2015, van Dongen had had enough, the BBC reported. He wanted out of the relationship, he told Wallace. A little later, he told his ex that he was seeing someone else.
That’s when, prosecutors say, Wallace began researching sulfuric acid.
In all, she looked at 82 websites about the corrosive substance, prosecutors said. Some of the sites showed bodies scarred black by the acid. She bought a bottle from Amazon.
About a month after he announced that he was dating again, Wallace lured her ex to her home under the guise of rekindling their relationship. The breakup had been an on-again off-again roller coaster, and van Dongen wanted to reiterate that he was moving on with his new girlfriend. But he ended up staying the night anyway.
And as he lay in bed around 3 a.m. wearing nothing but boxer shorts, Wallace stood over him with a glass mug full of acid.
She told him, “If I can't have you, no one can,” laughed, then tipped the corrosive substance onto his face and exposed body, the BBC reported.
Calling the moment “an act of pure evil,” a British judge on Wednesday sentenced Wallace, 49, to a minimum of 12 years in prison for the attack. Last year, van Dongen ended his life.
Speaking via a translator, the victim’s father, Kees van Dongen, told reporters: “I’m very pleased she’ll be locked up for a minimum of 12 years, but really it’s too little, because we as a family have been sentenced to life.”
The acid attack left van Dongen with gruesome burns over 25 percent of his body, including most of his face.
After the attack, he ran into the streets of Westbury Park in Bristol, half-blind and wearing only his boxers, his screams attracting the attention of neighbors.
“My doorbell rang a few times and I knew there was something desperate going on, and it was him,” Nic White told the court, according to the BBC. “He looked like he was covered in a clay sort of mud, which I later realized was his skin melting.”
Rachel Oaten, who decontaminated the injured man at Southmead Hospital in Bristol, said he let out a bloodcurdling scream when he saw his reflection.
“He said: ‘Kill me now,’ ” Oaten recalled, according to the Sun. “ ‘If my face is going to be left looking like this I don’t want to live.’ ”
But it wasn't just his face. The attack ultimately left him paralyzed from the neck down. One leg had to be amputated. And he spent four months in a coma. The only thing he could move with any real precision was his tongue.
When detectives asked who had attacked him, he used the organ to spell out the word “Berlinah.”
On the night of the attack, detectives found her at her home, sitting on the sofa, the Sun reported. When they asked about van Dongen, she motioned to the glass mug on the floor.
She told conflicting stories on that night and in her trial. She said she bought the acid to distress some jeans and to deal with a bad smell emanating from her drains. And she painted van Dongen as the abusive one — and the aggressor that night. She told investigators, then the court, that he had tried to get her to drink the acid, saying it was water.
“You know like ‘come and take your medication and go to bed,’ ” she said in an interview, according to the Sun. “He wanted me to, to burn my insides.”
She claimed that he had tried to stop her from leaving the apartment and that she had thrown the acid in self-defense, the Sun reported.
But her sheets told the real story. They were blackened by acid on his side of the bed.
In the ensuing years, as Wallace awaited her trial, her ex-boyfriend's suffering spiraled.
He spent months in intensive care, then more months in the burn unit.
He endured recurrent septic chest infections, intense pain, post-traumatic stress disorder and night terrors, the Sun reported. The muscle in one of his arms was slowly eaten away by the acid. Paralyzed, he couldn’t scratch himself.
His father made an 800-mile road trip from Belgium each weekend to see him, sometimes sleeping in his car in the hospital’s parking lot. The older man’s marriage disintegrated under the strain and he went bankrupt, according to the BBC.
With the help of a family friend, van Dongen was transferred to a hospital in Belgium.
For him, there were two benefits: His father could be with him everyday, and assisted suicide is legal in Belgium.
Doctors had told him that he would need a third tracheotomy, his father said. It would help him breathe but take away his voice.
“He knew he’d lose his voice,” his father told Sky News. “So what would he have left? Just pain and itching and another ceiling to stare at all day long.”
Van Dongen applied for euthanasia, and a panel of three doctors ruled that his “unbearable physical and psychological suffering” meant he was eligible.
On Jan. 2, 2017, 15 months after the attack, van Dongen ended his life.
(Chron) A Stagecoach Police Department officer was arrested Saturday in the fatal shooting of his brother, a Harris County sheriff's deputy, according to the Montgomery County Sheriff's Office.
Robert Lee, a 35-year law enforcement veteran who previously worked for the Houston Police Department, initially told authorities that he shot someone who broke into his home in Stagecoach Farms around 5:30 p.m. Friday.
Investigators later learned that the victim was 57-year-old Rocky Lee - and that it may not have been a break-in. The slain deputy was a 26-year veteran of the Harris County Sheriff's Office and worked at the jail at 1200 Baker Street, law enforcement officials said.
He was shot multiple times in the bathroom of the home, which is near the intersection of Westward Ho and Singletree in Stagecoach Farms, about 9 miles south of Magnolia.
"The exact circumstances surrounding the shooting are under investigation," Montgomery County Sheriff's Office spokesman Scott Spencer said late Friday. "We don't believe there was a burglary at the residence."
After the shooting, Robert Lee was treated for high blood pressure at the scene and held overnight before he was charged.
Though he is accused of killing a law enforcement officer - which is normally a capital crime - he was not charged with capital murder because the victim was not acting in his official duty at the time.
As authorities worked to untangle the events leading up to the shooting Friday evening, David Cuevas, president of the Harris County Deputies Organization, offered condolences.
"At this point we're still trying to gather more information as to the circumstances surrounding the shooting, but our thoughts and prayers are with the family at this time," he said. "Any loss to the Harris County Sheriff's Office family is a loss to all of us."
Harris County Sheriff Ed Gonzalez wrote on Twitter Friday that "our hearts are broken with the loss of Deputy Lee."
"He proudly served our county for many years," Gonzalez wrote. "Please keep him in and his family in your thoughts and prayers, as well as the many friends and co-workers gained over the years."
The Wu Tang Clan's debut album "Enter the Wu-Tang (36 Chambers)" turns 25 on November 9th. The group has big things in store to mark the occasion,
Billboard reports the Wu will perform the album in full on May 27 at the Soundset Music Festival in St. Paul, Minnesota, and on May 28 to close the Movement Electronic Music Festival in Detroit.
In addition, the group is preparing to release it's sixth studio album. RZA is normally at the helm, but Ghostface Killah will take over the executive producer role for this one.
"RZA's a deep thinker. His subject matter ranges, I think, broader than all of ours," says Inspectah Deck. "Ghost is definitely a soulful type brother and has a deep consciousness, but he's more direct to what Wu-Tang is. Wu-Tang was beats and rhymes. Ghost picks the harder beats. He has songs like 'Camay,' so he's not gonna skip the women. There's going to be a lot more variety of harder stuff. RZA comes up with deep concepts, but Ghost brings it just a little bit harder."
