(CNN) Three White men accused of chasing down & killing Ahmaud Arbery, a 25-year-old Black man out for a jog, are set to stand trial for murder in Georgia this week in a case thick with issues of racism, self-defense & cellphone video.
Gregory McMichael, his son Travis McMichael & their neighbor William "Roddie" Bryan Jr. are charged with malice & felony murder & have pleaded not guilty. They also face charges of aggravated assault, false imprisonment & criminal attempt to commit false imprisonment.
Jury selection in their state trial begins Monday.
Arbery was fatally shot February 23, 2020, while out jogging in Brunswick, Georgia, in an incident partly captured on video. The McMichaels said they were conducting a citizen's arrest on Arbery, who they suspected of burglary & that Travis McMichael shot him with a shotgun in self-defense. Bryan, who recorded the video, allegedly hit Arbery with his truck after he joined the McMichaels in chasing Arbery.
After the shooting, the three men were allowed to leave the scene & weren't arrested until after video of the incident was made public in early May.
The video and the delay in making the arrests, along with the killings of George Floyd & Breonna Taylor last year, helped spark nationwide Black Lives Matter protests that challenged how the legal system treats Black people.
The McMichaels & Bryan have also been indicted on federal hate crime & attempted kidnapping charges. They have pleaded not guilty to those charges as well.

WASHIINGTON (AP) — Colin Powell, former Joint Chiefs chairman and secretary of state, has died from COVID-19 complications, his family said Monday. He was 84.
In an announcement on social media, the family said Powell had been fully vaccinated.
“We have lost a remarkable and loving husband, father and grandfather and a great American,” the family said.
Powell was the first African American to serve as chairman of the Joint Chiefs of Staff and secretary of state.
But his reputation also suffered a painful setback when, in 2003, Powell went before the U.N. Security Council and made the case for U.S. war against Iraq. He cited faulty information claiming Saddam Hussein had secretly stashed away weapons of mass destruction. Iraq’s claims that it had not represented “a web of lies,” he told the world body.

An Italian DJ said MMA star Conor McGregor punched him & broke his nose at a party in Rome.
Francesco Facchinetti & his wife made the allegations on social media & said they were out clubbing with the star. It was hours after McGregor & his partner, Dee Devlin, had their son baptized at the Vatican.
Facchinetti said they were out "having fun" with McGregor for two hours when McGregor invited them to another party. When the DJ accepted the invite, McGregor punched him in the nose & broke it, he said on an Instagram video.
“At 2.30 this night I was attacked by Mr. McGregor,” Facchinetti said. “The very famous McGregor, who punched me in the mouth, broke my nose in front of 10 witnesses, his friends & his bodyguards. He attacked me without motivation as we talked for more than two hours & we also had fun together. I could have shut up & not say anything to anyone, but since I’m here to tell it, I must say that that person is really violent & dangerous.”
Facchinette's wife, Wilma, also detailed the incident on social media:
“Then out of nowhere, he threw a punch in the face of Francesco. He was inviting us to another party. Francesco said, ‘Okay, let’s go’ & he hit him. Luckily, he [Francesco] was very close so he [McGregor] couldn’t load up on his punch. Francesco flew back, fell on the table & then on the ground. The first thing that came to mind was ‘are we kidding? Is it a show?’ Then I was paralyzed. I turned around & saw that his friends were holding him against the wall because he wanted to continue beating Francesco. Then they took him away. I turned on the light & the guards turned them off. Francesco was bleeding. I wanted to help him & the guards chased us away.
“He will stay in Italy until October 26th. If you see him stay away from him. Don’t go near him & ask for autographs because he is an unstable & dangerous person."
Facchinette said on social media he plans to sue McGregor.
“I took a punch for nothing. That punch could go to anyone. My friends, my wife, or other friends. That’s why I decided to sue Conor McGregor because he is a violent & dangerous person.”
McGregor continues to get into trouble outside of his MMA career. He reportedly got into a scuffle with Machine Gun Kelly at the MTV Video Music Awards in September. In 2019, McGregor was charged with assault after punching a man in a Dublin bar while promoting his new brand of whiskey. He pleaded guilty.
And a year prior he hurled a dolly at a bus the week of a bout, breaking a window & injuring a fighter. There have also been allegations of rape & assault against McGregor over his career.

Last year, Kobe Bryant’s widow Vanessa Bryant and other family members of the crash victims sued the Los Angeles County sheriff saying deputies shared unauthorized graphic photos of the helicopter crash that killed Kobe, his and Vanessa’s 13-year-old daughter Gigi, and seven others. The lawsuit states Bryant was “shocked and devastated” by the reports of the pictures being shared and sought monetary damages in the tens of millions of dollars due to negligence, invasion of privacy, and intentional infliction of emotional distress.
Friday, as part of its defense, the county filed a court order trying to force Bryant and the other plaintiffs in the case to undergo psychiatric testing, saying they suffered their emotional distress due to the crash itself and not the photos, according to the USA Today, which saw the legal filing. From the filing:
“Plaintiffs cannot claim that they are suffering from ongoing depression, anxiety and severe emotional distress and then balk at having to support their claims.”
Attorneys for Bryant and the other families opposed forcing “involuntary” testing on the families — including six minors — who had already suffered a lot. Again, from the filing, via the USA Today:
“Unable to defend the indefensible conduct of its employees who took and shared horrific photographs of Plaintiffs’ deceased loved ones. … the County has resorted to scorched-earth discovery tactics designed to bully Plaintiffs into abandoning their pursuit of accountability.”
Now it falls to the judge in the case to determine whether Bryant and the other families must undergo psychiatric testing.
This lawsuit is still early in the winding legal process, with the sides contesting every step, including whether L.A. Sheriff Alex Villanueva and County Fire Department Chief Daryl Osby should have depositions. Also, Bryant’s attorney is still working on getting the phone records of the now retired fire department captain who took and shared the photos (he faced internal discipline from the department, but was not fired for his actions).
Bryant and the families have settled their lawsuit against the pilot and owners of the helicopter company involved in the tragic crash. However, the lawsuit against the county continues.
The lawsuit is scheduled to go to trial in February, although it is not uncommon in these cases for the trial date to get pushed back.

MEXICO CITY (AP) — Jacobo grew up in the western Mexico state of Jalisco, home to the Jalisco New Generation drug cartel. Never comfortable in school, he had an abusive childhood: at one point his mother held his hands over an open flame after he allegedly shoved a classmate.
Now 17, Jacobo claims he didn’t do it. But by 12, he was recruited to carry out his first murder for the cartel. “They go around looking for kids who are out on the streets and need money,” he recalls. “At 12 years old, I became sort of a hired killer.”
Jacobo told his story to Reinserta, a Mexican non-profit group that withheld the youths’ full names because all are under age, are currently being held at facilities for youthful offenders and most are scared of retaliation by the gangs.
“A neighbor asked me, ‘Do you want to earn money?’”. Growing up in a household where his family could seldom make ends meet, the answer was obvious. “I said yes. Who doesn’t want money?” But the $1,500 he earned didn’t last long; he picked up a meth habit, in part to quiet the psychological effects of what he was doing.
By his mid-teens he was torturing members of rival cartels for information, killing them and cutting up their bodies or dissolving them in acid, by now on the outskirts of Mexico City.
It was his last job that did him in; the cartel ordered him to carry out a killing in public, with lots of witnesses. Police came looking for him, and he went into hiding. The cartel contacted him to say it wanted to switch his hiding place, “but it was a trap,” he recalls. No longer useful — like so many disposable teen street-level drug dealers, lookouts and hitmen — the cartel wanted to get rid of him.
“When I showed up to meeting place, they started shooting me,” said Jacobo, whose last name was withheld because of his age. “I was shot in the head, in the back, in the abdomen.” Left for dead, he somehow miraculously survived, and is now serving a four-year youthful offender sentence for murder.
Mexican laws allow sentences of between three and five years for most youthful offenders, meaning almost all get out before they are 21.
Reinserta works to prevent youths from getting recruited by drug cartels, and find ways to rehabilitate them if they already have.
That is a difficult job in Mexico; though he’s alive, Jacobo is still afraid; he knows from his own work for the cartel that it is everywhere, and won’t stop at anything. “Now I am just a target to be eliminated, a minor irritant for one of the most powerful cartels in the country.”
Marina Flores, a researcher for Reinserta, said the study suggests some common myths about kids in drug cartels aren’t true.
While kids almost always engage in drug use and leaving — or being expelled from — school prior to joining a cartel, membership in local street gangs no longer appears to play much of a role. Cartels in Mexico are directly recruiting kids as soon as they leave school.
“Street gangs are not a previous step for them joining organized crime,” said Flores. “We are finding out that as soon as they are taken out of school, they immediately go into organized crime.”
The Network for Children’s Rights in Mexico says that, between 2000 and 2019 in Mexico, 21,000 youths under 18 were murdered in Mexico, and 7,000 disappeared.
The group estimates that some 30,000 youths had been recruited by drug gangs by 2019.
Reinserta says kids are frequently recruited to cartels by other children their own age; drug use is one way to recruit them, but the cartels also use religious beliefs and a sense of belonging kids can’t get elsewhere. Combinations of poverty, abusive homes and unresponsive schools and social agencies play a role.
In the report released Wednesday, Reinserta interviewed 89 minors held at youthful offender facilities in three northern border states, two states in central Mexico and two southeastern states. Of the 89, 67 of the youths said they had been actively involved with the cartels. The average age at the time they came in contact with the cartels was between 13 and 15. All of them had dropped out of school and all eventually went on to use firearms.
Drug cartels find kids under 18 useful, because they can go unnoticed more easily and can’t be charged as adults. They are initially used for street-level drug sales and as lookouts, but often are quickly promoted to act as killers.
In the northern border states, kids are lured with a wider variety of drugs, get more weapons and other training from the cartels, engage in a wider range of criminal activities and accelerate faster into violent roles than do youths in more southern states.
For example, Orlando grew up in the streets of northern cities like Ciudad Juarez, after escaping from an orphanage. Between the ages of ten and 16 he estimates he killed 19 people, mostly on the orders of the Sinaloa cartel.
Now, at 17 and serving four years for homicide, he says “I don’t know any other way to live, other than killing people.”

UPPER DARBY, Pa. (AP) — A woman was raped by a stranger on a commuter train in suburban Philadelphia in the presence of other riders who a police official said “should have done something.”
Superintendent Timothy Bernhardt of the Upper Darby Police Department said officers were called to the 69th Street terminal around 10 p.m. Wednesday after the assault on the westbound train on the Market-Frankford Line.
An employee of the Southeastern Pennsylvania Transportation Authority who was in the vicinity as the train went past called police to report that “something wasn’t right” with a woman aboard the train, Bernhardt said.
SEPTA police waiting at the next stop found the woman & arrested a man. The woman was taken to a hospital.
Bernhardt called the victim an “unbelievably strong woman” who provided police with a lot of information. She did not know her attacker.
“She’s on the mend,” Bernhardt said. “Hopefully she will get through this.”
The entire episode was captured on surveillance video that showed other people on the train at the time.
“There was a lot of people, in my opinion, that should have intervened; somebody should have done something,” Bernhardt said. “It speaks to where we are in society; I mean, who would allow something like that to take place? So it’s troubling.”
Fiston Ngoy, 35, has been charged with rape, aggravated indecent assault & related counts, according to Delaware County court records. Bernhardt said he is known to both SEPTA & Upper Darby police.
“There were other people on the train who witnessed this horrific act & it may have been stopped sooner if a rider called 911,” the authority said.

HUNTSVILLE, Ala. (WFLA) — Police say Christina Nance, 29, crawled into a Huntsville Police Department van and was there several days before her body was found.
Deputy Chief Dewayne McCarver led a news conference Friday afternoon to explain what investigators found in watching over a week’s worth of surveillance footage, but Christina Nance’s family says the video they watched left them with more questions than answers.
“I was thinking everything was going to be clear,” Latausha Nance said. “There was going to be some type of clear indication of my sister being you know.. of how she died but there wasn’t. Not any like at all, everything was blurry. I don’t know if that was my sister.”
McCarver said Nance was first seen in the parking lot on Saturday, September 25, around 12:30 p.m. The footage showed Nance wandering in the parking area, lying in the bushes, sitting on the hood of a cruiser, and eventually climbing into the rear doors of the van, where she was later found dead.
McCarver said the van was originally commissioned as a prisoner transport vehicle, meaning the doors would not open from the inside.
The windows did open. Nance could be seen opening the windows several times in the footage.
The surveillance video shows movement in the van through Tuesday, September 28.
Nance’s body was found on Oct. 7 by a police officer who was walking by the van and saw her inside. When the officer found her body, it was because he spotted her shoes under the open window of the van.
The family plans to have a private autopsy conducted.
Police have said there was no sign of foul play in Nance’s death. The official cause of death will be ruled by the State Medical Examiner once additional studies, including toxicology, are complete.

Emani 22, an R&B singer known for songs including "Feelings" and "Close," has died. She was 22.
Emani died on Monday following a "tragic accident," her manager, Fred Green, tells PEOPLE. Green says the incident happened on Saturday morning.
"It is with heavy hearts that the family of Emani has confirmed her passing," a statement provided to PEOPLE reads. "They would like to share that although she fought courageously and the medical team went above and beyond doing everything in their power to aid in her recovery, on Monday, October 11th, Emani succumbed to the injuries she sustained after a tragic accident. At this time, Emani's family is asking for privacy to mourn and honor her life and memories."
Record producer J Maine also confirmed the singer's death in a separate statement to PEOPLE. "Emani 22 was a wonderful individual that literally brightened up any room she was in," he said.
"I worked on music with her, and helped her put together her last project which was 'The Color Red.' The way we worked together was effortless, we just understood each other," he continued. "It hurts so bad to know that the last time I saw her was the last time I'd ever see her again."
Added J Maine: "I considered her to be like a little sister to me. She will be missed and never forgotten, and I'll always think about the great times we had hanging out."
The cause of death for Emani 22 — whose real name was Emani Johnson — has not immediately been revealed.
After news of Emani 22's death was initially made public, rapper Bhad Bhabie paid tribute to the late star with a set of social media posts.
First sharing a photograph of the two on Instagram, Bhad Bhabie, 18, wrote alongside the post, "I don't even know what to say…This doesn't even feel real."
