After five years of marriage Tom Cruise and Katie Holmes are calling it quits according to PEOPLE.
"This is a personal and private matter for Katie and her family," says Holmes's attorney Jonathan Wolfe. "Katie's primary concern remains, as it always has been, her daughter's best interest."
The soon-to-be-ex couple are parents to 6-year-old daughter, Suri.
Cruise, 49, and Holmes, 33, were married in an Italian castle in November 2006.
This was the first marriage for Holmes and the third for Cruise, who had previously been married to Nicole Kidman and Mimi Rogers
**UPDATE**
Looks like the straw that broke the camel's back in Katie and Tom's marriage was her fear that he would raise their daughter in the Church of Scientology according to TMZ. Katie is filing for sole legal custody because she does not want Tom to control decisions relating to religion.
TMZ is also reporting that despite the fact their marriage certificate was filed in California, Katie filed divorce papers in New York because it would be easier to win sole custody of their 6-year old daughter Suri there.

Bulgarian sprinter Georgi Kirilov Georgiev suffered a freakishly horrific leg injury during a race at the European Championships in Helsinki earlier this week.
Georgiev was competing in the 100 meter dash when midway through the race he began to limp before his right leg completely gives way and bends backwards. The injury was gruesome to watch.
Georgiev suffered a broken leg and dislocated knee according to the Daily Mail.

Snoop Dogg was popped this morning in Norway for carrying his favorite illegal plant. TMZ is reporting that Snoop was detained at customs at the Kjevic Airport in Kristiansand, where officials discovered 8 grams of weed.
In Norway anything less than 15 grams is punishable by a fine of 12,000 Norwegian Krone. That converts to roughly $1,980.13.
The New York Daily News reports that Snoop was also carrying more cash than is allowed and was fined for that also. In total Snoop had to shell out $8,600 for the violations.
Snoop is in the country to perform at the Hove Festival.

The Supreme Court upheld President Obama’s historic health care law Thursday - a defining moment in the 2012 race for the White House.
The stunning ruling - unexpected from a Court led by conservatives - was a huge victory for Obama, who staked much of his term on passing the national plan.
The major debate came over the individual mandate, which requires Americans to have health care or face a financial penalty.
The buy-in by most Americans would raise enough money to pay for the entire plan.
The Supreme Court ruled that it was constitutional - with Chief Justice John Roberts joining the 5-4 majority opinion.
Roberts, who was appointed by GOP President George W. Bush, cast the tiebreaking vote that allowed the law to surive.
He and the more traditionally liberal justices ruled that the controversial mandate could exist as a tax - which kept the bill intact.
Republicans opposed Obamacare from the outset and their presidential candidate Mitt Romney has pledged to repeal all of it on his first day in office if elected.
Obama was expected to address the Court’s ruling later Thursday, but his campaign sent out a fundraising email before the Justices ruled - asking supporters “to have [the President’s] back.”
The decision - the most important Supreme Court ruling since it awarded the 2000 presidential election to Bush - has been awaited for months and has become the center of the political world.
Press, protesters, policy wonks s and passing tourists jammed the steps and sidewalks outside the high court, pouring over onto the opposite sidewalk in front of the Capitol on a hot and humid weekday morning.
Dueling protestors pounded drums, waved flags and held signs ranging from "Don't hijack my healthcare” to "ObamaScare."
Police sirens chirped as officers struggled to keep gawkers on the sidewalk and out of First St. NE.
