After delays due to dental surgery and a courthouse fire, Lil Wayne will finally be sentenced and begin his one-year prison term stemming from a 2007 gun arrest on Monday (March 8). But, according to a prominent New York lawyer, barring any major disciplinary issues, the MC (born Dwayne Michael Carter) should be free in eight months.

"In New York, any sentencing to a year or less requires the time to be done in a county facility, and based on good-time credit in that kind of facility [such as Rikers Island, where Wayne is expected to be imprisoned], people only usually do two-thirds of their time," said Scott Leemon, a New York attorney who is not involved in the Wayne case but who has represented a number of other rappers in legal issues, including 50 Cent, Tony Yayo and Remy Ma. "Basically, all he needs to do is stay out of trouble, and it's an automatic thing. But if you're having disciplinary problems, they can take away good time."

Leemon said it takes a "substantial" violation for that good time to be revoked, such as getting into a major fight or having large amounts of contraband. Wayne's lawyer did not return requests for comment at press time.

Though Leemon did not know what kind of sentencing guidelines Judge Charles H Solomon would impose on Weezy, he said that if the rapper did good time and earned an early release, he could walk out of Rikers Island in early October without having to see a parole board. "The only question is if he will be sentenced to some post-release supervision, which depends on what the judge gives him."

Wayne was originally scheduled to be sentenced last month, but his attorney requested a delay due to dental surgery the rapper required. Judge Solomon agreed to the last-minute request and rescheduled the proceedings for March 2. The New Orleans MC has had more time than he requested to recover from a reported eight root canals in one day. "I don't want this to get pushed back anymore," Judge Solomon told the rapper's lawyer during his last appearance. "This is the last adjournment." Then, just hours before he was set to appear before Judge Charles H. Solomon on Tuesday, a fire broke out at the Manhattan Criminal Court Building. At the first sign of smoke, the building was evacuated and all appearances were postponed. The next day, Weezy's court date was once again rescheduled.

Wayne is set to appear before Solomon on Monday and plead guilty to attempted gun possession. He's then expected to turn himself in immediately to begin his prison term.

The rapper reached a deal with prosecutors in November to plead out to a lesser sentence, and in return he is expected to be released from prison as early as October of this year. In 2007, Lil Wayne was arrested for gun possession following his first headlining performance in Manhattan at the Beacon Theatre. A gun-possession charge in New York could have landed the Cash Money superstar behind bars for up to 15 years if he was convicted.

Wayne has been working feverishly in recent weeks to complete a number of videos and songs to stay relevant during his physical absence. That pace he's gotten accustomed to, however, will come to a screeching halt, according to a New York corrections officer who spoke to MTV News.

Once the rapper lands behind bars, his days will be as regimented as his recording schedule — but will be maintained by the prison warden, not Lil Wayne. "He'll be housed with inmates who are classified in his category, and he'll be able to be a regular inmate," the guard said. "He'll be able to watch television, go into the day room and congregate with people of his classification.

Ke$ha’s hot start hasn’t let up yet: “TiK ToK” stayed firmly planted at Number One on the Billboard Hot 100 for the eighth straight week. The Animal singer is now the first female artist since 1977 to have her debut single spend that much time consecutively atop the Hot 100, Reuters reports, with Debby Boone’s “You Light Up My Life” the last single to accomplish it. Boone’s debut single spent 10 weeks at Number One, so “TiK ToK” needs another three weeks at the top before another record is shattered.

It seems like only two tracks stand a chance of unseating “TiK ToK,” starting with Lady Antebellum’s “Need You Know,” which jumped from Number Eight to Number Three, marking the first time a country music band has made the Top Three since Lonestar’s “Amazed” in 2000. The other contender: The all-star 25th anniversary recording of “We Are the World,” which benefits Haiti relief efforts. That track, featuring Lil Wayne, Kanye West, the Beach Boys’ Brian Wilson and dozens more, made it's debut last night during NBC’s broadcast of the Winter Olympics’ Opening Ceremony.

Ke$ha is also responsible for the biggest digital single sales week by a female artist in history as “TiK ToK” was downloaded 610,000 times in the seven days following Christmas. The record for most digital sales in one week is currently held by Flo Rida’s “Right Round,” which features Ke$ha on the hook.

Animal’s Number One debut on the Billboard 200 initiated Ke$ha into a small club of female artists to have their first album top the charts. She also (possibly) defaced the historic Hollywood sign (though Ke$ha told Rolling Stone yesterday that she’s legally not allowed to discuss the prank).

Lil Wayne underwent oral surgery yesterday to repair substantial tooth decay for what can only be described as "Yuck Mouth"

According to a report on USMagazine the New Orleans MC had to sit in a dentist's chair for eight straight hours as he had his grill worked on, underwent several tooth implants and "had the few real teeth he had left repaired,

The eight root canals in one sitting has to be some kind of record. WebMD reports that one root canal can take up to two visits to complete.

Lil Wayne will now recuperate and prepare to be sentenced to a year in prison on March 2.

Audio After The Jump Brittany Murphy's mom and husband desperately tried to revive the actress the morning she died, according to a 911 call released Friday (January 8) to The Associated Press. "My daughter's passed out," Sharon Murphy tells the 911 operator, who proceeds to relay CPR instructions to the distraught mom. Brittany Murphy's husband, Simon Monjack, can be heard in the background trying to revive the actress and following Sharon's instructions via the dispatcher. During the eight-minute call, Sharon is heard wailing and screaming, "Brittany, please come back!" She told the operator that Murphy had been ill earlier and had vomited. An initial autopsy was performed on Murphy in Los Angeles on December 21, the day after she was found unconscious in her Hollywood Hills home and later pronounced dead at the hospital. In an e-mail to MTV News, representatives for the Los Angeles County Coroner's office disclosed the initial results. "The Los Angeles County Department of Coroner conducted an autopsy on the body of Brittany Anne Murphy-Monjack, age 32, on December 21, 2009," the statement reads. "The cause of death has been DEFERRED pending the receipt of additional toxicological tests and tissue studies that have been ordered by the deputy medical examiner. "There will be no final ruling as to the cause and manner of death until all of the requested test results have been received and reviewed in context with the autopsy findings. It is anticipated that this process may take approximately 4 to 6 weeks or more. Anatomical findings show no evidence of trauma to the body." A major porn company wants to be in the Carrie Prejean business Video After The Jump NY Daily News Reports Carrie Prejean's pageant tiara may be thoroughly tarnished, but one media company still wants to make her a star - a porn star. Vivid Entertainment, a giant in the world of porn production, has received a copy of Prejean's solo sex tape and is eager to release it to the public, TMZ.com reports. The company says it received the tape legally, but would prefer Prejean's go-ahead before distributing it, according to TMZ. It doesn't seem likely the former Miss California USA would approve such a venture, but with new reports claiming seven other sex tapes of Prejean have surfaced, the risk of a tape getting leaked has multiplied. RadarOnline.com reported the discovery of the new tapes Friday, along with 30 more nude photos. The videos and images are said to all be solo performances like the first tape. The exploding sex tape scandal surrounding Prejean began when a lawyer for Miss California USA pageant officials, whom Prejean had sued alleging religious discrimination, produced a copy of the hard core sex tape during settlement negotiations. After being shown the video, Prejean promptly dropped her $1M demands and bolted from the table empty-handed. She later owned up to making the salacious home movie as a teen, calling it "the biggest mistake of my life." Chicago Sun Times Reports Officers responding to a report of hysterical screams found an 8-year-old girl partially clothed and four boys, barely in their teens, running from an empty shed. The boys, ages 9 to 14, face charges ranging from sexual assault to kidnapping, police said Thursday. Authorities in Phoenix say it's one of the most horrific cases they've ever seen. Investigators said the boys lured the girl to an empty shed on July 16 under the pretense of offering her gum. The boys then held the girl down while they took turns raping her, police said. "She was brutally sexually assaulted for a period of about 10 to 15 minutes," police Sgt. Andy Hill said. The 14-year-old boy was charged Wednesday as an adult with two counts of sexual assault and kidnapping, the Maricopa County Attorney's Office said. He appeared in court Thursday and was being held without bond. He does not yet have a defense lawyer. The other boys -- ages 9, 10, and 13 -- were charged as juveniles with sexual assault. The 10- and 13-year-old boys also were charged with kidnapping, the office said Thursday. "This is a deeply disturbing case that has gripped our community," Maricopa County Attorney Andrew Thomas said. "Our office will seek justice for the young victim in this heartrending situation." The outrage over the allegations has intensified when police said the girl's parents criticized her after the attack and blamed her for bringing shame on the family. "The father told the case worker and an officer in her presence that he didn't want her back. He said 'Take her, I don't want her,"' Hill said. Hill cited the family's background as the reason the family shunned the girl. All five children are refugees from the West African nation of Liberia. In some parts of Africa, women often are blamed for being raped for enticing men or simply being in the wrong place at the wrong time. Girls who are raped often are shunned by their families. "It's a shame-based culture, so the crime is not as important as protecting the family name and the name of the community," said Tony Weedor, a Liberian refugee in Littleton, Colo., and co-founder of the CenterPoint International Foundation, which helps Liberians resettle in the United States. "I just feel so sorry for this little girl," he said. "Some of these people will not care about the trauma she's going through -- they're more concerned about the shame she brought on the family." In recent years, Liberia has made efforts to combat rape under the leadership of President Ellen Johnson Sirleaf, who has sought to dispel the stigma associated with sexual assault by publicly acknowledging that she was herself the victim of attempted rape during the country's civil war. The girl's healing process will be particularly difficult, said Paul Penzone of Childhelp, which aids young victims of crime. Authorities said the victim was in the care of Child Protective Services. "These four boys used what was a ploy to entice her to a place where they could take advantage of her almost like a pack of wolves," he said. "And what's so disturbing beyond the initial crime is the fact that a child needs to have somewhere to feel safe, and you would think that would be in a home with her own family," not in state custody, Penzone said.
