The father of the 9-year-old boy who was “trampled and catastrophically injured” at the Astroworld Festival in Houston has filed a negligence lawsuit against concert promoter Live Nation and Travis Scott.

Ezra Blount was on his dad Treston Blount’s shoulders at the Friday night festival when the two became trapped in the deadly crowd surge that started soon after Travis Scott took the stage at 9 p.m., his grandparents confirm.

“He kept screaming, ‘I can’t breathe.’ But everyone was pushing. It was so tight with no exits. His dad couldn’t breathe at all and passed out. We don’t really know what happened to Ezra after that,” grandmother Tericia Blount tells Rolling Stone. The family later found Ezra at a nearby hospital listed as a John Doe, and his father raced to his side, she says.

“During the concert, (Ezra), a 9-year-old minor child, was suddenly forced to watch in terror as several concertgoers were injured and killed as a result of the crowd surge. He himself was kicked, stepped on, and trampled, and nearly crushed to death,” the new lawsuit obtained by Rolling Stone claims. “He is currently in an induced coma on life support and has severe liver, kidney and brain damage. To his young, growing body, these injuries will have life-long effects, impairing his quality of life and ability to grow and thrive.”

The lawsuit is seeking a least $1 million in damages.

“This young child and his family will face life-altering trauma from this day forward, a reality that nobody expects when they buy concert tickets. Concerts and music festivals such as this are meant to be a safe place for people of all ages to enjoy music in a controlled environment. None of that was true about the Astroworld Festival,” Crump said in a statement Tuesday. “This little boy is currently fighting for his life, and his parents will never know the same child they entered Astroworld with.”

The new lawsuit – which also names promoter ScoreMore Management, its boss Sascha Stone Guttfreund and Scott’s label Cactus Jack Records as defendants – alleges the concert’s organizers failed to stop Scott’s performance for at least 40 minutes after city officials declared the scene a “mass casualty event.”

Nov 9 (Reuters) - The Oklahoma Supreme Court on Tuesday overturned a $465 million judgment against Johnson & Johnson (JNJ.N) in a lawsuit by the state alleging the drugmaker fueled the opioid epidemic through the deceptive marketing of painkillers.

The court on a 5-1 vote ruled that the state's public nuisance law does not extend to the manufacturing, marketing and sales of prescription opioids and that a trial judge went too far in holding the company liable under it.

"However grave the problem of opioid addition is in Oklahoma, public nuisance law does not provide a remedy for this harm," Justice James Winchester wrote.

The decision marked the latest setback for states and local governments pursuing lawsuits seeking to hold drug companies responsible for a drug abuse crisis the U.S. government says led to nearly 500,000 opioid overdose deaths over two decades.

The Oklahoma lawsuit was the first of the more than 3,000 cases against pharmaceutical manufacturers, drug distributors and pharmacies to go to trial.

NASHVILLE, Tenn. (AP) — The “heroic actions” of Tennessee pastor, Ezekiel Ndikumana, who tackled a man waving and pointing a gun during a service “saved a church from further violence,” police said.

No shots were fired during the incident Sunday at Nashville Light Mission Pentecostal Church, Metro Nashville Police said in a statement.

The 26-year-old man, identified as Dezire Baganda, pulled a gun as the pastor was praying with several people at the altar and told everyone to get up as he waved and pointed the gun at the congregation, police said. The pastor tackled the man and then several church members helped to disarm and hold him until officers arrived, the statement said.

Baganda is due in court on November 10. He faces 15 counts of aggravated assault. Additional charges are expected.

Bond is set at $375,000 for Baganda.

SyckCezzy teams up with FLM Label Mate Daniel Peter on Follow up single “Downfall”

Final Level Music Artists SyckCezzy and Daniel Peter are back with a new joint entitled “Downfall.” It’s a creative project that showcases Syckcezzy’s gritty poetic style and Daniel Peter’s silky vocals. The duo skillfully explains how a precipitous decline in status or wealth can happen when a hater speaks against you.The track was executively produced by two well-renowned veterans in the game-Ice-T and Hen Gee Garcia.

12353903456?profile=originalSyckCezzy was born in Missouri and raised in Richmond Virginia. Growing up on the southside of Richmond wasn't the ultimate dream for the young Syck but it was an experience. SyckCezzy prides himself as a diverse artist that works with all genres of music. Ten years from now, Syck will focus on different phases and styles that the hip-hop genre has gone through over the last few decades.

With a winning strategy in place, SyckCezzy plans to put his people in a position to win along with giving back to his people. His message to the youth is strong- "Please educate yourselves by paying attention, follow your dream, work hard, and don't accept "NO" as an answer." The rapper/entrepreneur has a new business venture and it is 'Syck Wine' to build generational wealth.

12353903469?profile=originalDaniel Peter isn’t new to the music scene. This young, driven American Pop artist was first discovered at the age of 13 when his music went viral. The Ames, Iowa native has been singing since the age of two and is a self-taught musician of four instruments. Daniel has been passed the torch from his father, who played the guitar for the band “Willy and The Rockets” and was an active singer in their home church. As for his mother, she is the backbone of his support and his number 1 fan. Family values are very important; therefore Daniel devotes himself to staying connected to his hometown. As a young kid, who was repeatedly a victim of bullying, Daniel has vowed and dedicated his music as well as his entire brand to making his fans smile and encouraging living life optimistically. With influences such as Michael Jackson, Usher, Chris Brown, Justin Timberlake, and Kehlani, Daniel Peter brings a touch of greatness to the realm of music. Through the intriguing blends of R & Bass, Pop, and Rhythmic fusion, this young phenomenon is the future sound of music.

The single is available on all digital music platforms including Spotify and Apple Music. Be sure to connect with SyckCezzy and Daniel Peter on all social media and digital music platforms.

[NEW MUSIC] TZIE - "TFROST" | @IGOBYTZIE

12353906097?profile=original

East Coast Super Producer TZIE releases debut EP “TFrost”

Washington, DC native TZIE born as Mark Evans Robinson Jr. wears many hats; Father, Husband, Super Producer, Singer, and Songwriter. The creative extraordinaire is signed with 4EYMG, which enables him to produce for an entire range of artists on the roster. The Suitland, MD Producer grew up in a blue-collar household where playing music wasn’t considered a career. Both parents worked for the DC Metropolitan Police Department with more than 25 years in service. As early as 2-years-old, TZIE knew that music chose him. He received a drum set for Christmas then the gift was born. “I became obsessed, taught myself. Once I felt I was great enough to start going out into the world with my gift, I grew a hunger for all the other instruments, then production, then audio production. Soon enough, I fell in love with everything music. Period,” says TZIE. If you have listened to Jade Alexis’ “Toxic” or Torazz” - “Baby I Gotta”, you would know that TZIE’s multi-talented abilities separate him from the rest. His creative sound is guaranteed to put him on top and keep him there.

12353906493?profile=original

“I have no limits to my artistry now. I can go whenever and however I please and have the confidence that it will sound as good as I want it to.” - TZIE

Most people recognize Kanye as a rapper, but TZIE recognizes the true artistry in Kanye —the Producer— which fuels the drive and pumps the inspiration of his music production mindset. “Kanye taught me the keys to success through our similar stories growing up. He taught me consistency, how to create outside of my comfort zone, work ethic, and most of all, how to inspire myself daily. I inspire myself now every day because of how Kanye molded my mindset to be,” he says. TZIE has aspirations of working with Ye, Travis Scott, Baby Keem, Snoop Dogg, Doja Cat, Tyler the Creator - to name a few. He has been steadily building his production arsenal with over 2,000 finished tracks and is ready to show the world- he is worthy of being highly recognized as the most slept-on Producer.

Truthfully, TZIE is bringing a fresh new style of Hip-Hop to the industry. This impressive young up-and-coming Producer has completed his new EP “TFrost” which features a few of his labelmates like CharleeLynai and Lil Leek. The 7-track storyline is about TZIE’s alter ego, who is a bad villain but not by choice. The EP depicts events that took place in his life that caused him to be a cold-hearted individual that plays no games. In “TFROST”, TZIE will unapologetically take you on a journey. You will learn who he is, his mindset, his everyday life, and his thought patterns. “TFrost” is available on all digital music platforms like Spotify, Apple Music, and Google Play. Be sure to connect with TZIE on social media and all digital music platforms.

LONDON, Ky. (AP) — A 16-year-old girl held captive by a 61-year-old man was rescued on an interstate highway in Kentucky after another driver noticed her using a distress signal with her hand that was made popular on TikTok, law enforcement officials said.

The girl’s parents reported their daughter missing from Asheville, North Carolina, last week. Two days later, her hand-signal — and the alert driver — enabled sheriff’s deputies in Kentucky to stop the car and arrest James Herbert Brick of Cherokee, North Carolina, on charges of unlawful imprisonment and possession of material showing a sexual performance by a minor, Deputy Gilbert Acciardo said.

The girl and the driver were acquainted, and she initially went with the man willingly, but at some point got scared, Acciardo, the spokesman for the Laurel County Sheriff’s Office, told The Lexington Herald-Leader. The man had taken her to Ohio to visit his relatives, and left with her after they realized she had been reported missing, a sheriff’s statement said.

The other driver called 911 from Interstate 75 in Laurel County, Kentucky, on Thursday to report that a girl in a silver Toyota car was making distress hand signals that he recognized from TikTok as a plea for help from domestic violence. The signal is to raise your hand, showing your palm with your thumb extended, and then tuck your thumb into your palm and lower your fingers over it, as if to trap the thumb.

Officials say the driver continued following the man and the girl, updating a dispatcher, until deputies were able to stop the Toyota and rescue the girl.

The sheriff’s statement says a cellphone found in the man’s possession had images that allegedly “portrayed a juvenile female in a sexual manner.” Brick was booked into the Laurel County correctional center on a $10,000 bond pending a court hearing on Tuesday.

KENOSHA, Wis. (AP) — A protester and volunteer medic wounded on the streets of Kenosha by Kyle Rittenhouse testified Monday that he was pointing his own gun at the rifle-toting Rittenhouse when the young man shot him.

Gaige Grosskreutz, the third & final man gunned down by Rittenhouse during a night of turbulent racial-justice protests in the summer of 2020, took the stand at Rittenhouse’s murder trial & recounted how he drew his own pistol to try to stop the bloodshed.

“I thought the defendant was an active shooter,” the 27-year-old Grosskreutz said. Asked what was going through his mind as he got closer to the 17-year-old Rittenhouse, he said, “That I was going to die.”

Rittenhouse shot Grosskreutz in the arm, tearing away much of his bicep — or “vaporized” it, as the witness put it.

Under questioning from the prosecution, Grosskreutz said he had his hands raised as he closed in on Rittenhouse. Prosecutor Thomas Binger asked Grosskreutz why he didn’t shoot first.

“That’s not the kind of person that I am. That’s not why I was out there,” he said. “It’s not who I am. And definitely not somebody I would want to become.”

But during cross-examination, Rittenhouse defense attorney Corey Chirafisi asked: “It wasn’t until you pointed your gun at him, advanced on him … that he fired, right?”

“Correct,” Grosskreutz replied.

Rittenhouse, now 18, is on trial on charges of killing two men & wounding Grosskreutz. The one-time police youth cadet from Antioch, Illinois, had gone to Kenosha with an AR-style semi-automatic rifle & a medical kit in what he said was an effort to safeguard property from the damaging demonstrations that broke out over the shooting of Jacob Blake, a Black man, by a white Kenosha police officer.

Prosecutors have portrayed Rittenhouse as the instigator of the bloodshed. His lawyers have argued that he acted in self-defense. He could get life in prison if convicted of the most serious charges against him.

Grosskreutz said he had gone to the protest in Kenosha to serve as a volunteer medic, wearing a hat that said “paramedic” & carrying medical supplies, in addition to a loaded pistol.

Grosskreutz said his permit to carry a concealed weapon had expired and he did not have a valid permit that night.

“I believe in the Second Amendment. I’m for people’s right to carry and bear arms,” he said, explaining why he was armed. “And that night was no different than any other day. It’s keys, phone, wallet, gun.”

He said he went into action after seeing Rittenhouse kill a man just feet away — the second person Rittenhouse fatally shot that night.

On cross-examination, Chirafisi sought to portray Grosskreutz as dishonest in his description of the moments right before he was shot, with Chirafisi asserting that Grosskreutz was chasing Rittenhouse with his gun out.

Grosskreutz denied he was chasing Rittenhouse & said that he was concerned about Rittenhouse’s safety after seeing others chase him & someone try to kick him.

Chirafisi also pointed to Grosskreutz’s lawsuit against the city of Kenosha, in which he alleges police enabled the violence by allowing an armed militia to have the run of the streets during the demonstration.

“If Mr. Rittenhouse is convicted, your chance of getting 10 million bucks is better, right?” Chirafisi said.

At the defense table, Rittenhouse kept his eyes on Grosskreutz as he testified, taking detailed notes when the witness spoke about the moment he was shot.

One juror nodded her head in agreement when the judge instructed the jury to disregard Grosskreutz’s referring to Rittenhouse’s fatal shooting of another protester as a “murder. ”

Travis Scott is stepping up to help the families of those who died at Astroworld Fest -- offering to pay funeral costs & extending even more help for those affected.

Travis just announced he'll be fully covering any and all funeral costs that might come about for the families of the 8 people who passed away at the concert this weekend.

We're told this is going to be coming from Travis' own pocket & that there'll be no questions asked as it pertains to those 8 individuals & what their families might need to properly lay their loved ones to rest.

There's more ... Travis is also going to be partnering with BetterHelp -- a network of mental health professionals -- to offer mental health services, for free, to anyone who attended Astroworld Fest who may need to talk through their trauma.

The BetterHelp resources will amount to one-on-one virtual therapy sessions with trained, licensed professionals working with the org. On top of this, BetterHelp will also team up with the National Alliance of Mental Illness for people who may need more help than just virtual & there's going be a hotline set up to that end, which Travis is also overseeing.

Unclear how exactly Trav & co. will vet claims for the service, but we imagine it's going to be a system that vets people ... to make sure they were, in fact, in attendance Friday.

Of course, that may mean there are thousands of people who take him up on it -- as there were countless folks in the crowd that night who might've been affected ... and if that happens, it probably won't be a cheap endeavor to ensure all those folks are cared for.

It's certainly a nice gesture & just one step of Travis trying to do right by his fans. Obviously, there's a lot more that may have to be done -- but at least he's starting here.

As we reported ... in addition to those who died, dozens more were injured to varying degrees & hospitalized & some of those people have already started to file lawsuits against Travis & Live Nation.

Travis Scott & Live Nation continue to have lawsuits pile up against them, with one Houston injury attorney just submitting 7 in the last hour for various clients & famed attorney Ben Crump is also repping victims.

The docs, obtained by TMZ, are mostly identical -- filed by the Houston law firm of Roberts Markland LLP -- but switch out the petitioner name each time. Each lawsuit claims both Travis & Live Nation failed to provide adequate security & a security plan to protect attendees & conditions at Astroworld Festival "caused several stampedes & a crowd compression" that led to the 8 deaths & hundreds of injuries.

The attorney behind these lawsuits -- Sean Roberts, doesn't list specific injuries for his clients, but says they were "seriously and permanently injured."

In the docs, Travis & LN are accused of failing to warn fans of safety risks & failing to provide appropriate medical staff at the event.

Of course, there will certainly be more lawsuits filed by concertgoers, and wrongful death litigation is expected as well. Attorney Ben Crump -- who repped the family of George Floyd -- has also stated he is representing Astroworld attendees.

Roberts is suing for negligence & wants an unspecified amount in damages for each of his clients.

Ireland Baldwin compared the outrage over Travis Scott’s deadly Astroworld show to the reaction her famous father got following his fatal “Rust” shooting.

In an Instagram Stories tirade, the 26-year-old model defended Scott, blaming criticism of him on “misinformation” and “twisted cancel culture bulls–t” — before later admitting that he “incites the rage” at his often violent shows.

“First, you were armory/stunt coordination pros when it came to the horrific tragedy involving my dad,” Baldwin wrote dad Alec Baldwin, who last month accidentally shot dead cinematographer Halyna Hutchins on the set of his Western movie “Rust.”

“And now Travis Scott is demonic because he ALLOWED people to die at his show?” she continued, referring to reports that Scott continued his show despite fans’ desperate pleas to stop amid the crush of people.

“But it’s not Travis Scott’s fault,” Ireland insisted in the rant saved by the Daily Mail before it was deleted.

She said “any musician would validate that you can’t see or hear anyone up there. Especially when wearing in-ear monitors.”

“C’mon people…do a little research before you go spewing cancel culture bulls–t,” she wrote in a caption over an image of an unmade bed.

“People lost their children at this show and you’ve got say is that Travis Scott’s music is demonic and be [sic] belongs in prison? Jesus,” she wrote.

She followed up with another post saying, “Maybe we should stick to what we actually know, stop making assumptions, stop spreading misinformation, and educate ourselves on things we know nothing about.”

“I am in no way defending Travis Scott because honestly, I don’t know him or care personally,” she said, contradicting her earlier post.

“I’ve been to two of his shows. I watched people get carried out on stretchers with head injuries and from ODs,” she wrote.

“He incites the rage. No doubt about that,” she added of the embattled rapper. “But I refuse to fall into this twisted cancel culture bulls–t when it’s coming from people who have no idea how anything works.”

Former Mets relief pitcher Pedro Feliciano died in his sleep on Sunday night, according to ESPN’s Eduardo Perez.

Feliciano, 45, had a nine-year MLB career, all with the Mets. The left-hander was a native of Rio Pedras, Puerto Rico. He was drafted by the Dodgers in 1995 and floated through systems in Los Angeles, Cincinnati, New York and Japan before landing with the Mets for a third time in 2006.

After making the team out of spring training, Feliciano became a key lefty specialist for the team, leading the majors in games pitched in 2008 with 86. He ranks second in franchise history in games pitched with 459, behind John Franco.

Though Feliciano signed with the Yankees ahead of the 2011 season, shoulder injuries ended his year before it began. He also failed to play for the Yankees in 2012, then re-signed with the Mets in 2013 for what would ultimately be his last big-league season.

The cause of death is unknown as of now. Feliciano was jet-skiing with his family on Sunday, according to Perez.

In 2013, Feliciano said he had a small “hole” in the exterior of his heart, but he was told the situation was not life-threatening.
