The family of Elijah McClain is going after the city of Aurora and 13 of its police officers, claiming they're all to blame for his 2019 death.

McClain's parents just filed the lawsuit in Colorado claiming the city, the cops, a paramedic, and a doctor should be held responsible for the August 24, 2019 fatal incident based on their "needless use of excessive force and torture."

According to new legal docs, obtained by TMZ, the family says Elijah was listening to music on a short walk home from the corner store "when Aurora police officers grabbed, tackled, and assaulted him."

In the lawsuit, they claim officers "continued to brutalize Elijah for nearly eighteen minutes—approximately fifteen minutes of which he was handcuffed." They also allege the force the officers used against Elijah included "compressing his neck and the blood flow to his brain with two consecutive carotid holds, cranking his left shoulder with an armbar hammerlock that caused it to repeatedly pop."

Describing the arrest even further ... the family claims Elijah vomited after they slammed him to the ground. According to the docs, another officer allegedly "jammed his knee into Elijah's arm for minutes on end" with the sole purpose of inflicting pain and eventually separating Elijah's biceps and triceps muscles.

Then the paramedics arrived, but the family claims things only got worse. In the suit, they claim an EMT "involuntarily injected him with a massive dose of ketamine" even though he was not experiencing any medical condition that would have required ketamine ... a powerful sedative.

Minutes after they injected him with the sedative, Elijah stopped breathing, had no pulse and never regained consciousness before dying a few days later.

As we reported ... Aurora PD officers stopped Elijah while responding to a call about a suspicious person walking the streets wearing a ski mask and waving his arms. His family had previously said he commonly wore the mask to keep warm.

Body-camera footage of the incident shows Elijah telling the cops, "Let go of me. I am an introvert. Please respect the boundaries that I am speaking." His final words -- documented at the beginning of the lawsuit from start to finish -- popped up on social media posts demanding justice.

Gov. Jared Polis had said back in June the case would be reopened with a special prosecutor appointed to the case. Three cops were fired last month and one other resigned after a photo surfaced mocking Elijah's death. Three of those four cops are named in the lawsuit.

President Trump on Tuesday again advocated for college football in the fall, falsely claiming that coronavirus "just attacks old people" and that young, healthy college athletes are "not going to have a problem."

"People don't realize it's a tiny percentage of people that, that gets sick," he said in an interview with 'Outkick' on Fox sports Radio. "It just attacks, old people, especially old people with bad heart, diabetes, or some kind of a physical problem."

Several Division I colleges and athletic conferences have canceled fall sports and football amid speculation that the Big 10 and some of the country's most prominent athletic conferences could cancel the fall football season over concerns about the coronavirus and a rare heart condition that could be associated with COVID-19.

Eduardo Rodriguez, a 27-year-old star pitcher for the Boston Red Sox, was recently diagnosed with myocarditis, heart inflammation that team doctors believe stemmed from his COVID-19 infection, and will not play for the rest of the Major League Baseball season.

While older Americans are considered more vulnerable to COVID-19 and the mortality rates for younger people remains low, hospitals have seen a growing number of younger patients admitted with severe symptoms throughout the summer as the virus has spread across the country.

Public health experts and medical officials have also warned about the potential for long-term health effects from COVID-19 given how little is known about the novel coronavirus. And, officials are concerned that young people who do become infected but don’t exhibit symptoms are spreading the virus to other, more vulnerable individuals.

WILSON, N.C. — A Wilson man was in custody Monday night, about 24 hours after police said he shot and killed a 5-year-old boy.

Darius N. Sessoms, 25, was apprehended in Goldsboro by members of the U.S. Marshals Service Carolinas Regional Fugitive Task Force, Goldsboro police and the Wayne County Sheriff's Office. He was charged with first-degree murder and was being held without bond in the Wilson County jail.

During a brief court hearing Tuesday morning, he said he planned to hire his own lawyer and rejected an attempt to have a judge appoint an attorney for him.

Police were called to a shooting in a neighborhood in the 5100 block of Archers Road just after 5:30 p.m. Sunday.

Family members said Cannon Hinnant was playing outside his father's house when he was shot in the head. The boy's two sisters, ages 8 and 7, saw their brother get shot, according to Cannon's mother.

Cannon was taken to Wilson Medical Center, where he died.

No details about a possible motive for the shooting have been released, but police said the shooting wasn't random.

Sessoms lives next door to Cannon's father, and a neighbor said that the two men had dinner together Saturday night and that Sessoms was at his neighbor's home earlier Sunday.

Doris Lybrand, who witnessed the shooting, said Sessoms ran up to Cannon, put the gun near his head and fired before running back to his own house.

"My first reaction was he's playing with the kids," Lybrand said. "For a second, I thought, 'That couldn't happen.' People don't run across the street and kill kids."

She said she realized the gun was real when she saw Cannon's father's reaction to the shooting, and she quickly went inside her home, locked the door and tried to call 911.

"You don't expect to see somebody shoot someone," she said.

Cannon's grandmother said the family was happy to know that Sessoms had been arrested, but they're devastated by the young boy's senseless killing.

Mike Tyson vs. Roy Jones Jr. has officially been moved to Nov. 28 -- with another former world champ fighting on the undercard, TMZ Sports has learned.

The fight was originally set to go down on Sept. 12 -- but now, we're told the new date is locked in.

So, why the change to Thanksgiving weekend?

"Changing the date to November 28th will give more people the opportunity to see the biggest comeback in boxing history," Tyson said in a statement.


"This temporary inconvenience will last longer than Roy Jones Jr. He better be ready, I'm coming full force."


The company behind the event, Triller, says the move was made to accommodate a larger audience than originally anticipated.


"Given the enormous interest, the holiday weekend will make this historic battle an even bigger viewing event," the company says ... "marking the first live Pay-Per-View event brought to the world by Triller as the first of the 'Triller Battles' series."


Triller is also officially announcing the addition of new undercard fights ... including Badou Jack vs. Blake McKernan.


Badou Jack is one of Floyd Mayweather's fighters -- he's 22-3-3 and a former world champ in 2 weight classes.

Jack says he's donating a portion of his fight check to the Badou Jack Foundation to "continue to give kids across the globe a fighting chance in life."


Also added ... Viddal Riley vs. Rashad Coulter.


Vidal is pretty talented British fighter who's also famous for training up KSI for his fight with Logan Paul.


Coulter is a former MMA fighter who competed in the UFC until 2018.


And, of course, Jake Paul is still set to fight ex-NBA star Nate Robinson as the lead-in to the main event.


We're told the Tyson vs. Jones fight -- the first event in a series under Mike's "Legends Only League" -- will be sanctioned and scored by a recognized sanctioning body.


Oh, and the winner will get a specially-commissioned belt!!!

The guy accused of shooting at Lil Wayne's bus in 2015 has copped a pretty sweet plea deal ... but we're told he's not getting out of jail just yet.

Jimmy Winfrey has pled guilty to 2 counts of violation of the Street Gang Terrorism and Prevention Act ... this according to new legal docs obtained by TMZ. As part of the deal, prosecutors have dropped a slew of other charges -- 4 counts of violation of the RICO Act, 6 other counts of violation of the Street Gang Terrorism and Prevention Act, 12 counts of aggravated assault, 2 counts of criminal damage to property in the first degree and 1 count of possession of a firearm during the commission of a felony.

He was sentenced to 7 years in prison ... a much lighter sentence than what he got in 2015, when the judge threw the book at him with a 20-year sentence. The Georgia Supreme Court overturned his conviction in 2018 and so the case went back to square 1.

And, get this ... Winfrey got credit for time served and set to be released, but Winfrey's lawyer, Steve Sadow, tells TMZ ... the reason his client hasn't been released involves an unrelated outstanding warrants case. Sadow wants to be clear ... Winfrey entered a special kind of guilty plea where his client maintains his innocence, despite pleading guilty.

As part of the sentence, he's also gotta pay $100k in restitution to Alvin Lewis, the bus driver.

TMZ broke the story ... Alvin accused Birdman and Young Thug of striking secret deals with prosecutors in the case. Alvin had said he found it unusual Cobb County prosecutors described Birdman and YT as co-conspirators in the alleged shooter's indictment but did NOT bring charges against them.

Alvin made no bones about it ... he claimed there was overwhelming evidence of complicity among Winfrey, Birdman and Young Thug ... evidence that includes phone records, recorded confessions, and promises of payment.

Sources close to Birdman had told us the rapper denied any involvement in the case. Young Thug has never commented publicly on the incident.

In the 2015 shooting, Alvin claims he suffered spinal cord, rotator cuff and psychological injuries when Weezy's bus was shot up in Atlanta.

The excerpts of the videos are from the time immediately before, during and after the detainment and death of Floyd, who died in police custody on Memorial Day. In addition to the footage from Lane's body camera, video from former officer J Alexander Kueng was also released, but not shown here.

Judge Peter Cahill on Friday ruled in favor of the media coalition challenging a court order that prohibited the public from viewing the body camera video, which was submitted as evidence in Lane's motion to dismiss the charges against him.

Four officers face charges in the death of Floyd.

Derek Chauvin, who pressed his knee into Floyd's neck for nearly nine minutes, is charged with second-degree murder and second-degree manslaughter.

Thomas Lane and J. Alexander Kueng, who helped restrain Floyd, and Tou Thao, who stood near the others, are charged with aiding and abetting second-degree murder and aiding and abetting second-degree manslaughter.

Using marijuana during pregnancy is linked to 50% greater chance of having a child with autism, according to the largest study of its kind.

The study, published in Nature Medicine on Monday, reviewed data from more than a half a million women in Ontario, Canada — about 3,000 of whom reported using cannabis during pregnancy and about 2,200 of whom reported using cannabis and no other substances.

They found that 2.2% of women who used marijuana had children with autism compared to 1.4% of women who did not use cannabis but had similar characteristics, like age, education, and socio-economic status.

The study authors say that while their study was imperfect, the results are worrying, especially given that cannabis was illegal in Canada during the period (2007 to 2012) the data was collected.

"The universal recommendation is no alcohol use in pregnancy and I think a similar recommendation should be made for no cannabis use in pregnancy," co-author Dr. Daniel Corsi, an epidemiologist at The Ottawa Hospital and BORN Ontario, told the Guardian.

The findings follow the same team's research showing marijuana use during pregnancy increases the risk of other complications like preterm birth.

One study from 2018 in Colorado found that women who reported using cannabis while pregnant had a 50% chance of lower birth weights.

Other research has shown that marijuana use during pregnancy may affect a child's brain development. It appears to be linked to lower IQs, attention problems, and more impulsiveness.

Such research led to the US Food and Drug Administration issuing a statement in 2019 about the dangers of using CBD and THC, two of the main compounds found in cannabis, while pregnant or breastfeeding, Insider's Julia Naftulin previously reported.

But still, cannabis use during pregnancy appears to be on the rise, perhaps as a way to cope with nausea. According to a January 2019 letter in JAMA Pediatrics, marijuana use during pregnancy in the U.S. increased from 2.9% in 2002 to 5% in 2016.

MIAMI (WSVN) - Florida Gov. Ron DeSantis addressed coronavirus testing in Orlando Friday, where he criticized businesses, especially restaurants, for demanding negative test results from their employees before allowing them to return to work.

“The problem with demanding a negative test is these PCR tests will pick up just particles, so it could be dead virus,” he said, “and the CDC has seen people test positive for up to 12 weeks. Obviously, you only carry live virus for a very short period of time.”

His comments come after the Florida Department of Health reported another 7,686 new COVID-19 cases statewide, marking nearly a week with under 8,000 daily reported cases.

Two people were shot, more than 100 people were arrested and 13 police officers were injured as crowds broke windows and looted stores along Michigan Avenue and on the Near North Side overnight and into Monday morning.

Supt. David Brown called the looting “pure criminality” in a news conference Monday morning, not connected to any protest.

“Criminals took to the streets with the confidence that there would be no consequences for their actions,” Brown said, adding that police would aggressively pursue cases against people involved in the looting.

“You have no right, no right to take and destroy the property of others,” Mayor Lori Lightfoot said at the news conference. “We are coming for you. ... I don’t care what justification was given for this. There is no justification.”

The police have started a neighborhood protection plan, and Brown said a team of detectives has been assigned to scour security footage of all incidents.

Access to downtown will be restricted from 8 p.m. to 6 a.m., effective Monday night, Brown said.

For several hours this morning, there were no bus or train service in the area bordered by Fullerton and Ashland avenues and Cermak road for several hours, the CTA said. The transit agency was in the process of restoring normal service shortly before 8 a.m.

All downtown bridges except LaSalle Street were raised. The Chicago Department of Transportation said they were being lowered again as of 7:15 a.m., but ongoing street closures could be expected throughout the downtown area.

Brown said “the seeds for the shameful destruction we saw last night” started with a police-involved shooting in Englewood Sunday afternoon. About 2:30 p.m., officers responded to a report of a man with a gun. He fled as they arrived, Brown said, and fired at officers. They returned fire, striking the man, who was taken to the University of Chicago Hospital and is expected to survive. The 20-year-old man had previously faced charges of domestic battery, reckless conduct and child endangerment, Brown said.

After the shooting, a crowd gathered in the area. “Tempers flared, fueled by misinformation,” Brown said. Shortly after that, police became aware of “several social media posts” about looting planned downtown. He said the department reacted by deploying 400 officers to the downtown area.

In this episode of People's Party, Talib Kweli and co-host Jasmin Leigh sit down British-born rapper, actress, radio personality, and fully-fledged member of the Native Tongues collective -- Monie Love.

The conversation with Monie evolves into a wide-ranging discussion starting with her childhood, growing up in London, and being heavily influenced by her father's Jamaican heritage. She goes on to give her unique perspective on the current anti-immigration sentiments being spread by groups like ADOS, she tells the story of how she came to be part of the Native Tongues collective at the age of 16, and outlines that organic induction being based on "vibes".
