BBC - Spencer Elden, 31, said his appearance on the front of the Nevermind record constituted child sexual abuse.

But the judge said he had left it too late to claim he had been exploited.

Mr Elden's legal avenues are now all but exhausted as he cannot re-file the case, but his legal team told US media he would appeal against the ruling.

The lawsuit focused on a photograph of Mr Elden, which depicted him swimming naked in a pool towards a dollar bill pierced with a fish hook.

He argued that he had been unable to consent to the picture being used. He was seeking $150,000 in damages.

Photographer Kirk Weddle was among the defendants, as were former Nirvana members Dave Grohl and Krist Novoselic, as well as Courtney Love, the widow of late singer Kurt Cobain.

Mr Elden filed his case in 2021, arguing that he was still within his rights to complain about the decades-old image because it had continued to cause him distress and lost earnings into adulthood.

The lawsuit was dismissed and then re-filed in January.

The Los Angeles judge ruled on Friday that Mr Elden lodged his case well beyond the 10-year statute of limitations.

Welcoming the verdict, a defense lawyer said the case had been "meritless."

Mr Elden's parents were paid $200 for the photo in 1991 by what was then a relatively unknown band.

Worldwide sales of Nevermind went on to surpass 30 million, making it one of the best-selling albums of all time.

(CNN) An executive at Black Lives Matter Global Network Foundation (GNF), is accused of "syphoning" more than $10 million from donors, the grassroots arm of the BLM organization said a court filing this week.

The suit is against executive Shalomyah Bowers, the foundation itself, Bowers' consulting firm & unnamed individuals.


Bowers was hired by BLM in 2020 to help run the Black Lives Matter Global Network Foundation (GNF), an extension of the Black Lives Matter grassroots organization.


Bowers denied the claims leveled in the suit, saying in a statement the accusations are "harmful, divisive & false."

GNF was originally created by Cullors "as an administrative organization to raise funds to provide financial support for local-level community efforts of BLM Grassroots," the suit said, while the BLM Grassroots organization did the "on-the-ground" work.

Bowers was also supposed to disclose certain financial and organizing information other leaders within the group, but "refused" to so, the suit alleges.

The suit also said Bowers changed social media account passwords for the grassroots organization & tried to "to register the trademark of BLM Grassroots using the logo & design of BLM Grassroots leader Angela Waters, in what appears to be an attempt to 'steal' the logo or prevent BLM Grassroots from utilizing."


"Mr. Bowers continues to fraudulently raise money from unsuspecting donors passing himself off as the organization that is doing the work of BLM, padding his own pockets at that of his associates at the cost of BLM's reputation," the suit said.


The grassroots organization arm of the organization is asking for a jury trial & accuses Bowers of unfair businesses practices, fraud & intentional misrepresentation.

PLAINFIELD, Ind. (Fox59) — Police confirmed a body matching the description of a missing 4-year-old autistic girl who has been missing since Thursday was recovered from a retention pond located near where she went missing.

On Thursday, Fiedwenya “NeeGee” Fiefe went missing. A Silver Alert was issued for the missing child & searches continued into Friday in the Legacy Farms neighborhood area in hopes of finding her.

“Despite the valiant efforts of our citizens, volunteers, police, fire, along with local and state agencies, the search for missing NeeGee has come to a devastating & heartbreaking end,” Plainfield police said.

Police said the Hendricks County Coroner’s Office will determine the child’s identity for exact confirmation. Police said the body of the child did match the description of NeeGee, however.

A woman who identified herself as NeeGee’s mother said there had been a miscommunication that played a part in the child going missing & that she had mistakenly thought the girl was with her grandmother.

According to the woman, Fiedwenya has autism & may have wandered off. The girl is non-verbal & attracted to water.

WELDON, Saskatchewan, Sept 5 (Reuters) - 2 men suspected of killing 10 people in a stabbing rampage that devastated an indigenous community in Canada were still at large on Monday as police tried to determine a motive for attacks that shocked a nation where mass violence is rare.

Police launched a manhunt for Damien Sanderson, 31, & Myles Sanderson, 30, after they allegedly stabbed people in 13 different areas across an indigenous community & its surrounding province on Sunday. At least 15 others were wounded.

The attacks in Saskatchewan province were among the deadliest in Canada's modern history. A statement by indigenous leaders indicated they may have been drug-related. Police said some of the victims appeared to have been targeted, while others were apparently random. 

Indigenous people account for less than 5% of Canada's population of about 38 million and suffer from higher levels of poverty and unemployment than other Canadians and also have a shorter life expectancy.

Prime Minister Justin Trudeau said his government had been in direct communication with the James Smith Cree Nation leadership, adding, "we are ready to assist in any way we can."

MEMPHIS, Tenn. (Action News 5) - The old saying goes: “crime doesn’t pay.” Being a Good Samaritan Friday evening didn’t pay either for a Memphis father. His car, with his 3 children inside, was stolen by a crash victim he had pulled over to assist.

“I stopped to help & almost lost everything,” he said. “We have to stay closer because everything can be gone in the blink of an eye.”

Bryon’s “everything” is 2-year-old Brandon, 4-year-old Chloe & 6-year-old Olivia. His children are safe after becoming the latest victims of the car theft epidemic in Memphis.

“I got carjacked. I stopped to help & I got carjacked,” Bryon said, “and I’m going to pray because God was on my side.” Bryon said he pulled over to help the folks involved in a crash. The driver of a stolen white KIA.

Witnesses said he told them he needed to leave the accident scene, but they weren’t comfortable driving him away. Moments later, he got into Bryon’s brown Toyota Avalon & took off, taking Bryon’s 3 startled children with him. “I’m going to pray for our city,” said Bryon, “because the young ones don’t have any guidance & they need guidance.”

Neighbor Derick Taylor watched in disbelief as the suspect drove off with the children. He & Bryon hopped into his truck to go after him.

“The world we live in is just ridiculous now,” Taylor said. “You can’t even offer help. It’s ridiculous,” said Taylor. MPD said the car thief let the children out in front of a house. All 3 unharmed.

“This has got to stop,” he said, “It could have been much worse. I’m just glad I got my babies.”

Both Bryon & Derick Taylor refuse to let what happened to them change their Good Samaritan ways.

“You can’t help your heart. If your heart tells you to help somebody,” said Bryon, “you’re going to help somebody. God had me. So, I’ll leave it at that.”

MONROE COUNTY, Miss. (WCBI) – A three-year-old missing persons case may be wrapped up after a surprise confession.

Monroe County Sheriff Kevin Crook has been in law enforcement for more than 20 years & he’s seen a lot - but Tuesday was a first.

“James Eric Crisp walked into my office, of his own free will & confessed to having killed Mr. Taylor,” Sheriff Crook said.

Forty-eight hours later, Crisp, 37, was being led into Monroe County Justice Court for a bond hearing on 1 count of manslaughter for the death of 48-year-old Roger Loyd Taylor of Sulligent, Alabama.

Crisp said he killed Taylor on March 10, 2019 & disposed of the victim’s body.

Taylor’s truck was discovered in Monroe County a couple of days after he was reported missing. Searches since then have turned up no evidence & the case went cold until this week.

Crisp has prior arrests for drug-related charges, but during his time as a resident at a Christian discipleship program called “God’s House of Hope,” the sheriff says Crisp had a life-changing encounter.

“By his own testimony, he got saved 3 years ago, was in a recovery center, we sent him there, he is now a teacher & preacher in that program,” Crook said.

Acclaimed Nova Scotia battle rapper Pat Stay was the victim of a fatal stabbing in downtown Halifax early Sunday.

Halifax Regional Police have not identified Stay as the victim, but Stay's brother, Peter Stay, confirmed the news.

Police said they were called to the 1600 block of Lower Water Street around 12:36 a.m.

Stay was taken to hospital, where he later died.


The Dartmouth, N.S., man was revered for his work in rap battles, where two rappers confront each other in front of an audience using a mixture of boasts, insults and rhymes.

Stay had a large social media following and put out a new track two days ago that has already amassed more than 50,000 views on YouTube.

The video even includes a brief quote from Canadian rapper Drake, who praises Stay.

"Pat Stay's definitely one of, if not, the best," he said in the video.


In 2015, Stay won a rap battle put on by the hip-hop superstar.

GALVESTON, Texas (KTRK) -- A suspected drunk driver has been charged with murder after a 14-year-old was killed in a car crash Friday night.

Keith Brazier, 28, is charged with the murder of Mason Nelson, 14, & is currently in custody on a $500,000 bond.

Texas prison records show that Brazier was in prison, serving a 3-year sentence for driving while intoxicated & cocaine possession. Records show that he was convicted in December 2021 & given 109 days of jail credit.

He originally was slated to serve in prison until September of 2024. Prison records show he was granted parole on Friday, the day of the fatal crash.

Galveston County court records show Brazier had 3 DWI convictions over 5 years.

On Saturday, investigators said the 14-year-old was killed when a Jeep he was riding in was broadsided by a speeding SUV driven by Brazier, which ran a red light.

Mason was 1 of 5 people in the Jeep when the Toyota SUV slammed into the vehicle. Two of the Jeep passengers are in critical condition.

A passenger in the Toyota with Brazier was also injured in the crash & was in the hospital in critical condition.

Galveston police confirmed that Mason was pronounced deceased at the scene & all others were transported to the Trauma Center at John Sealy Hospital at UTMB Health in Galveston.

Investigators believe alcohol is a contributing factor & charges are forthcoming.

Nine migrants died after being swept downriver while attempting to cross the Rio Grande at the Texas border, Customs and Border Protection confirmed to Axios.

The big picture: The migrants were passing through Eagle Pass, a town in southern Texas that has become "a major entry point for migrants," the New York Times reports.

*At least 37 of the 53 migrants taken into custody were rescued from the river on the American side of the border, CBP told Axios in a statement.


*Six migrants were found drowned by U.S. officials, CBP said. Mexican authorities found another six dead on their side of the border.


*Local authorities are still searching the area for more potential victims.

*Authorities told the New York Times that "fierce currents had swept a number of migrants downstream" while trying to cross the border.


*The fire chief in Eagle Pass told NYT that drownings have become rather common at the Rio Grande in recent years. He pointed to an incident in July when 12 dead bodies were recovered at the border.
