The gunman accused of murdering 12 people and inuring 58 others inside an Aurora, Colorado movie theater during a showing of The Dark Knight Riseslast Friday made his first appearance in court today.
24-year old James E. Holmes appeared to be heavily sedated throughout the proceeding. He struggled to keep his eyes open and was barely focused as Judge William B. Sylvester spoke.
The hearing, known as an advisement, took place at the Arapahoe County Justice Center.
Holmes wore a maroon jumpsuit while sitting next to his defense attorney. His feet were shackled and it has been reported that he has been wearing a bullet proof vest while in jail to keep other inmates from stabbing him.
Prosecutors will formally file charges on July 30th. District Attorney Carol Chambers said her office is considering the death penalty against Holmes.

Common: There was a moment in hip-hop when I went to SOB’s and I saw Kanye perform before he came out with The College Dropout. INDIANAPOLIS (AP) — The NCAA slammed Penn State for the Jerry Sandusky sex abuse scandal Monday with an unprecedented series of penalties, including a $60 million fine and the loss of all the school's victories from 1998-2011, knocking Joe Paterno from his spot as major college football's winningest coach.
Other sanctions include a four-year ban on postseason games that will prevent Penn State from playing for the Big Ten title, the loss of 20 scholarships per year over four years and five years' probation. The NCAA also said that any current or incoming football players are free to immediately transfer and compete at another school.
NCAA President Mark Emmert announced the staggering sanctions at a news conference in Indianapolis. Though the NCAA stopped short of imposing the "death penalty" — shutting down the Nittany Lions' program completely. But the punishment is so severe, it's more like a slow-death penalty.
Sandusky, a former Penn State defensive coordinator, was found guilty in June of sexually abusing young boys, sometimes on campus. An investigation commissioned by the school and released July 12 found that Paterno, who died in January, and several other top officials at Penn State stayed quiet for years about accusations against Sandusky.

Emmert fast-tracked penalties rather than go through the usual circuitous series of investigations and hearings. The NCAA said the $60 million is equivalent to the annual gross revenue of the football program. The money must be paid into an endowment for external programs preventing child sexual abuse or assisting victims and may not be used to fund such programs at Penn State.
"Football will never again be placed ahead of educating, nurturing and protecting young people," Emmert said.
By vacating 112 Penn State victories over a 14-year period, the sanctions cost Paterno 111 wins. Former Florida State coach Bobby Bowden will now hold the top spot in the NCAA record book with 377. Paterno, who was fired days after Sandusky was charged, will be credited with 298 wins.
The scholarship reductions mean that Penn State's roster will be capped at 65 scholarship players within a couple of seasons. The normal scholarship limit for major college football programs is 85. Playing with 20 less is crippling to a program that tries to compete at the highest level of the sport.
Emmert had earlier said he had "never seen anything as egregious" as the horrific crimes of Sandusky and the cover-up by Paterno and others at the university, including former Penn State President Graham Spanier and athletic director Tim Curley.
The investigation headed by former FBI Director Louis Freeh said that Penn State officials kept what they knew from police and other authorities for years, enabling the abuse to go on.
There had been calls across the nation for Penn State to receive the "death penalty," and Emmert had not ruled out that possibility as late as last week — though Penn State did not fit the criteria for it. That punishment is for teams that commit a major violation while already being sanctioned.

Penn State has already agreed to not fight the sanctions.
Emmert said the university and the NCAA have signed a consent decree, essentially a pact signing off on the penalties.
"This case is obviously incredibly unprecedented in every aspect of it, as are these actions that we're taking today."

Michael Jackson's 82-year old mother has been reported missing in the midst of a growing dispute between several of Jackson's children and her advisers over her finances and legal affairs.
Katherine Jackson was reported missing by her nephew, Trent, after her grandchildren were unable to get in touch with her for a week according to CNN.
Jermaine Jackson disputed the claim. He tweeted that his mother is following doctors orders and resting.
"Outsiders, from Alan Duke to TMZ 'sources', can clutch at straws all day long but no-one can tell us about events concerning our own mother," Jermaine tweeted. "I want to reassure everyone (inc all sudden medical experts) that Mother is fine but is resting up in AZ on the orders of a doctor, not us."
Several hours later Michael's daughter Paris, disagreed with Jermaine and asked for help in finding her grandmother.
"Yes , my grandmother is missing . i haven't spoken with her in a week i want her home now," Paris tweeted. "If anybody sees my grandmother , please call the authorities or this number— (818)-876-0186 it's the security number .. thank you so much."

Australian 100 meter hurdler Michelle Jenneke caught a lot of people's attention at the World Junior Championship in Barcelona last weekend. The 19-year old did a warm up routine that looked more like she was trying out for a cheerleader squad than getting ready for a big race.
A video of her routine has since gone viral and has been viewed over 10 million times on youtube.
Jenneke won her first heat, but didn't make the final cut to the 2012 Olympics after finishing fifth overall. She has however received an offer to pose nude from the website Sex.com.
“She's the right amount of cute and sexy, not to mention her body is clearly in peak condition," Sex.com’s Martin Ellison told XBIZ. We're sad to report that Usher's 11-year old stepson has died from injuries suffered in a jetski accident in Georgia earlier this month.
Kyle Glover suffered severe head injuries when an inner tube he was being pulled in on Lake Lanier was hit by a man on a jetski. Kyle had been on life support, with no sign of brain activity since the July 8th accident.
TMZ is reporting that his mother, Tameka Foster, made the agonizing decision to take her son off of life support after it was determined the injuries were too severe to overcome.
Our prayers go out to Tameka, Usher and their families during this difficult time.
