A Texas inmate with the critical thinking ability of a first-grader has been waiting some 34 years for a new trial. And now he'll wait some more.

In a recent ruling, a judge decided that Jerry Hartfield's constitutional right to a speedy trial had not been violated — despite being imprisoned since 1980 on a murder conviction that had been overturned — because, in essence, Hartfield did not ask for a new trial.

Judge Craig Estlinbaum found the state had been negligent in failing to retry the 56-year-old man, and that his ability to adequately defend himself had diminished over time, but he ultimately ruled Hartfield was responsible for his own incarceration because he failed to seek a new trial.

The decision is the latest in a series of confusing and baffling proceedings that have kept the Bay City man behind bars since his 1976 conviction for robbing and killing a bus station worker in 1976.

Hartfield, whose IQ has been estimated at 51, claims he is innocent and that police used a false confession against him. He was sentenced to death, but his conviction was overturned in 1980 by the Texas Court of Criminal Appeal, which ruled a juror had been improperly dismissed for voicing concerns about capital punishment.

Prosecutors twice tried to persuade the court to reconsider that ruling, but failed.

 

And then things began to legally fall apart for Hartfield.

Then-Gov. Mark White, at the urging of prison officials, commuted Hartfield's sentence from death to life imprisonment in 1983. Whether he had been informed that Hartfield's conviction had been overturned is not known, according to Hartfield's current attorney, Jeffrey Newberry of the Texas Innocence Project.

What is now known, however, is that the governor's commutation was issued in error, Newberry said.

"He couldn't commute the sentence because there was nothing left to commute," Newberry told the Daily News Friday. "Mr. Hartfield should have had a new trial. But he didn't get one."

He didn't get one because he had no legal counsel after his trial.


In this proclamation, then-Gov. Mark White commuted Jerry Hartfield's death sentence to life in a Texas prison. But Hartfield’s attorney says the governor’s act was a mistake.


"So he just sat there," Newberry said.

Fast-forward to 2006, when a fellow inmate told Hartfield that he should have received a new trial after his conviction was overturned.

"Someone helped him write documents on his own saying 'Hey, I never got my new trial,''' Newberry said. Eventually, his handwritten legal filings resulted in him receiving a court-appointed attorney while he fought to be released.

Over the next eight years, his case bounced from federal court to state courts. Meanwhile, the murder weapon, a pick-axe, has been lost and witnesses have died.

In a jailhouse interview last year, Hartfield said he was not angry about what happened to him.

He became a Christian behind bars, he said. “Being a God-fearing person, he doesn’t allow me to be bitter,” Hartfield said. “He allows me to be forgiving.” Newberry said he is appealing last week's most recent ruling in Hartfield's case.

He disputes Judge Estlinbaum assertion that no evidence was submitted of Hartfield's mental incapacity. He also disputes the logic of the decision, saying the judge essentially ruled "Mr. Hartfield's right to a speedy trial had not been violated … because the fact that he waited (to request a new trial) was an indication that he didn't want a new trial," Newberry said.

Separate proceedings to retry the criminal case are also underway, the attorney said. A hearing on that matter is scheduled for next month.

In October 2012, we posted a story about Amanda Todd. She was 15-years old at the time she committed suicide after being stalked and blackmailed into exposing herself on webcam by someone she had never met.

This horror story began when Amanda was in the seventh grade. She went into an online chat room and made the mistake of giving into a guy's request to expose her breasts on webcam. Fast forward a year later and the man somehow tracked her down on Facebook. He knew where she lived, her relatives names and what school she attended. He told her if she didn't continue to expose herself he would send photos of her breasts to everyone she knew.

Amanda did as she was told, but her stalker sent compromising photos to everyone she knew anyway. After being bullied by schoolmates, attempting suicide and changing schools, Amanda made a video using note cards to describe her ordeal.

I'm struggling to stay in this world, because everything just touches me so deeply. I'm not doing this for attention. I'm doing this to be an inspiration and to show that I can be strong. I did things to myself to make pain go away, because I'd rather hurt myself then someone else. Haters are haters but please don't hate, although im sure I'll get them. I hope I can show you guys that everyone has a story, and everyones future will be bright one day, you just gotta pull through. I'm still here aren't I ?

The video was uploaded on September 7, 2012. On October 10, 2012, Amanda committed suicide at her home in Port Coquitlam, British Columbia, Canada.

It's taken a while, but police have finally made an arrest in the case. A 35-year old Dutch man, identified as only as "Aydin C" because of Dutch privacy laws, is in police custody.

According to the New York Daily News, Ayden C has been arrested in the Netherlands and charged with extortion, luring, criminal harassment and possession of child pornography for the purpose of distribution.

Ayden C was taken into custody in January 2014. However, the news of his arrest and connection to Amanda is just now being reported.

"The suspicions against the man are that he approached underage girls via the Internet and then seduced them into performing sexual acts in front of a webcam," prosecutors said in a statement. "He is suspected of subsequently pressurizing them to participate in making new material."


Dutch police suspect he has victimized girls in the U.S., Britain, Canada and the Netherlands. 

Ayden C is also accused of blackmailing men by pretending to be an underage boy and convincing them to perform sex acts on camera, then threatening to turn them over to police.

Canadian authorities want to extradite Ayden C and prosecute him for the crimes committed against Amanda, but Dutch officials say he must go through the legal process there first.

His lawyer, Christian van Dijk, said he doesn't think prosecutors have enough evidence to convict his client.

"Prosecutors seem to think they have a big fish here, but if I see the evidence, it's not much," he said. "Lots of references to IP addresses and such."

Amanda's cry for help can be viewed below. Her mother hopes the video will help others who are being bullied.

To celebrate the 20th anniversary of Nas's classic album, Illmatic, the Los Angles Leakers have re-released their 2008 Skillmatic mixtape, which features many of Nasir's best joints.

Tomorrow is the 20 year anniversary of possibly the BEST Hip-Hop album (depending who you ask) EVER recorded, Illmatic. With that, we wanted to re-release a tape we did with Nas back in 2008, before we were the “L.A. Leakers,” before we had Twitter or Instagram, and before we had any sense of what a good intro sounded like…. Haha! This was what first gave us the idea to do our audio-biographies that we do. We didn’t fully have the idea down yet, but going back and listening made us want to know stories more in detail and that’s when we did our first REAL audio-biography.
