HOUSTON, Texas (KTRK) -- The man who is facing three capital murder charges after being accused of killing three members of the same family last week was not given a bond.
Over the weekend, a judge denied bond for 28-year-old Xavier Davis in relation to the shooting death of a 6-year-old & her family.
"There is a risk to community safety," said the judge. "The bond amounts as stated are necessary & reasonable to ensure safety of the community & prevent flight from prosecution."
Davis was arrested last Thursday in an unrelated family violence charge, authorities said.
He is accused of shooting Harmony Carhee, 6, & her parents, Donyavia Lagway & Gregory Carhee, in their Fondren Road apartment last Wednesday night. Harmony's 10-year-old sister was also shot, but she played dead during the rampage before using FaceTime to call her grandmother.
The 10-year-old was released from the hospital on Friday & is recovering from her injuries. She told police the man believed to be Davis knocked on the door of the apartment before the rampage.
He had a mask on & grabbed her 1-year-old baby brother by the hair & threw him, the little girl told police. He then shot the victims in the head.
She said she played dead & when the killer left, she got her brother & locked the door.
Davis has been charged with aggravated assault with a deadly weapon in the 10-year-old's shooting.
Even if Davis does make bond, the judge has essentially ordered him to be under 24-hour house arrest. He is expected to have a GPS monitor installed within five calendar days.
The judge also ordered that Davis is not to go within 200 feet of 12101 Fondren Road.
"I'm purposefully not putting an apartment number in there," the judge said. "I want him to stay away from the apartment complex."
He did not appear in court Sunday due to medical reasons, but he is expected to be in court Tuesday.

MOUNT LAUREL, N.J. (CBS Philadelphia) — Hundreds of protesters gathered outside a South Jersey townhome Monday afternoon. They gathered outside 45-year-old Edward Cagney Mathews’ home in Mount Laurel after video of his racist rant against his neighbor went viral.
Late Monday evening, police took the man into custody.
Protesters were angry that Mathews, seen in videos using racial slurs, was charged with harassment, but then allowed to return home.
New charges have emerged Monday evening as Mathews was taken into custody in dramatic fashion.
According to neighbors, the harassment went even beyond the use of racial slurs. One woman said Mathews kicked down her door and vandalized her vehicle.
It was a dramatic home removal for a man who many claim has been harassing neighbors outside of his Mount Laurel home for years.
Police were called to Mathews’ home Friday shortly after a disturbing video went viral where police say Mathews was “shouting offensive and racial slurs” at a neighbor.
“This is not Africa,” Mathews can be heard saying in the video. He allegedly continued to hurl racial slurs.
On Friday, Mathews was charged with biased intimidation and harassment.
“A judge decided that they should be on a summons so that evening, Mr. Mathews was released,” Mount Laurel Police Chief Steve Riedener said.
Monday afternoon, protestors arrived to his home, demanding police take Mathews into custody.
“This is America, we all live here, we cannot put up with this,” Alyia Robinson said.
Several years ago, Robinson’s daughter, Jazmyn, lived in an apartment below Mathews in a different nearby apartment complex. Once the recent video was shared online, she decided to upload one she had taken back.
“I’m literally in fear all the time living with my son, like what am I supposed to do?” Robinson said.
Another neighbor said that at least 10 others have been continually harassed for the color of their skin.
“He used a BB gun to shoot their windows out, he smeared dog feces all over their car,” one neighbor said.
“I totally understand why the protestors were here today. They had seen videos that weren’t available to us on Friday night that were even worse,” Burlington County prosecutor Scott Coffina said.
Once the new video was reviewed, new charges were added, including assault. The decision was made to arrest Mathews.
The protests that had remained calm all day got heated as police and SWAT units pulled Mathews from his home.
Several bottles were thrown at Mathews’ home and at the police, but many community members urged that action to stop.
Police remain on scene and say two arrests were made as mace was allegedly tossed by a member of the crowd.

(CNN) A California woman who authorities say falsely accused a Black teenager of stealing her cell phone in a New York City hotel lobby last December is now charged with a felony hate crime, according to court documents.
A New York grand jury indicted Miya Ponsetto on four charges including unlawful imprisonment, as a hate crime, endangering the welfare of a child, and aggravated harassment, according to the indictment shared with CNN by the Manhattan DA's office.
Ponsetto's attorney, Paul D'Emilia, pleaded not guilty on behalf of Ponsetto, who appeared via teleconference in a Manhattan courtroom Wednesday, according to a spokesperson for the Manhattan DA's office.
Ponsetto is accused of attacking 14-year old Keyon Harrold Jr., who was with his father, a famed musician, in the Arlo Hotel in December, when she says she thought he had her cell phone. He did not, investigators say.
The incident was widely shared on social media and Ponsetto was accused of racially profiling the teen, which she has denied.
"The charges alleged are a brazen and clear overreach of the intent of the statute. In sum, they are absurd, and a perversion of our legal system," D'Emilia told CNN in a statement.
Harrold's father, Keyon Harrold Senior, retweeted an article about the charges Wednesday, but didn't comment further.
Ponsetto is on supervised release, according to her attorney, who says her next court date won't be until October.

A medical examiner in Michigan says an autopsy has determined that Columbus Blue Jackets goaltender Matiss Kivlenieks died of chest trauma from an errant fireworks mortar blast & not a fall as authorities previously reported.
Police in Novi, Michigan, said the mortar-style firework tilted slightly & started to fire toward people nearby Sunday night. The 24-year-old Kivleniek was in a hot tub & tried to get clear with several other people, police Lt. Jason Meier said.
The fire department & EMTs got to the private home shortly after 10 p.m. & took him to a hospital, where he was pronounced dead, Meier said. The Oakland County Medical Examiner’s office reported preliminary autopsy results Monday afternoon.
The Blue Jackets and Latvian Hockey Federation announced Kivlenieks’ death, with the NHL club saying it resulted from an apparent head injury in a fall. The team’s statement made no mention of fireworks.
Columbus general manager Jarmo Kekalainen tweeted: “Life is so precious & can be so fragile. Hug your loved ones today. RIP Matiss, you will be dearly missed.” Blue Jackets president of hockey operations John Davidson called it a “devastating time” for the team.
The Latvian Hockey Federation called Kivlenieks’ death “a great loss not only for Latvian hockey but for the entire Latvian nation.”
Kivlenieks most recently represented Latvia this spring at the world hockey championship in which he played four games. He played two games for the Blue Jackets and eight for the American Hockey League’s Cleveland Monsters this past season.

A leaked recording of a phone conversation from last year has created a difficult situation at ESPN, pitting two of the network's most visible female broadcasters against each other.
The dispute goes back to last year's broadcast of the NBA Finals, when ESPN executives selected Maria Taylor over Rachel Nichols to be the primary host for the network's coverage.
An unhappy Nichols discussed her frustration with not being chosen in a phone call with Adam Mendelsohn, the longtime adviser of L.A. Lakers star LeBron James. During the call, Nichols expressed her opinion that Taylor got the assignment because the network was feeling pressure to improve its record on racial issues.
“I wish Maria Taylor all the success in the world — she covers football, she covers basketball,” Nichols said in an audio excerpt published by the Times. “If you need to give her more things to do because you are feeling pressure about your crappy longtime record on diversity — which, by the way, I know personally from the female side of it — like, go for it. Just find it somewhere else. You are not going to find it from me or taking my thing away.”
According to the Times, the call was recorded by a camera Nichols had in her hotel room that enabled her to appear on-camera from the NBA bubble. The contents were recorded to a video server at ESPN headquarters, where any number of employees could have accessed it.
At least one person recorded a copy of the call on a cellphone, the Times reports, and the contents soon spread throughout the company.
The only person disciplined over the incident, the Times said, was a digital video producer who told ESPN's human resources department she shared the video with Taylor. The producer, a Black woman, was suspended two weeks without pay and has since left the company.
Nichols explained to the Times she was “unloading to a friend about ESPN’s process, not about Maria.” She said she reached out to Taylor via texts and phone calls, but never received a response.
The tension between the two remained throughout the current NBA season, as Taylor has continued to host the network's "NBA Countdown" pregame show, with all of Nichols' segments prerecorded so they were not forced to interact.
