Case (26)

Miami Herald Reports The San Diego district attorney's office has reportedly decided against filing charges against Chargers linebacker Shawne Merriman for allegedly choking and restraining his girlfriend, MTV star Tila Tequila. The San Diego Union-Tribune posted a statement from district attorney Bonnie Dumanis saying that her office "determined there is insufficient evidence to prove beyond a reasonable doubt that any crime was committed." The report also says the case is now closed. The paper reported last Sunday that Tequila -- the star of a former reality show on MTV, whose real name is Tila Nguyen -- signed a citizen's arrest complaint that charged the linebacker with battery and false imprisonment. Deputies went to Merriman's home just before 4:00 a.m. in response to a disturbance call. Tequila reportedly told them she was choked, thrown to the ground and restrained by Merriman upon attempting to leave. Merriman was then released from custody just after 11:00 a.m. The 25-year-old Merriman is a three-time Pro Bowl selection and was named First-Team All-Pro in 2006, when he led the league with 17 sacks. Merriman, the 12th overall pick of the 2005 NFL Draft, has spent his entire four-year career with San Diego. He missed all but the first game last season because of a knee injury that required surgery.

CNN Reports Former figure skating champion and Olympian Nicole Bobek was free on bond Tuesday after New Jersey police accused her of being part of a drug ring. Nicole Bobek waves after a routine at the World Figure Skating Championships in 1995.

Bobek, 31, who won the U.S. figure skating title in 1995, was arrested at her home in Jupiter, Florida, last week on a charge of conspiracy to distribute methamphetamine in Hudson County, New Jersey, according to Guy Gregory of the Hudson County prosecutor's office. She waived extradition rights to face the charges in New Jersey and made her first appearance in court on Monday via video, entering a plea of not guilty, Gregory said. Bobek was released Monday night on bond, according to Sean Wilkes of the Hudson County Jail. According to the prosecutor's office, 20 people have been arrested in connection with the alleged drug ring, which police have been investigating for nearly a year. Bobek could face up to 10 years in prison if convicted. Her attorney, Sam DeLuca, was not immediately available for comment.

Immediately after Chris Brown's plea deal was announced on Monday (June 22), speculation began as to whether the 20-year-old singer was let off the hook too easily for allegedly assaulting his former girlfriend, Rihanna. Brown avoided jail time and instead was sentenced to 180 days of labor service in Virginia, five years of probation and was ordered to attend a domestic-abuse program for a year. In addition to the deal that was reached, Brown was also issued a "stay away" order by the judge hearing the case. According the guidelines of the "stay away," Brown isn't to have any contact with Rihanna during the duration of his probation period. In the event both celebrities appear at a function, Brown is to remain a certain distance away from his onetime girlfriend and Rihanna isn't to contact him either. Many think Brown received only a slap on the wrist for what he pleaded guilty to, but legal expert Peter T. Haven thinks Brown may have actually gotten more than he bargained for. "It sounds good on the surface — no jail time — but in many respects, it's a pretty tough deal," Haven told MTV News. "He has to do 180 days of labor service. In California, for instance, we're used to seeing guys in jumpsuits picking up trash on the freeway or weeding. Labor service is not gonna be easy. You have to get up super early, you have to be there almost before the sun comes up and work until 2 or 3 [p.m.]. Then he has to do 52 weeks of sitting in a class for two hours every week. He almost gave up a year of his life — that's an indication that the prosecution probably had a pretty good case and [Brown] really didn't want to do any jail time." Brown was offered 180 days of jail time as an alternative to labor service, which Haven described as "hot, tough, hard work." Haven suggested that jail time might have been an easier option for Brown. The singer will be formally sentenced on August 5 and Haven suspects the 180 days may be reduced to a shorter time span at that hearing. A brief sentence could easily be reduced even further for good behavior if Brown did serve time. "It's not a walk in the park [either way]," Haven explained. "But, say if he did jail time as a part of his plea, he probably wouldn't have served the full term — he probably would have done less. He would have gotten out earlier and the whole thing would have been done. When you're in jail, it's also hard to violate the terms of your probation. When you voluntarily take it upon yourself to take these things on yourself and have to show up yourself, that leaves a lot of room for error." Further complicating matters is that Brown's 180 days of service could be spread out over years. Meanwhile a short jail stay could potentially be "easier and cleaner," Haven said. "Some lawyers have recommended jail to their clients," he said. "Because if you screw up, you're gonna get more than just 180 days." Source: MTVNEWS

On Monday night, some of Hollywood's biggest stars descended on the Mann Village theater for a huge premiere, celebrating the summer's biggest, loudest, most high-profile movie. But on the "Transformers: Revenge of the Fallen" red carpet, moments before the film was unveiled, the day's news involving Chris Brown and Rihanna was on everyone's lips. "Violence is never the answer — even if provoked," reasoned Aubrey O'Day, the former Danity Kane member and "Making the Band" star who had just heard the news that Brown accepted a plea deal. "But with bigger issues like war, we just need to let go and forgive. Let people move on." Look Back At The Timeline Of The Case Here "I just wish they were here," "Transformers" co-star Tyrese said of Chris and Rihanna, explaining that the escapism of a film like "Revenge of the Fallen" is helpful during difficult times. "[It would help them] to embrace this energy at this premiere." Sure enough, a huge crowd had poured out for "Fallen" — but as the stars tried to promote their Friday release, it was hard to ignore the news that had broken just a few hours earlier. "I wish [Chris Brown] luck," confessed "Gossip Girl" actress Taylor Momsen, who was doubtful that the plea deal was the final chapter in the Chris Brown-Rihanna drama. "People like to obsess over personal lives — so I'm sure it's not the end." "I support both artists," said Ciara, who has toured and recorded with both Brown and Rihanna. "It's a very personal process." All-American Rejects member Nick Wheeler, however, was a bit less diplomatic. "If it was just a regular dude, would [the sentence] have been the same?" he asked, posing a question on the minds of many who believe Brown's celebrity helped him in the courtroom. "No one should turn a blind eye to [abuse]. He should get what he gets. "We did a show with Rihanna a couple years ago," Wheeler added. "And she was nice." "I wish them well," explained Anthony Anderson, a star of the original "Transformers" film, who said that he'll continue to buy Chris Brown albums whenever the troubled singer decides to move forward. "I'm not going to let a personal instance taint my opinion of someone musically." "He's incredibly talented," Aubrey O'Day agreed. "Regardless of his personal decisions, I will always support his music." Source: MTVNEWS

DNA Doesn't Match In DJ Bay Bay Rape Case

DNA results from the two year rape trial of DJ Hollyhood Bay Bay do not match the industry veteran, AllHipHop.com has confirmed. Hollyhood Bay Bay, real name Terrance Stewart, was arrested in 2007 and charged with one count of rape and intimidation of a witness. According to prosecutors, the DJ raped a woman who was found drunk and unconscious on the second floor of club Kokopelli’s, located in Shreveport, Louisiana. The ensuing DNA test used semen retrieved from the alleged victim, and the couch where the crime occurred. “I believe everything happens for a greater reason and purpose. I was terminated from one station, only to be recruited by the fourth largest black radio station in the country, so there are no hard feelings,” DJ Hollyhood Bay Bay told AllHpHop.com. “I’m just ready to conclude this chapter in my life and get back to what I do, finding the next multiplatinum success story. Bay Bay previously gained national recognition courtesy of Hurricane Chris’ hit tribute song “Ay Bay Bay,” which was inspired by fans who would chant the DJ’s name at club appearances. The rape accusation has proved damaging to Hollyhood’s career over the last two years. The fallout resulted in him being terminated from his position at Shreveport’s 103.5 The Beat, and losing his longtime club MC position at Kokopelli’s. He later signed on to Dallas’ KKDA 104.5, and maintains a weekly radio slot from 3PM from 7PM. Despite the serious accusation that has lingered over his head, DJ Hollyhood Bay Bay feels he’s been blessed with a better opportunity in Dallas and is hopeful the charges will soon be dropped. "This entire situation is unfortunate, but all I can do is continue to live my life until it is over and I am fully cleared of all charges,” added DJ Bay Bay. Since relocating to Dallas, the DJ assisted rapper Dorrough in closing a deal with E1 Music. On the community service front, he founded Bay Bay’s Kids, which aims to decrease high school dropout rates through education-focused speaking engagements and camps. At press time, Caddo Parish District Attorney Brady O’Callaghan has not dropped the rape charges against DJ Hollyhood Bay Bay. Source:allhiphop.com
