The Justice Department has opened an investigation into Indianapolis police Sgt. Eric M. Huxley after he kicked a man in the face during an arrest in downtown Indianapolis.

"Our office and the FBI have opened an investigation, and if the investigation reveals prosecutable violations of any federal criminal statutes, the Department will take appropriate action," acting U.S. Attorney for the Southern District of Indiana John E. Childress said in a prepared statement Wednesday.

The announcement comes a day after prosecutors charged Huxley with official misconduct and battery with moderate bodily injury, both of which are felonies.

Body camera footage played during a police news conference Tuesday showed Huxley kick a homeless man accused of disorderly conduct, Jermaine Vaught, in the face, causing his mouth to bleed September 24, court documents said.

Huxley, a 14-year veteran of the force, has been suspended without pay. Police chief Randal Taylor has recommended Huxley be removed from the department.

"I'm upset," Taylor said before showing video of the arrest. "It hurts me to see any of our officers treat someone the way you're going to see here. There is no excuse for it."
