Kanye West will probably have to cough up a chunk of money after being sued for allegedly not clearing the sample used in his song "Bound 2" off of the album, Yeezus.
56-year old Ricky Spicer filed the lawsuit in Manhattan Supreme Court on Monday. He wants West to pay up immediately or pull the song.
Spicer was a member of teen R&B group Ponderossa Twins Plus One. In 1971 they released the album 2+2+1 which contained the song "Bound." Spicer was 12-years old when he recorded the hook that can be heard in West's version.
According to Spicer, he has a copyright “in the sound recording of his voice in the song.” The singer claims that he was never contacted by West or his representatives to gain permission. He first heard "Bound 2" on the radio and decided to file the lawsuit.
“Mr. Spicer’s voice is sampled exactly as he recorded it,” the suit claims.
Island Def-Jam Music, Roc-A-Fella Records, Rhino Entertainment and Universal Music Group are also named in the suit.
At this point in his career West has cleared hundreds of samples, which makes it hard to understand why he wouldn't clear the "Bound" sample because one listen to it and it immediately becomes clear that it was used in "Bound 2." It's possible he cleared it through another company because there is confusion as to who owns the rights.
According to the Cleveland Challenger, a man by the name of Chuck Brown, Sr. claims he own's the original song's publishing. Brown says that one of several labels he owned recorded the song.
Brown’s Saru Records was the parent company for Horoscope Records and Chuck Brown Music that owns everything from the name Ponderosa Twins Plus One to the songs they performed. On the album, “Bound” is listed on Brown’s Horoscope label.
Chuck Brown, Sr.
As of June 2013 when Cleveland Challenger published their article Brown had not been paid either. He blames the confusion on the late Joseph Robinson, Jr. and Sylvia Robinson, who once distributed his records through their companies Robinson Music Group and Gambi Music.
Both companies are listed in the production credits for "Bound 2" on West's Yeezus album.
Sounds like a big mess the courts will have to figure out. Listen to the two songs below.

For the second time in as many shows someone was shot at a Rich Homie Quan concert at the Red Zone nightclub in Columbus, Ohio.
The Atlanta rapper was performing his hit song "Type of Way" on Sunday, December 22, when someone in the crowd started shooting.
24-year old Jeremiah I. Frazier was hit by one of the bullets. He was rushed to OhioHealth Grant Medical Center, where he was pronounced dead at 5:21 a.m, according to the Columbus Dispatch.
Quan issued a statement today via TMZ.
It’s sad to hear that someone died especially during the holiday season. I just want everybody to know me nor anybody in my crew or affiliation had anything to do with the shooting in Ohio. We will be reaching out to the family of the deceased.
Back on November 9th, another man was shot at Red Zone following a Quan performance. 27-year old Freddie Johnson Jr., was shot twice in the back, but survived.
The club has a history of violent incidents and underage drinking. This year police have made more than 100 runs to the establishment.
"That's one of the most we've seen with liquor establishments in 2013," Assistant City Attorney Bill Sperlazza, told ABC6. "It's obviously a climate that is dangerous."
The Columbus City Council wants the club's liquor license yanked. A hearing regarding the permit could happen as early as February.

Warner Bros looks like they have the first must see sci-fi thriller of 2014 in Transcendence. The film is directed by longtime Christopher Nolan collaborator Wally Pfister, explores transhumanism
It stars Johnny Deep, Morgan Freeman, Cillian Murphy, Kate Mara and Rebecca Hall.
The 2:31 trailer reveals just enough to leave you wanting more. Depp plays scientist, Dr. Will Caster.
"The path to building super intelligence requires us to unlock the most fundamental secrets of the universe. Imagine a machine with the full range of human emotion," Caster tells a packed auditorium, in the trailer's opening moments. "It's analytical power will be greater than the collective intelligence of every person in the history of the world. Some scientists refer to this as the singularity. I call it transcendence."
A botched assassination attempt by an anti-tech group known as Rift leaves Caster dying from radiation poisoning. His wife makes the decision to upload his consciousness into a machine. The results are far more powerful and dangerous than she or anyone else could have imagined.
Two leading computer scientists work toward their goal of Technological Singularity, as a radical anti-technology organization fights to prevent them from creating a world where computers can transcend the abilities of the human brain.
Becoming immortal: Johnny Depp undergoes a cyber transformation in the trailer for Transcendence
Transformation complete: When Will dies he becomes a virtual person
Growing power: Morgan Freeman and Cillian Murphy become concerned when Will’s power as an AI reaches godlike proportions
The film opens nationwide on April 18, 2014.
