It's been said that divorce can be as painful as a death in the family. When there are kids involved and their parents can't reach an amicable agreement when it comes to visitation it's even worse.

 

The courts generally set rules for visitation, alimony, child support payments and the distribution of marital assets, but even then problems can still arise.

 

Case in point; the Dwayne Wade/Siohvaughn Funches-Wade divorce. In 2011, Wade was awarded custody of their two children, Zaire and Zion, with Funches receiving visitation every other weekend and on certain holidays.

As part of the divorce agreement, Funches-Wade was supposed to be paid a $1 million dollar settlement, plus $25,000 a month and an additional $10,000 a month in living and travel expenses as a part of their 2008 agreement.

 

Pretty nice settlement on paper right? Well,according to Funches-Wade she is not seeing very much of that money.

She has filed a new lawsuit claiming that funds from Wade’s endorsement deals with T-Mobile, Staples, Gatorade and Li Ning are not being deposited in joint account controlled by both of them, according to the Chicago Sun Times.

In the lawsuit Funches-Wades' attorney, William P. Suriano, claims his client has been unable to pay her mortgage or home or auto insurance. They are seeking $2 million in damages from Wade, his attorney, a financial adviser and the four companies involved in the endorsement deals.

In 2009, Funches-Wade sued Dwayne for allegedly giving her a sexually transmitted disease (STD) contracted through an through an extramarital affair. Wade sued his his ex-wife and two of her lawyers for defamation. Funches-Wade later dropped her lawsuit.

On Friday (July 19), Funches held a press conference/demonstration on the streets of Chicago to detail issues regarding the way Wade has been treating her.

She says the NBA star has scheduled a basketball camp for Zaire during her visitation time. She also claims that the parenting coordinator, Howard Rosenberg, told her if she doesn't allow her son to participate in the basketball tournament he would ask the judge to not allow her to see her kids again. Funches-Wade says she has email proof.

Funches-Wade also alleges that her own lawyer has cut deals for financial settlements with Wade without her permission.

This situation just seems to be getting worse by the day. The only hope is that the parents can set aside their differences and put the children first.



 

 

**UPDATE** July 22

After a bitter money  dispute and issues regarding custody of their children, Dwayne Wade has reached a settlement with his ex-wife Siohvaughn Funches.

Wade's attorney, Jim Pritikin, released a statement on Monday July 22.

The statement reads:

"Dwyane Wade and his ex-wife Siohvaughn Funches have reached a financial settlement. The agreement was submitted in court last Tuesday, July 16 prior to Ms. Funches' recent unfounded and erratic public display outside the courthouse this past Friday. Dwyane Wade has made several requests over the years to settle this matter, despite Ms. Funches having 16 different attorneys and 2 arrests throughout this process.  Mr. Wade has provided a very generous settlement to Ms. Funches to continue to live a wonderful lifestyle for the rest of her life.

Despite false allegations by Ms. Funches claiming to be “homeless” and “destitute,” Dwyane Wade has maintained over the years financial support to his ex-wife by providing her with income over $25,000 on a monthly basis, timely paid for her home mortgage, maintenance and security at the house, 4 cars, insurance, taxes and all of her attorney fees throughout this process. Ms. Funches has made a mockery of homelessness which is a serious and personal issue for Mr. Wade as his mother was homeless for a period of time when he was a child.

Dwyane Wade was awarded sole custody of their sons by the court in 2011. The safety and wellbeing of his children are his main priority. Due to Ms. Funches' current unstable mental state, her visitation will be determined by the court. Mr. Wade continues to hope that one day he will have a civil relationship with his ex-wife for the sake of their sons."
