Drake and Cash Money Records are facing a lawsuit from the estate of deceased jazz musician Jimmy Smith.
Smith's estate claims that Drake illegally sampled the monologue at the beginning of "Pound Cake/Paris Morton Music 2." The 35-second clip is from the song "Jimmy Smith Rap" off of Jimmy's 1982 album Off the Top.
According to the lawsuit obtained by TMZ, Drake used the sample without permission, then represented in the liner notes of his 2013 album, Nothing Was the Same, that the clip was properly licensed.
Smith's estate is seeking at least $300,000
